JUNE 14, 2005 TWENTY-FOURTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, June 14, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Woodbury County Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Motion by Batcheller second by Monson to go into Closed Session, in accordance with Iowa Code 20.17(3), at the request of J.D. Pellersels, Human Resource Director. Carried 5-0 on a roll call vote.

Motion by Clausen second by Batcheller to go out of Closed Session. Carried 5-0 on a roll call vote.

Meeting called to order.

Motion by Walish second by Batcheller to amend the agenda by removing item 8. Carried 5-0. Copy filed.

The Board Chair introduced Clinton Meadows as the Countys Homeland Security Director.

Motion by Walish second by Clausen to approve the Board minutes of June 7, 2005 as submitted. Carried 5-0. Copy filed.

The Board approved the separation of Linda A. Prosser, Temporary Clerk II, County Auditor/Recorder Dept., effective 05/11/2005. End of temporary work. Copy filed.

The Board approved the reclassification of John J. Sullivan, Assistant County Attorney, County Attorney Dept., @ $50,643/year, effective 07/01/2005. Wage Plan comparability with AFSCME Attorney Contract. Copy filed.

The Board approved the reclassification of Dawn L. Zahnley, Secretary II, Disaster Services Dept., @ $11.71/hour, effective 07/01/2005. Wage Plan comparability with AFSCME Court House Contract. Copy filed.

Motion by Walish second by Clausen to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for one Temporary Aide, Social Services Dept., entry level Wage Plan: $6.00/hour. Carried 5-0. Copy filed.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a resolution approving petition for suspension of taxes through the redemption process for Juanita Skoglund on Parcel #894814356006. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES THROUGH THE REDEMPTION PROCESS


WHEREAS, Juanita Skoglund. as joint titleholder of real estate located at 1428 LaPlante Ave., Sioux City, Woodbury County, Iowa, and legally described as follows:

Lot Eight (8) & East 13 Feet Lot Nine (9) Block Six (6) Edgewater 2nd Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Juanita Skoglund, as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem parcel #894814356006 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS Russell Eugene Elsberg, are titleholders of a property located at 2317 Summit Street, City of Sioux City, Woodbury County, Iowa, and legally described as follows:

Except West 30 Feet, East 52 Feet, South 1 Feet Lot 3 Block 6, Calls Summit 2nd Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Russell Eugene Elsberg as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Walish second by Monson to authorize the Chairman to sign the Community Action Agency of Siouxland Senior Aides Program Host Agency Agreement. Carried 5-0. Copy filed.

There was a discussion between the Board and Patty Erickson-Puttmann, Social Service Coordinator, about considering and approving the uncompensated care costs for Siouxland Mental Health.

Motion by Walish second by Monson for approval of reimbursement to Siouxland Mental Health for all or any portion of the $126,027.45 balance. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to authorize the Chairman to sign the Utility Accommodation Permit submitted by the City of Sioux City, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Batcheller second by Monson to authorize the Chairman to sign the 28E Agreement with the City of Pierson, per recommendation of Richard Storm, County Engineer. Carried 5-0. Copy filed.

.The Board discussed with County Engineer, Richard Storm, a letter received from the City of Pierson requesting that a portion of the Road Use Tax Receipts, Received by Woodbury County since July 1, 2004, be returned.

Motion by Walish second by Clausen to approve the reimbursement of 75% of the receipts collected year to date. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign a resolution to establish road closures for the 2005 construction project, per recommendation of Richard Storm, County Engineer. Carried 5-0. Copy filed.

WOODBURY COUNTY, IOWA

RESOLUTION NO. 9930

BE IT RESOLVED, by the Woodbury County Board of Supervisors, duly assembled, pursuant to Section 306.41 of the Code of Iowa, 2004, as amended, that the following highways or sections of highways described and shown on Exhibit Aand B respectively, attached hereto and by this reference made a part hereof, will become temporarily closed for a undetermined period for construction, re-construction, and/or maintenance and thereupon the County Engineer is directed to cause signs and partial or total barricades to be erected in the roadway at each end of said described highway or section of highway, and on said highway where intersected by other highways, reading Road Closed. Said described highways shall become closed effective upon the erection of signs and barricades, and shall remain closed until said signs and barricades are removed.

.Motion by Walish second by Monson to receive the County Engineers Report for the establishment of Derocher Path Assessment District. Carried 5-0. Copy filed.

The Board discussed establishing the 2005-06 assessments for various drainage districts, with Richard Storm, County Engineer.

The Chairman presented a plaque to Alexis Derochie, recognizing her for winning the Public Museum contest with her project on the County Courthouse.

.The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Glenn Marlett who is Cornerstone Faith Center's construction manager, discussed a proposed paving agreement with the Board. There was a consensus to put the proposal on the agenda next week and to let construction proceed until that time.

The Board adjourned the regular meeting until June 21, 2005.
