SEPTEMBER 27, 2011 — THIRTY-NINETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 20, 2011 at 10:00 a.m.  Board members present were Monson, Clausen, Tripp and Smith, and Boykin.  Staff members present were Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented.  Copy filed.

The Board canvassed the Western Iowa Tech Community College Election held on September 13, 2011.  Steve Hofmeyer, Deputy Commissioner of Elections, presented the canvass as follows:

For the office of Western Iowa Tech Community College Board Member, Director District VII, 1 vacancy, there were one thousand one hundred twenty-six (1,126) ballots cast as follows:

Curt Grigg received one thousand one hundred fourteen (1,114) votes
Scattered Write-In Votes received twelve (12) votes
Total voters:   one thousand one hundred twenty-six (1,126) votes

We therefore declare Curt Grigg duly elected to the office of Western Iowa Tech Community College Board Member, Director District VII, for the term of four (4) years.

For the office of Western Iowa Tech Community College Board Member, Director District III, 1 vacancy, there were nine hundred sixty-one (961) ballots cast as follows:

Bob Rasmus received nine hundred fifty (950) votes
Scattered Write-In Votes received eleven (11) votes
Total voters:   Nine hundred sixty-one (961) votes

We therefore declare Bob Rasmus duly elected to the office of Western Iowa Tech Community College Board Member, Director District III, for the term of four (4) years.

For the office of Western Iowa Tech Community College Board Member, Director District IV, 1 vacancy, there were one hundred sixty-five (165) ballots cast as follows:

Bill Lyle received one hundred sixty-one (161) votes
Scattered Write-In Votes received four (4) votes
Total voters:  one hundred sixty-five (165) votes

We therefore declare Bill Lyle duly elected to the office of Western Iowa Tech Community College Board Member, Director District IV, for the term of four (4) years.

For the office of Western Iowa Tech Community College Board Member, Director District VI, 1 vacancy, there were eight hundred thirty-two (832) ballots cast as follows:

Eldon Schroder received eight hundred sixteen (816) votes
Scattered Write-In Votes received sixteen (16) votes
Total voters:  eight hundred thirty-two (832) votes

We therefore declare Eldon Schroder duly elected to the office of Western Iowa Tech Community College Board Member, Director District VI, for the term of four (4) years.

For the office of Western Iowa Tech Community College Board Member, Director District IX, 1vacancy, there were seven hundred fifty-nine (759) ballots cast as follows:

Derrick Franck received seven-hundred fifty-seven (757) votes
Scattered Write-In Votes received two (2) votes
Total voters:  seven hundred fifty-nine (759) votes

We therefore declare Derrick Franck duly elected to the office of Western Iowa Tech Community College Board Member, Director District IX, for the term of four (4) years.

For the special proposition, upon the public measure Question A: "Shall the Board of Directors of Western Iowa Tech Community College in the Counties of Buena Vista, Carroll, Cherokee, Crawford, Harrison, Ida, Monona, Plymouth, Sac, Shelby, Sioux and Woodbury, State of Iowa, be authorized to continue to levy a tax not to exceed twenty and one-fourth (20 1/4? cents per thousand dollars of assessed value in any one year for a period of ten consecutive fiscal years beginning with the tax levy to be made for

collection in the fiscal year ending June 30, 2014, for any one or more of the following purposes: for the purchase of grounds, construction of buildings, payment of debts contracted for the construction of buildings, purchase of buildings and equipment for buildings, and the acquisition of libraries, for the purpose of paying costs of utilities, and for the purpose of maintaining, remodeling, improving or expanding the Community College of the Merged Area; or for such other purposes as authorized by law, as provided in Chapter 260C, Section 22 of the Code of Iowa?"

There were ten thousand nine hundred seventy-seven (10,977) ballots cast as follows:

For the question there were seven thousand seven hundred ninety-seven (7,797) votes cast.
Against the question there were three thousand one hundred eighty (3,180) votes cast.

We therefore declare the public measure to be adopted.

Motion by Clausen second by Tripp to receive and approve the official canvass results of the Western Iowa Tech Community College Election.  Carried 5-0.

The meeting was called to order.
 
Motion by Boykin second by Tripp to approve the minutes of the 09/20/2011 Board meeting.  Carried 5-0.  Copy filed.
 
Motion by Clausen second by Tripp to approve a settlement with Tri-State Mental Health Services.  Carried 5-0.

The Board approved the separation of Travis Hutzell, Civilian Jailer, County Sheriff Dept., effective 09-16-11. Separation.  Copy filed.
 
The Board approved the appointment of Vanessa Jorgensen, P/T Youth Worker, Juvenile Detention Dept., effective 09-28-11, $16.00/hour.  Job vacancy posted: 07-20-11.  Entry level salary:  $16.00/hour.  Copy filed.

