OCTOBER 13, 1998 FOURTEENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 13, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight, Clausen and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, County Auditor/Board Secretary, and Ann Long, Board Legal Counsel.

The Claims were approved as presented.

Meeting called to order.

Motion by Batcheller second by Burnight to approve the Regular Board Minutes of October 6, 1998 as submitted. Carried 5-0.

Motion by Boykin second by Burnight to amend the minutes of the September 29, 1998 Board of Supervisors to include the canvass of the Western Iowa Tech Community College Directors District III and IV Election of September 8th. Carried 5-0.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign the appointment of Elizabeth A. Peterson, P/T Youth Worker, Juvenile Detention, @$10.39/hr., effective 10/07/98. Job vacancy posted: 8/19/98. Copy filed.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign the separation of Lanae C. Peterson, Correctional Officer, County Sheriff, effective 10/18/98. Resignation. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to approve and authorize Chairman to sign the appointment of Mary E. Bell, Temporary Election Clerk, County Auditor/Recorder, @ $8.63/hr., effective 10/06/98. Not to exceed 120 days. Copy filed.

Motion by Boykin second by Burnight to approve and authorize the Chairman to sign the resolution setting the Public Hearing for the Sale of Real Estate Parcels #351495 and #351510 on 10/27/98 @ 10:15 AM. Carried 5-0

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa is the owner under a tax deed of a certain parcel of real estate described as:

Lot Four (4) Block Fifteen (15) and Lots Five through Eight (5-8) inclusive, Block Fifteen (15),
Millers Addition, City of Sioux City, Woodbury County, Iowa.

NOW THEREFORE,


BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on
the 27th day of October, 1998, at 10:15 oclock a.m. in the
meeting room of the Board of Supervisors on the first floor of the
Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 27th day of October, 1998,
immediately following the closing of the public hearing.

3 That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $300.00 plus recording
fees.

4. That this resolution, preceded by the caption Notice of Property Sale
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

RESOLUTION #9120

A RESOLUTION SETTING DATE FOR PUBLIC HEARING FOR VACATING ROAD

WHEREAS, the Woodbury County Board of Supervisors in accordance with Section 306.11 (Code of Iowa) 1997), as amended, seeks to set a date for public hearing to vacate a road legally described as follows:

Vacate all that portion of county road right-of-way located in a parcel of ground lying in the following plat:

Lots 1 thru 6, 33 thru 38 in block twenty-eight (28) and Lots 1 and 6,
33 thru 38 in block twenty-nine (29), all in Morningside Addition to
Sioux City, Iowa, in County of Woodbury and State of Iowa. More
Commonly known as a dedicated location of Stoddard Street lying
Between Decatur Ave. and Wells Ave.

NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors that on Tuesday,
November 17, 1998 at 10:45 a.m. the County will hold a public hearing to vacate the

RESOLUTION #9121

A RESOLUTION SETTING DATE FOR PUBLIC HEARING FOR VACATING ROAD RIGHT-OF-WAY

WHEREAS, Woodbury County Board of Supervisors adopted a Resolution requesting the Chief
Judge of the Third Judicial District to proceed with condemnation of certain rights and lands in conjunction with the improvement of Old South Lakeport Road.

WHEREAS, the property described below as included in this application but later determined to not
be required for the project:

A tract of land located in the SE1/4 of Section 32, T88N, R47W of the 5th P.M. Woodbury County, Iowa further described as follows: Beginning at the SW corner of the SE1/4 of said
Section 32; thence north along the west line of the SE1/4 of said Section 32 for a distance of
735.0 feet; thence east for a distance of 55.0 Feet; thence south parallel to and 55.0 feet
normally distant east of the west line of the SE1/4 of said Section 32 for a distance of 735.0
feet to the south line of the SE1/4 of said Section 32; thence west along the south line of the
SE of said Section 32 the point of beginning. Containing 0.35 acres, more or less,
Exclusive of the present established road. (Said tract contains 0.93 acres, more or less,
Inclusive of the present established road). Note: The west line of the SE1/4 of said Section
32 is assumed to bear north.

WHEREAS, Woodbury County Board of Supervisors in accordance with Section 306.11 (Code of
Iowa 1997), as amended, seeks to set a date for public hearing to vacate a section of road right-of-way previously described.

NOW THEREFORE,


BE IT RESOLVED by the Woodbury County Board of Supervisors that on Tuesday,
November 17, 1998 at 10:20 a.m. CST, the County will hold a public hearing to vacate the
above described right-of-way.

Motion by Boykin second by Clausen to adopt a resolution setting a public hearing for approving the Commissioners Report. Carried 5-0.
RESOLUTION #9122

RESOLUTION APPROVING COMMISSIONERS REPORT

RE CLASSIFICATION AND FIXING TIME AND PLACE OF HEARING

WHEREAS, the Woodbury County Board of Supervisors, as the governing body of the Orton Slough Drainage District, did appoint Commissioners to reclassify the lands affected by the projected improvements in the said drainage district; and

WHEREAS, said Commissioners did qualify and have now completed the report entitled Reclassification of certain tracts of land in the Southwest Quarter (SW ) of Section Twenty One (21)l Township Eighty Seven (87) North, Range Forty Seven (47) West of the Fifth (5th) Principal Meridian, Woodbury County, Iowa, which receive benefits from improvements of the Orton Slough Drainage District which has been filed with the Woodbury County Auditor;

WHEREAS, the said Board of Supervisors finds that said report of Commissioners should be tentatively approved and that time and place of hearing upon the report should be served as provided by statue.

NOW THEREFORE, IT IS RESOLVED that the report of the Commissioners to reclassify the lands in the Orton Slough Drainage District be and the same is hereby tentatively approved.

IT IS FURTHER RESOLVED that said report shall come on for hearing as required by Section 468.45 of the 1997 Code of Iowa, on the 24th day of November, 1998, and the Woodbury County Auditor is hereby directed to cause notice to be served as required by law. This Resolution is in lieu of that Resolution dated September 8, 1998.

Motion by Clausen second by Boykin to adjourn the Orton-Slough Drainage Ditch Board of Trustees Meeting. Carried 5-0.


There was a discussion of plans and cost estimates for restoration of first and third floors of the Trosper-Hoyt County Services Building. Consensus was to put this on the agenda for next week.

Motion by Batcheller second by Boykin to approve a request from U.S. West for space at the Trosper-Hoyt County Services Building for placement of equipment. Carried 5-0.

Motion by Clausen second by Boykin to approve change orders #4 and #5 for the courthouse preservation Phase III. Carried 5-0.

Motion by Clausen second by Batcheller to authorize and approve the Chairman to sign a grant application for FY2000 well water programs. Carried 5-0. Copy filed.

There was a discussion of Siouxland District Healths building construction and financing methods.

The Board adjourned the meeting until October 20, 1998.
