June 21, 2011 — TWENTY-FORTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, June 21, 2011 at 10:00 a.m.  Board members present were Monson, Clausen, Tripp, Smith and Boykin.  Staff members present were:  Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented.  Copy filed.

The meeting was called to order.
 
Motion by Tripp second by Boykin to approve the minutes of the June 14, 2011 Board meeting.  Carried 5-0.  Copy filed.

Motion by Smith second by Boykin to approve a Health Insurance Premium Holiday per recommendation by Ed Gilliland/Gallagher Benefit Services, Inc.  Carried 5-0.

Motion by Boykin second by Clausen to approve lifting the tax suspension for Charles Semple, 519 35th St, Sioux City, per the taxpayer’s request.  Carried 5-0.

Motion by Clausen second by Smith to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for Parcel #055995, 1619 Center St, Sioux City.  Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Lot 1 in Block 24, North Sioux City, City of Sioux City, Woodbury  
County, Iowa
(1619 Center Street)

NOW THEREFORE,
 
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1.  That a public hearing on the aforesaid proposal shall be held on
      the  5th  Day of July, 2011 at 10:15 o’clock a.m. in the meeting
      room of the Board of Supervisors on the first floor of the Woodbury
     County Courthouse.
     
2.  That said Board proposes to sell the said parcel of real estate at a
      public auction to be held on the 5th  Day of July, 2011, immediately
      following the closing of the public hearing.
     
3.  That said Board proposes to sell the said real estate to the highest
      bidder at or above a total minimum bid of $500.00 plus recording fees.
     
4.  That this resolution, preceded by the caption "Notice of Property Sale"
      and except for this subparagraph 4 be published as notice of the
      aforesaid proposal, hearing and sale.

Motion by Boykin second by Tripp to approve a 12-month Cigarette/Tobacco Permit, for Heritage Express, 1501 330th Street, Sloan, Iowa, effective 7/1/2011 through 6/30/2012.  Carried 5-0.  Copy filed.

Motion by Smith second by Tripp to approve a Memorandum of Understanding between Woodbury County Social Services and the Sioux City Community School District for clarification and specification of specific responsibilities between the parties involved for performance and funding of programming related to the Safe Schools/Healthy Students Initiative, per recommendation of Social Services Coordinator Patty Erickson-Puttmann.  Carried 4-0; Boykin abstained.  Copy filed.

Motion by Clausen second by Boykin to sign a One Year Extension of the Mental Health Court (Project Compass) with Siouxland Mental Health per recommendation of Patty Erickson-Puttmann, Social Services Coordinator. Carried 5-0.  Copy filed.

Motion by Boykin second by Clausen to receive a Re-Zoning Petition for Luane Todd, Cheryl Todd, and Linda Lurene Miller and to refer it to the Planning & Zoning Commission for review and recommendation.  Carried 5-0.

Motion by Smith second by Clausen to receive a minor subdivision application for Luane Todd, Cheryl Todd, and Linda Lurene Miller and to refer it to the Planning & Zoning Commission for review and recommendation.  Carried 5-0.

Motion by Boykin second by Tripp to approve and authorize the Chairman to sign a Resolution accepting the Replat of Lot 2 Joyful Acres First Addition.  Carried 5-0.

RESOLUTION ACCEPTING AND APPROVING
REPLAT OF LOT 2 JOYFUL ACRES FIRST ADDTION
A MINOR SUBDIVISION TO WOODBURY COUNTY, IOWA

RESOLUTION ACCEPTING AND APPROVING THE REPLAT OF LOT 2 JOYFUL ACRES FIRST ADDITION, A MINOR SUBDIVISION TO WOODBURY COUNTY, IOWA.
 
WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 2ND DAY OF MAY, 2011, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS THE REPLAT OF LOT 2 JOYFUL ACRES FIRST ADDITION, A MINOR SUBDIVISION TO WOODBURY COUNTY, IOWA, AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE PLAT OF THE REPLAT OF LOT 2 JOYFUL ACRES FIRST ADDITION, A MINOR SUBDIVISION TO WOODBURY COUNTY, IOWA BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED AND THE CHAIRMAN AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNERS AND PROPRIETORS A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign an underground tile permit submitted by Long Lines on Highway D-25 per recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

Motion by Clausen second by Tripp to approve and authorize the Chairman to sign an underground tile permit submitted by Long Lines on Fayette Ave per recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

The Board and Monona County Board of Supervisors discussed with an adjacent landowner a request to purchase a county line bridge.

There was no action taken on a request from an adjacent landowner to purchase a county line bridge.

The Board discussed funding for the Phoenix with Amy Bloch of Jackson Recovery. 

Motion by Boykin second by Smith to approve and authorize the chairman to sign an Amendment to the Contract for Services  between the Woodbury county Board of Supervisors, on behalf of Homeland Security, Region III, and Mrs. Aimee Barrit.  Carried 4-0; Clausen abstained.  Copy filed.

Motion by Smith second by Boykin to approve and authorize the chairman to sign a contract for services between the Woodbury County Board of Supervisors on behalf of the Homeland Security Board, Region III, and Ms. Sarah Browne-Walish.  Motion carried 4-0; Clausen abstained. Copy filed

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

Motion by Clausen second by Tripp to go into closed session for General Relief Appeal for Karie Bumann per Iowa Code Section 21.5(1)(a).  Carried 5-0 on a roll-call vote.

Motion by Boykin second by Smith to go out of closed sessions per Iowa Code Section 21.5(1)(a).  Carried 5-0 on a roll-call vote.

Motion by Tripp second by Boykin to uphold the decision of General Relief services to deny services to Karie Bumann.  Carried 5-0.
      
The Board adjourned the regular meeting until June 28, 2011.
