FEBRUARY 26, 2008NINTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 26, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, and Monson; Walish was absent. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Monson to approve the Board minutes of the February 19, 2008 meeting as submitted. Carried 4-0. Copy filed.

Motion by Boykin second by Monson to approve the Board minutes of the executive session held on February 19, 2008 meeting as submitted. Carried 4-0. Copy filed.

Motion by Boykin second by Monson to approve the Board minutes of the February 22, 2008 special meeting as submitted. Carried 3-0; Batcheller abstained. Copy filed.

Motion by Monson second by Boykin to approve the Board minutes of the executive session held on February 22, 2008 meeting as submitted. Carried 3-0; Batcheller abstained. Copy filed.

The Board approved the reclassification of Ryan M. Hansen, Correctional Officer, County Sheriff Dept., $14.87/hour, effective 02/19/2008. Per 2008-2010 DSDOA contract agreement, Class 4 is eliminated upon signing, effective 02/19/2008, movement to Class 3. Copy filed.

The Board approved the separation of Joshua R. Brunsting, Correctional Officer, County Sheriff Dept., effective 02/22/2008. Resignation. Copy filed.

The Board approved the reclassification of Tracy L. Nelson, Correctional Officer, County Sheriff Dept., $17.83/hour, effective 02/25/2008. Per DSA contract agreement, to Senior Class, due to 6 years service plus an AA Degree. Copy filed.

The Board approved the separation of David J. Kyte, Correctional Officer, County Sheriff Dept., effective 02/29/2008. Resignation. Copy filed.

The Board approved the separation of Lisa M. Drum, Part-time Youth Worker, Juvenile Detention Dept., effective 03/01/2008. Resignation. Copy filed.

The Board approved the separation of Marleen J. Loftus, Assistant County Attorney, County Attorney Dept., effective 03/31/2008. Retirement. Copy filed.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign an Authorization To Initiate Hiring Process for:

2 Male Correctional Officers, County Sheriff Dept. Entry level: DSA $14.32/hour.

1 Part-time Female Youth Worker, Juvenile Detention Dept. Entry level: AFSCME J.D. $13.94/hour.

1 Assistant County Attorney, County Attorney Dept. Entry level: AFSCME Attorney salary range: $44,423/year-$51,374/year, based on experience.

The Board discussed the Countys self-insured health plan with Human Resources Director J. D. Pellersels.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign the 2007 Regional Homeland Security Grant Agreement between Iowa Homeland Security and Emergency Management Division (HSEMD) and Woodbury County, to receive grant funding totaling $326,092.00. Carried 4-0. Copy filed.

Motion by Monson second by Batcheller to designate Gary Brown as the authorized representative for the Woodbury County 2007 Regional Homeland Security Grant Agreement between Iowa Homeland Security and Emergency Management Division (HSEMD) and Woodbury County. Carried 4-0. Copy filed.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign a lease agreement with Woodbury Rural Electric Coop for leasing the StarComm tower at 2028 Jasper, Moville. Carried 4-0. Copy filed.

Motion by Boykin second by Monson to approve the appointment of Gary Brown as Woodbury Countys Department of Natural Resources point of contact. Carried 4-0.

A public hearing and sale was held at 10:15 a.m. for real estate parcel #104970 (aka 1604 Main Street).

Motion by Batcheller second by Boykin to close the hearing.

Motion by Batcheller second by Boykin to accept the bid of $1.00 plus recording fees, from David E. Daniels. Carried 4-0.

Motion by Batcheller second by Monson to approve lifting the tax suspension for Arthur F. LaCroix, 505 W. 26th Street, Sioux City, as this person is no longer eligible for the suspension per Iowa Department of Human Services. Carried 4-0.

Motion by Monson second by Boykin to approve lifting the tax suspension for James C. Epperson, 1307 Summit Street , Sioux City, as this person is no longer eligible for the suspension per Iowa Department of Human Services and no longer lives in the home. Carried 4-0.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a certificate of completion of the 2007 concrete crushing project by Schmillen Construction, Incorporated, per recommendation of the County Engineer. Carried 4-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Farm-to-Market voucher, to reimburse Iowa DOT for material inspection costs incurred on project STP-S-CO97(53)5E-97, per recommendation of the County Engineer. Carried 4-0.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a Resolution vacating road right-of-way for a portion of Decatur Street in Morningside Addition, per recommendation of the County Engineer. Carried 4-0.

