JULY 8, 2008TWENTY-SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, July 8, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Boykin second by Clausen to approve the Board minutes of the July 1, 2008 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the reclassification of Mat R. Cook, Correctional Officer, County Sheriff Dept., $18.59/hour, effective 07/14/2008. Per DSDOA contract agreement, from Class 1 to Senior Class, due to 6 years employment and an AAS degree. Copy filed.

The Board discussed a Justice Assistance Grant application and an associated Inter-local Agreement with Patty Erickson-Puttmann, Social Services Director.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign the Justice Assistance Grant Inter-local Agreement, between Woodbury County and the City of Sioux City. Carried
5-0. Copy filed.

Motion by Clausen second by Batcheller to approve the appointment of Patty Erickson-Puttmann as the authorized agent for electronic submission of the grant application. Carried 5-0.

Motion by Clausen second by Boykin to approve designating the use of the Justice Assistance Grant funds for operational costs of the Tri-State Drug Task Force. Carried 5-0.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by Qwest Communications, to install an underground telephone line across Glen Ellen Road and along the frontage road to the Cornerstone Church facility, per recommendation of Richard Storm, County Engineer. Carried 5-0. Copy filed.

The Board discussed incorporating SUDAS design guidelines for future subdivision street/road improvements, with County Engineer Richard Storm.

Motion by Batcheller second by Monson to approve the incorporation of SUDAS design guidelines for future subdivision street/road improvements in Woodbury County. Carried 5-0.

The discussion of a recommendation to contract purchase diesel fuel for Secondary Roads Dept. was deferred.

Motion by Clausen second by Boykin to receive and approve the proposal from Kooiker, Incorporated, LeMars, IA, in the amount of $42,750.00, to repair bridge #E-63, Concord Township, per recommendation of the County Engineer Richard Storm. Carried 5-0. Copy filed.

The Board discussed various sale options for the former Secondary Roads radio tower site, with County Engineer Richard Storm.

Motion by Monson second by Boykin to acknowledge the appointment of John Anfinson, 404 Valley, Cushing, IA, to the River Valley Community School District Board of Directors, to fill a vacancy in the office previously held by Terry Jensen, until the next School Board election. Carried 5-0.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date of parcel #219495 (114 S. Casselman Street). Carried 5-0.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 22nd Day of July, 2008 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 22nd Day of July, 2008, immediately following the closing of the public hearing to Lewis L. Wilmot only per Code of Iowa 331.361 (2).

3. That said Board proposes to sell the said real estate to Lewis L. Wilmot only for consideration of $1.00 plus recording fees.

1. That a public hearing on the aforesaid proposal shall be held on the 22nd Day of July, 2008 at 10:17 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 22nd Day of July, 2008, immediately following the closing of the public hearing to Willard D. Maaske only per Code of Iowa 331.361 (2).

3. That said Board proposes to sell the said real estate to Willard D. Maaske only for consideration of $250.00 plus recording fees.

1. That a public hearing on the aforesaid proposal shall be held on the 22nd Day of July, 2008 at 10:19 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 22nd Day of July, 2008, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $425.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Monson second by Clausen to approve lifting the tax suspension for Charlotte Butler, 802 Pacific Street, Sioux City, IA. Carried 5-0.

Bob Lee, RML Architects, provided the Board with an update on the LEC sidewalk project.

A public hearing was held at 10:28 a.m. for the first reading of the adoption of new zoning ordinances for the unincorporated areas of Woodbury County, including zoning district designation mapping. The Chairman called on anyone wishing to be heard.

Ken Gard, Woodbury County Farm Bureau, and Kevin Miller, Lawton, presented concerns they have with the new zoning ordinances for the unincorporated areas of Woodbury County.

Motion by Batcheller second by Monson to close the public hearing. Carried 5-0.

A public hearing was held for the first reading for the adoption of new subdivision ordinances for the unincorporated areas of Woodbury County. The Chairman called on anyone wishing to be heard.

There was no one wishing to be heard.

Motion by Clausen second by Batcheller to close the public hearing. Carried 5-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The general relief appeal for G.C. was not held as the appellant did not appear.

The Board adjourned the regular meeting until July 15, 2008.
