The Board of Supervisors met on Tuesday, May 23, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, and Monson; Walish was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

WHEREAS, Kirk P. Dahlheimer, as titleholder of a properties located 3319 E. 6th Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

WHEREAS, Kirk Pl Dahlheimer of the aforementioned properties has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Boykin second by Monson to approve compromising the back taxes on mobile home title #97U596835, and assign the tax certificate to Donna Taylor for $100.00. Carried 4-0.

Social Service Coordinator, Patty Erickson-Puttmann, presented copies of the Grant Agreement for receipt of JAG funds to the Board for review and approval.

Motion by Boykin second by Batcheller to authorize the Chairman to sign agreement and return to the U. S. Department of Justice. Carried 4-0. Copy filed.

Linda Drey from Siouxland District Health submitted an Alternative Plan for Local Public Health Services Contract for fiscal year 2006.

Motion by Boykin second by Monson to approve the Alternative Plan for fiscal year 2006. Carried 4-0. Copy filed.

Linda Drey from Siouxland District Health submitted an Application for Local Public Health Services Contract for fiscal year 2007.

Motion by Boykin second by Monson to approve and authorize the Local Public Health Services Contract for fiscal year 2007. Carried 4-0. Copy filed.

The Board discussed with Gary Brown, Emergency Services Director, an ordinance authorizing Woodbury County to lease property to a private enterprise, competing against another private enterprise, doing business in the telecommunications industry.

Motion by Batcheller second by Boykin to approve the second reading of an ordinance authorizing Woodbury County to lease property to a private enterprise, competing against another private enterprise, doing business in the telecommunications industry. Carried 4-0.

John Pylelo, Planning and Zoning Director, presented to the Board for consideration a Funding Easement Project regarding Glen Ellen Subwatershed (Little Sioux River Flood Prevention Project).

Motion by Boykin second by Monson to approve and authorize the Chairman to sign Section 28E Agreement between Woodbury County and Woodbury County Soil and Water Conservation District for funding and managing Easement Acquisition Project for the Glen Ellen Subwatershed Little Sioux River Flood Prevention Project. Carried 3-1, Batcheller opposed. Copy filed.

The Board discussed with Rob Marqusee, Rural Economic Development Director, the possibility of leasing farmland to Western Iowa Tech.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a Resolution approving leasing farmland to Western Iowa Tech. Carried 4-0.

RESOLUTION #10,056
A RESOLUTION LEASING FARMLAND TO WESTERN IOWA TECH

WHEREAS, Woodbury County enacted the Organics Conversion Policy on June 28, 2005 providing a tax rebate to farmers who convert agricultural land from conventional to organic farming. Woodbury County desires to support this policy by granting a lease to Western Iowa Tech Community College (WITCC) to educate students in the methods of organic farming.

WHEREAS, WITCC plans to offer two organic farming courses, beginning Fall 2006, that lead to the awarding of a diploma in organic farming to students who successfully complete the program.

WHEREAS, Woodbury County desires to support the WITCC organic farming course offerings that prepares farmers and agriculture businesses to meet the challenges of the growing and potentially profitable organic food market. Woodbury County desires to enlarge the labor pool necessary for businesses that focus on organic food markets in our region.

WHEREAS, Woodbury County owns approximately 208.4 acres of prime farmland located near the County Care Facility, located in Woodbury County. The current lessee of the farmland has agreed to release a total of 15 acres (out of the 208.4 acre lease) back to the county and subsequently to be leased to WITCC to be devoted to be an organic farm laboratory for use in the WITCC organic farming course offerings. The 15 acres to be released by current lessee and then to be leased to WITCC is described by physical markers reflected on the attached map (a triangular area bordered by three roads).

WHEREAS, Section 331.361(2) of the Code of Iowa grants Woodbury County the power to dispose of interests in real property by lease.

IT IS HEREBY RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That it hereby authorizes an amendment to the county Farm Lease, reducing the current lease by fifteen (15) acres.

2. That it hereby authorizes the lease of the aforementioned fifteen (15) acres to WITCC in connection with a dedicated organic farming course for ten (10) years.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign Final Voucher for Project BROS-CO97(51)5F-97. Carried 4-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign Project Agreement with NRCS for Cost-Sharing of the Construction of Four Drop Inlet Structures. Carried 4-0. Copy filed.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to Adopt a Resolution to Contract Operation of Wolf Creek Pumping District for 2006. Carried 4-0.

RESOLUTION NO. #10,057
WOLF CREEK DRAINAGE DISTRICT/PUMPING STATION
RESOLUTION REQUIRING CONTRACT TO OPERATE PUMPS

WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Wolf Creek Drainage District and as the governing body has approved and established certain pumping stations in connection therewith; and

WHEREAS, the Board of Supervisors as the governing body of the Wolf Creek Drainage District and its pumping station(s) has previously contracted for the pumping of excess surface waters in the Wolf Creek Pumping Station District; and

WHEREAS, it appears that authority for pumping of excess surface waters including the use of the district owned pumping equipment should be renewed in the event of rainfall which might require pumping in the affected area.

NOW THEREFORE, BE IT RESOLVED by the Woodbury County Board of Supervisors that this Board as Trustees of Wolf Creek Pumping Station District should enter into a contract for the crop year of 2006, for the operation and maintenance of the pumping stations in the Wolf Creek Drainage District heretofore established by this Board.

BE IT FURTHER RESOLVED, that the Chairman of this Board be and he is hereby authorized and directed to enter into that Employment Contract with Douglas Washburn, as per the attached form of Employment Contract, subject to the Guidelines for the operation of the Wolf Creek Pumping Station District.

IT IS FURTHER RESOLVED that in connection herewith, the Contractor, Douglas Washburn, will furnish evidence of insurance as required by Paragraph 4 of said Contract.