RESOLUTION NO. # 10,346
WOODBURY COUNTY, IOWA
A RESOLUTION VACATING EXCESS ROADWAY RIGHT-OF-WAY

WHEREAS, The Woodbury County Board of Supervisors in accordance with section 306.10 (Code of Iowa), as amended, has determined that a portion of roadway right-of-way in Morningside Addition, a section of Decatur Street in part of section 4, T88N, R47W Woodbury County is no longer needed for roadway purposes. The portion to be vacated is described as follows and shown on attached drawing.

Vacate a portion of excess right-of-way located on Decatur Street, Said parcel of land described as being part of Morningside Addition in section 4, T88N, R47W of the 5th P.M. Woodbury County Iowa, further described as follow: Commencing at the Northeast Corner of government Lot 1 of section 5; Thence S 0 0000 E for a distance of 1643.83 feet to a point on the center line of platted Decatur St., the point of beginning; thence continuing on the said line S 0 0000 E for a distance of 165 feet; to a point on the northeasterly right-of-way of an actual road passage way; thence S 24 00E along a line parallel and 30 feet normal distant northeasterly of the center line of actual road passage way, for a distance of 74 feet, more or less; thence N 0 0000 W a distance of 232.5 feet, along the west line of block 35 to a point of 60.02 feet easterly of the Southeast corner of lot 6, Block 27 and its southerly line extended to a point on the west line of block 34; thence S 8811 39 W for a distance of 30.01 feet to the centerline of Decatur Street, the point of beginning Containing 5961 square feet, more or less.

NOW THEREFORE BE IT RESOLVED, that the Woodbury County Board of supervisors, in accordance with section 306.10 (Code of Iowa) as amended, hereby vacates the excess right-of-way described above. From and after the date of this resolution is recorded, the identified property shall not constitute a street or highway, or public right-of-way, but shall revert to private ownership pursuant to operations of law.

Motion by Boykin second by Batcheller to receive the recommendation of the county engineer for cost-sharing for improvements on County Route K-42 (aka Maple Street) in Bronson, per request received by the Lawton-Bronson School District, with cost sharing as follows: 75% by the School, 12.5% by the City, and 12.5% by the County. Carried 4-0.

The Board discussed a Siouxland Historical Railroad Association request for funding with Larry Obermeyer. The request is for approving a Resolution appropriating $5,000.00 to the Milwaukee Railroad Shops Historic District Preservation Project.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Resolution appropriating $5,000.00 of Riverboat Funds to the Milwaukee Railroad Shops Historic District Preservation Project. Carried 4-0.

WOODBURY COUNTY, IOWA
RESOLUTION #10,347
RESOLUTION APPROPRIATING $5,000 TO
THE MILWAUKEE RAILROAD SHOPS HISTORIC DISTRICT
PRESERVATION PROJECT

WHEREAS, the Siouxland Historical Railroad Association is a private, non-profit museum organization and owner of the Milwaukee Railroad Shops Historic District, located adjacent to the Loess Hills National Scenic Byway - Iowa Highway 12 spine in Woodbury County; and

WHEREAS, the Milwaukee Railroad Shops Historic District preserves and interprets the railroad heritage of Woodbury County and the surrounding tri-state Siouxland region; and

WHEREAS, in order to further the mutual tourism goals of Woodbury County and the Siouxland Historical Railroad Association to redevelop the Milwaukee Railroad Shops Historic District as a railroad museum for current and future generations to enjoy; and

WHEREAS, the Siouxland Historical Railroad Association will not be able to complete their preservation and redevelopment of the Milwaukee Railroad Shops Historic District without the aid of a Vision Iowa Community Attraction and Tourism (CAT) Program grant; and

WHEREAS, the Vision Iowa Board of Directors requires county governments to provide a direct financial contribution to a CAT-eligible project located within its jurisdiction as part of the projects total funding mix;

NOW, THEREFORE IT BE RESOLVED BY THE BOARD OF SUPERVISORS THAT WOODBURY COUNTY does hereby demonstrate its support for the Milwaukee Railroad Shops Historic District Preservation Project with a financial contribution of $5,000 and other in-kind services; and.

BE IT FURTHER RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, that the $5,000 financial contribution shall be appropriated during the Fiscal Year 2010 general operating budget beginning July 1, 2009.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Department of Natural Resources Administrative Consent Order, in the matter of Woodbury County Prairie Hills public water supply. Carried 4-0. Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Kevin Miller, 1013 Emmit Avenue, Lawton asked that the Board resubmit a master matrix regarding a proposed dairy facility near Lawton.

The Board adjourned the regular meeting until March 4, 2008.
