SEPTEMBER 6, 2011 — THIRTY-SIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 6, 2011 at 10:00 a.m.  Board members present were Monson, Clausen, Tripp and Smith, and Boykin.  Staff members present were Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented.  Copy filed.

The meeting was called to order.
 
Motion by Tripp second by Smith to approve the minutes of the 08/30/2011 Board meeting.  Carried 5-0.  Copy filed.

The Board approved the separation of Donald C. Stevenson, Maintenance Worker, Building Services Dept., effective 08-26-11.  Resignation.  Copy filed.
 
The Board approved the separation of Ronald A. Larson, Equipment Operator, Secondary Roads Dept., effective 10-07-11.  Retirement.  Copy filed.

Motion by Boykin second by Tripp to approve and authorize the Chairman to sign an “Authorization to Initiate Hiring Process” for Maintenance Worker, Building Services Dept., AFSCME Courthouse: Grade 2/Step 1 to Step 3 Range:  $13.05 to $14.35/hr.  Carried 5-0.  Copy filed.

Motion by Clausen second by Boykin to approve Ronald Larson’s request to remain on County Insurance Plans.  Carried 5-0.
 
Motion by Boykin second by Tripp to approve and authorize the Chairman to sign a Resolution approving a petition for suspension of taxes for Vietnamese Evangelical Church of the Christian Missionary Alliance, 1515 29th st , Sioux City, parcel #894715355006 and 2812 Cheyenne Blvd, Sioux City, parcel #894715359001.  Carried 5-0.

WHEREAS, the organization, namely Vietnamese Evangelical Church of the Christian Missionary Alliance is failing to immediately pay the taxes due; and 

WHEREAS,  the Board of Supervisors sees that good cause exists for the abatement of these taxes; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates  the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the 2010/2011 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes.  Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel.

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to sign a contract to sell said property and, per said contract, to execute a Quit Claim Deed for the said premises to the said purchaser at the time of closing set forth in said contract.

A public hearing was held regarding a resolution for the Amendment of Woodbury County’s Flood Plain Management Ordinances.  The Chairman called on anyone wishing to be heard.

Louis Gordon, Lawton, asked about the impact on his property.

Motion by Clausen second by Boykin to close the hearing.  Carried 5-0.

Motion by Clausen second by Boykin to approve the first reading of the Amendment of Woodbury County’s Flood Plain Management Ordinances.  Carried 5-0.
 
Motion by Clausen second by Boykin to purchase equipment for the County Jail and Prairie Hills for State E-filing per Lynette Redden and Rose Griffith, County Sheriff’s Department from Local Option Sales Tax Proceeds.  Carried 5-0. 

Motion by Smith second by Boykin to approve the contract with for Project Number BROS-CO97(102)—5F-97, Bridge replacement on Knox Avenue, per recommendation by Mark Nahra, County Engineer.  Carried 5-0.  Copy filed.

Motion by Boykin second by Tripp to approve the contract with for Project Number BROS-CO97(93)—8J-97, Bridge replacement on Glen Ellen Road, per recommendation by Mark Nahra, County Engineer.  Carried 5-0.  Copy filed.

Motion by Boykin second by Smith to approve and authorize the Chairman to sign the application for Horizontal Curve Sign Program to Iowa DOT, per recommendation by Mark Nahra, County Engineer.  Carried 5-0.  Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a Permit to Work in the County Right of Way by Tom Cameron, per recommendation of County Engineer Mark Nahra.  Carried 5-0.  Copy filed.

Bid letting was held for sale of Sergeant Bluff Shed for Secondary Roads Dept.  There was one bid submitted by Oban Construction for $1,000.00.

Motion by Clausen second by Boykin to award the bid for the Sergeant Bluff Shed to for the bid amount of $1,000.00 to Oban Construction.  Carried  5-0.  Copy filed.

Motion by Boykin second by Smith to approve and authorize the Chairman to sign the re-application of the Detention Reform Program, per recommendation of David Gleiser.  Carried 5-0.  Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

The Board toured Watersheds in Woodbury County.
 
The Board adjourned the regular meeting until September 13, 2011.
