SEPTEMBER 29, 1998 TWELVETH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 29, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight and Welte. Clausen absent. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, County Auditor/Board Secretary, and Ann Long, Board Legal Counsel.

The Claims were approved as presented.

Meeting called to order.

The Board canvassed the Western Iowa Tech Community College from the School Board Election on September 8, 1998, for the minute book only with results as follows:

For the office of Western Iowa Tech Community College Area XII, Director District I, there were Three Hundred Ninety-three (393) votes cast, as follows:

John R. Elkins received Two Hundred Sixty-five (265) votes
Charles Semke (Write-in) received One Hundred Twenty-seven (127) votes
Calvin Kooiker (Write-in) received One ( 1) vote

We therefore declare John R. Elkins duly elected to the office of Western Iowa Tech Community College, Director District I, for the term of 3 years.

For the office of Director District III there were Nine Hundred Eighty-seven (987) votes cast as follows:

Bob Rasmus received Nine Hundred Eighty-seven (987) votes

We therefore declare Bob Rasmus duly elected to the office of Western Iowa Tech Community College, Director District III, for the term of 3 years.

For the office of Director District V there were Four Hundred Sixty (460) votes cast as follows:

Deborah J. Cook received Four Hundred Sixty (460) votes

We therefore declare Deborah J. Cook duly elected to the office of Western Iowa Tech Community College, Director District V, for the term of 3 years.

Motion Burnight second by Boykin to approve the Regular Board Minutes of September 22, 1998 as submitted. Carried 4-0.

Mr. Boykin excused himself to attend the funeral of Police Officer, Tom Skaff. Mr. Welte also announced that the agenda item dealing with E-911 surcharge issue would be postponed so that those involved could attend the funeral.

The Board approved the separation of Becky A. Clausen, Sr. Real Estate Clerk, County Auditor/Recorder, effective 9/23/98. Copy filed.

The Board approve the reclassification of Dawn E. Dvorak, Legal Secretary III, County Attorney, @$11.98/hr., effective 10-2-98. Per AFSCME Courthouse Contract Agreement, from Grade 6, Step 3 to Grade 6, Step 4. Copy filed.

Motion by Burnight second by Batcheller to approve and authorize the Chairman to sign the liquor license renewal for The Barn at Climbing Hill. Carried 3-0.

Motion by Batcheller second by Welte to purchase 20,000 pamphlets, A Statement in American Architecture from Record Printing for $3,562.50. Carried 3-0.

Motion by Batcheller second by Burnight to approve the Executive Session of September 15, 1998 as submitted. Carried 3-0.

Motion by Burnight second by Batcheller to approve the Executive Session of September 22, 1998 as submitted. Carried 3-0.

The Public Hearing and sale of Real Estate Parcel #010425 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Burnight second by Batcheller to close the Public Hearing on the sale of Real Estate Parcel
#010425 as there was no one present wishing to be heard on said sale. Carried 3-0.

Chairman called for bids on Real Estate Parcel #010425. Daniel R. Tramp bid $226.00 plus recording fees. There were no further bids.

Motion by Batcheller second by Burnight to accept Daniel R. Tramp $226.00 bid plus recording fees for Real Estate Parcel #010425. Carried 3-0.

RESOLUTION OF THE BOARD OF SUPERVIORS OF WOODBURY COUNTY, IOWA #9118

BE IS RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: DANIEL R. TRAMP

in the sum of TWO HUNDRED TWENTY-SIX AND NO/100 ($226.00) Dollars for the following described real estate to wit:

EAST FIFTY FEET (E 50 FT) OF LOT SEVEN (7) IN BLOCK FORTY (40) OF THE SIOUX CITY ADDITION. CITY OF SIOUX CITY, WOODBURY COUNTY, IOWA

now and included in and forming a part of the City of SIOUX CITY, Iowa, the same is hereby accepted; said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8 (3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of the Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

Motion by Batcheller second by Burnight to authorize the Chairman to sign Certificate of Completion for Project L-EWP 98(1)73-97. Carried 3-0. Copy filed.

Motion by Burnight second by Batcheller to authorize the Chairman to sign Certificate of Completion for Project L-EWP(28),(34)73-97. Carried 3-0. Copy filed.

Motion by Batcheller second by Burnight to authorize the Chairman to sign an application for use of highway right-of-way for underground water main facility. Carried 3-0. Copy filed.

Motion by Batcheller second by Burnight to award the contract for propane to Garold M. Smith Oil & LP. Carried 3-0. Copy filed.

Motion by Burnight second by Batcheller to award the contract for calcium chloride to Scotwood Industries Inc. Carried 3-0. Copy filed.

Motion by Batcheller second by Burnight to pursue construction of wood pilings, steel girders, and wood deck bridge for $128,000 next spring. Carried 3-0.

Motion by Burnight second by Batcheller to begin a pilot project to reimburse and individual in secondary road at $32.5/mile for use of a personal vehicle. Carried 3-0.

Doris Hansen, Independent Auditor for Woodbury County presented the audit for fiscal year ended 6/30/97.

Motion by Batcheller second Burnight to accept the audit delivered by the Independent Auditor of Woodbury County for the fiscal year ended June 30, 1997. Carried 3-0.

Charles M. Palmer, Director, Iowa Department of Human Services addressed the Board about the Countys fiscal year 1999 Mental Health/Mental Retardation plans.

Darrell Moore, the Moore Group of Nebraska Inc. discussed a proposal by Technology Change Management to address the year 2000 compliance issue.

Motion by Batcheller second by Burnight to allow the Chairman to contract with the Moore Group within the next 15 days if the Chairman sees fit. Carried 3-0.

The Board adjourned the meeting until October 6, 1998.
