APRIL 15, 2008SIXTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, April 15, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson; and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Batcheller to approve the Board minutes of the April 8, 2008 meeting as submitted. Carried 5-0. Copy filed.

The Board approved an active military leave of absence for Bradley D. Rose, Deputy Sheriff, County Sheriff Dept., effective 04/20/2008 through 01/31/2009. Copy filed.

The Board approved an active military leave of absence for Jeffrey C. Davis, Full-time Youth Worker, Juvenile Detention Dept., effective 04/20/2008 through 01/31/2009. Copy filed.

The Board approved the separation of Brett R. Balliet, Part-time Youth Worker, Juvenile Detention Dept., effective 04/22/2008. Resignation. Copy filed.

The Board approved the reclassification of Janet I. Johnson, Motor Vehicle Clerk II, County Treasurer Dept., $13.23/hour, effective 05/09/2008. Per AFSCME Courthouse Contract, from Grade 4, Step 2 to Grade 4, Step 3. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for a Part-time Male Youth Worker, Juvenile Detention Dept. Entry level: AFSCME J. D. $13.94/hour. Carried 5-0. Copy filed.

Motion by Monson second by Clausen to receive the Auditors Quarterly Report for the quarter ending March 31, 2008. Carried 5-0. Copy filed.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign applications for impoundment structure property tax exemption, totaling $489,300.00 for 2008. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign applications for Slough Bill property tax exemption, totaling $1,061,660.00 for 2008, with 179.08 acres left in the program. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign the fiscal year 2009 Local Public Health Services Contract. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to approve and receive for signatures a Resolution proclaiming the week of April 13-19, 2008 as National Public Safety Telecommunications Week to honor Woodbury County 9-1-1 Center public safety dispatchers. Carried 5-0.

PROCLAMATION
NATIONAL PUBLIC SAFETY TELECOMMUNICATIONS WEEK

WHEREAS, Woodbury County Communications will honor the men and women who serve as public safety dispatchers during National Public Safety Telecommunications Week, April 13-19, 2008 and


WHEREAS, introduced to Congress in 1991, National Public Safety Telecommunications Week is the second full week of April each year. This week is dedicated to public safety telecommunicators who aid in providing 9-1-1 emergency assistance to citizens everywhere, and

WHEREAS, every day, millions of people depend on the skill, expertise and commitment of the men and women who work in public safety telecommunications. These individuals help save countless lives by responding to emergency calls, dispatching emergency professionals and equipment and providing moral support to citizens in distress, and

WHEREAS, the term 9-1-1 is often associated with rapid emergency response, poise under pressure, aid and compassion in times of distress and critical decision-making within seconds. Many people dont stop to think about these seemingly nameless, faceless individuals until they experience actual emergencies themselves. These professionals make the difference between life and death in many instances.

THEREFORE, The Woodbury County Board of Supervisors do hereby proclaim

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a utility accommodation permit submitted by Tri-State Plumbing, Sioux City, involving a city water line to a residence along Correctionville Road, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to receive and approve plans for Secondary Roads Dept. project #BRS-CO97(85)60-97, per recommendation of the County Engineer. Carried 5-0.

Motion by Boykin second by Monson to receive and approve the results of the speed study requested by the City of Moville., per recommendation of the County Engineer. Carried 5-0.

Motion by Batcheller second by Monson to award the bid for the 03/25/2008 motor grader bid to Murphy Tractor, to furnish a Model 770D to District 2 at a net cost of $139,750.00, and a Model 772D do District 4 at a net cost of $159,596.00, per recommendation of the County Engineer. Carried 5-0.

Motion by Monson second by Boykin to set the public hearing and sale date of May 5, 2008 at 10:15 a.m. for the sale of approximately 6 acres of excess County real estate located at the former radio tower site, and establish a minimum bid of $3,000.00/acre, or $18,000.00, per recommendation of the County Engineer. Carried 5-0.

A public hearing was held at 10:15 a.m. for the sale of real estate parcel #401880 (3399 Grandview Boulevard). The Chairman called on anyone wishing to be heard.

Motion by Clausen second by Boykin to close the hearing. Carried 5-0.

The Chairman called for bids.

Richard Wissing bid $50.00.

There were no other bids.

Motion by Batcheller second by Boykin to approve the sale of real estate parcel #401880 to Richard Wissing for the amount of $50.00 plus recording fees. Carried 5-0.

Motion by Monson second by Boykin to approve lifting the tax suspension for Willie Earl Rucker, 213 Main Street, Sioux City, as he has been sentenced to prison for fifteen years. Carried 5-0.

Motion by Monson second by Boykin to approve and receive for signatures, a Resolution adopting and levying a special assessment in the Little Sioux Inter-County Drainage District of Monona, Harrison, and Woodbury Counties. Carried 5-0.

WOODBURY COUNTY, IOWA
RESOLUTION # 10,387

WHEREAS, the Board of Trustees of the Little Sioux Inter-County Drainage District, in session on the 2nd day of April, 2008, requested that the Board of Supervisors levy a special assessment of Forty-two (42%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona, Woodbury and Harrison Counties, Iowa, acting as a Drainage Board for the Little Sioux Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District of Monona, Woodbury and Harrison Counties, Iowa, a special assessment in the amount of Forty-two (42%) Percent of the Original Assessment, and the Auditors of Monona, Woodbury and Harrison Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2008-2009.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a lease agreement between Woodbury County and Schenkelberg Implement Company, Onawa, for leasing the Anthon tower site. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a loan agreement between Woodbury County and Anthon Rescue Squad, for $15,000.00, to be repaid over three years, for the purchase of a Heartlink MRX M3535A ALS Defibrillator Heartstart. Carried 5-0. Copy filed.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign a Local Hazard Mitigation Planning Grant Agreement with Iowa Homeland Security and Emergency Management Division, for federal aid through grant agreement #DR-1688-0009-00. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign an agreement for services between Woodbury County and Siouxland Interstate Metropolitan Planning Council (SIMPCO) to complete the scope of work outlined in the local hazard mitigation planning grant agreement. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a agreement between Woodbury County and Iowa Department of Public Health, Division of Acute Disease Prevention and Emergency Response, for $30,000.00 in funding for a two year Iowa System Standards project. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign an agreement between Woodbury County Emergency Management and Siouxland Interstate Metropolitan Planning Council (SIMPCO), to perform the scope of work outlined in the planning agreement. Carried 5-0. Copy filed.

Frank Baron with Baron, Sar, Goodwin, Gill, and Lohr and Frank Tenuta with Legal Aid, gave the Board a presentation on funding for Legal Aid.

Randall Handley with Cost Advisory Services, Incorporated, gave a presentation to the Board regarding their services in preparing cost allocation plans for fiscal years 2008, 2009, and 2010.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board discussed the agenda for their trip to the Sioux City Steak Dinner in Washington D.C.

The Board adjourned the regular meeting until April 29, 2008.
