FEBRUARY 12, 2002THIRTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, February 12, 2002 at 9:00 A.M. Board members present were Boykin, Clausen, Walish and Welte; Batcheller was absent. Staff members present were Karen James, Board Administrative Coordinator, Jean Jessen, Deputy/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Boykin second by Walish to approve the Board minutes of February 5, 2002 as submitted. Carried 3-0. Welte abstained.

Motion by Boykin second by Walish to approve the minutes of the first Executive Session of February 5, 2002 as submitted. Carried 3-0. Welte abstained.

Motion by Boykin second by Walish to approve the minutes of the second Executive Session of February 5, 2002 as submitted. Carried 3-0. Welte abstained.

The Board approved the separation of Ryan T. Denney, Correctional Officer, County Sheriff Dept., effective 2-22-02. Resignation. Copy filed.

The Board approved the end of probation for Brett P. Lambert, Equipment Operator, Secondary Roads Dept., $14.29/hr., effective 2-15-02. Per C.W.A. Contract agreement / End of Probation Salary Increase. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign the authorization to initiate hiring process, but to suspend the initiation of hiring effective March 15, 2002, for a Male Correctional Officer, County Sheriff Dept., DSA Entry: $13.24/hr. Carried 4-0. Copy filed.

Motion by Welte second by Walish to appoint Gretchen Schlage, Bob Moritz, Bob Seitzinger, and Chuck Johnson to Loess Hills Alliance Board of Directors. Carried 4-0. Copy filed.

Motion by Boykin second by Walish to approve a resolution for suspension of taxes for M.L.U. and S.J.U. Carried 4-0.

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

WHEREAS, June F. Nave as titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

RESOLUTION NO. 9543

RESOLUTION ACCEPTING AND APPROVING MAHINS SUBDIVISION, WOODBURY COUNTY, IOWA

WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 28TH DAY OF JANUARY, 2002, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS MAHINS SUBDIVISION; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT;

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE PLAT OF MAHINS SUBDIVISION BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRMAN AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNERS AND PROPRIETORS A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

Motion by Walish second by Boykin to approve Change Order #2Courthouse Restoration Phase IV, for electrical and data boxes for courtroom. Carried 4-0. Copy filed.

Motion by Boykin second by Walish to approve Woodbury County Sheriffs Office, Reserve Association request to erect a building on County property at the Prairie Hills Center, contingent upon successful grant award by Missouri River Historical Development, Inc. Carried 4-0. Copy filed.

Motion by Welte second by Boykin to reduce the Planning and Zoning Department budget by $18,457 and to split the funding of the secretary position between the Planning and Zoning Department and Secondary Roads Department effective July 1, 2001. Carried 4-0. Copy filed.

Motion by Welte second by Walish to reduce the District Health Department budget by $21,404. Carried 4-0.

Motion by Walish second by Boykin to reduce the Conservation Department budget by $18,844. Carried 4-0.

Motion by Boykin second by Walish to reduce the Disaster Services budget by $6,698. Carried 4-0.

Motion by Boykin second by Welte to reduce the County Attorney budget by $36,158. Carried 4-0.

Motion by Boykin second by Welte to eliminate the clerk position in the General Relief Department and reduce their budget by $36,914. Carried 4-0.

Motion by Boykin second by Walish to reduce the Sheriffs Department budget by $184,075. Carried 4-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Bob Leiten recommended that evening meetings would enhance public participation.

The Board adjourned the regular meeting until February 19, 2002.