The Board approved the Separation of Bobbier Cranston, Asst. County Attorney, County Attorney Dept., effective 10-05-11.  Per Resignation.  Copy filed

Motion by Boykin second by Tripp to approve and authorize the Chairman to sign an “Authorization to Initiate Hiring Process” for Civilian Jailer, County Sheriff  Dept. CWA Civilian Officers:  $16.24/hour,  for Asst. County Attorney, County Attorney Dept.  AFSCME Attorney salary range:  $50,347-$58,225/year, and for Senior Real Estate/Recorders Clerk, Auditor/Recorder Dept., AFSCME Court House Contract Grade 4:  $15.23/hr or per Contract Language.  Carried 5-0.  Copy filed.

Motion by Tripp second by Clausen to approve and authorize the Chairman to sign a Resolution approving abatement of taxes for Lillian Hadden, for parcel #884201258011.  Carried 5-0.

WHEREAS, these taxes are held by Woodbury County on a Tax Sale Certificate and are uncollectable or impractical to pursue collection through personal judgment or tax sale

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the 2000-01 through 2011-12 tax years and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Motion by Smith second by Boykin to approve and authorize the Chairman to sign a Resolution to authorize the Chairman to sign a letter of agreement between the City of Sioux City and Woodbury County to allow voters from Unincorporated areas to vote in City Precincts.  Carried 5-0.

RESOLUTION APPROVING A LETTER AGREEMENT BETWEEN WOODBURY COUNTY, IOWA, AND THE CITY OF SIOUX CITY, IOWA, FOR THE CREATION OF A COMBINED TOWNSHIP AND CITY VOTING PRECINCT HEREBY KNOWN AS PRECINCT 28 PURSUANT TO SECTION 49.6 OF THE IOWA CODE.

WHEREAS, Chapter 49 of the Code of Iowa grants cities and counties the power to combine township and city precincts as long as the combined precinct does not have a total population in excess of three thousand five hundred, as shown by the most recent federal decennial census, and the combined precinct is contained wholly within a legislative district; and

WHEREAS, Chapter 49 of the Code of Iowa grants cities and counties the power to combine township and city precincts as long as the combined precinct does not have a total population in excess of three thousand five hundred, as shown by the most recent federal decennial census, and the combined precinct is contained wholly within a legislative district; and

1.  The City Council of the City of Sioux City, Iowa, and the Woodbury County Board of Supervisors of Woodbury County, Iowa agree to create a combined township and city precinct hereby known as Precinct 28.

TO VOTE IN CITY PRECINCTS

RESOLUTION APPROVING A LETTER AGREEMENT BETWEEN WOODBURY COUNTY, IOWA, AND THE CITY OF SIOUX CITY, IOWA, FOR THE CREATION OF A COMBINED TOWNSHIP AND CITY VOTING PRECINCT HEREBY KNOWN AS PRECINCT 15 PURSUANT TO SECTION 49.6 OF THE IOWA CODE.

WHEREAS, Chapter 49 of the Code of Iowa grants cities and counties the power to combine township and city precincts as long as the combined precinct does not have a total population in excess of three thousand five hundred, as shown by the most recent federal decennial census, and the combined precinct is contained wholly within a legislative district; and

WHEREAS, due to redistricting, there is no satisfactory polling place within Iowa House District 13 in unincorporated Concord Township for citizens to vote in; and

WHEREAS, the Board of Supervisors of Woodbury County, Iowa and the City Council of the City of Sioux City wish to establish a polling place within the city limits, specifically Precinct 15, that can be used by both voters in Sioux City Precinct 15 and voters of unincorporated Concord Township to cast ballots for their respective officials; and

WHEREAS, combining the unincorporated Concord Township precinct with the contiguous Sioux City precinct allows the unincorporated Concord Township voters to vote at a nearby location; and

WHEREAS, the unincorporated Concord Township voters will vote separate township ballots and are not eligible to vote City of Sioux City municipal elections; and

WHEREAS, the City of Sioux City, Iowa, and Woodbury County, Iowa desire to enter into a Letter Agreement for the creation of a combined township and city precinct hereby known as Precinct 15, a copy of said Letter Agreement is attached hereto and by this reference made a part hereof, which Letter Agreement should be approved as to form and content. 

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the Letter Agreement by and between the City of Sioux City, Iowa, and Woodbury County, Iowa, for the creation of a combined township and city precinct hereby known as Precinct 15, referred to in the preamble, be and the same is hereby approved as to form and content.

BE IT FURTHER RESOLVED that the Chairman and County Auditor be and they are hereby authorized and directed to execute said Letter Agreement for and on behalf of the City.

BE IT FURTHER RESOLVED that the County Auditor be and he is hereby authorized and directed to file said Letter Agreement with the Iowa Secretary of State.

2.  The City of Sioux City precinct contiguous to the unincorporated Concord Township precinct, specifically Precinct 15, shall be combined with the unincorporated Concord Township precinct.

3.  The unincorporated Concord Township precinct contiguous to the City of Sioux City precinct, specifically Precinct 15, shall be combined with the City of Sioux City precinct, specifically Precinct 15.

4.  That voters in the unincorporated Concord Township may use the designated polling place in Sioux City Precinct 15 to cast ballots for all elections that pertain to unincorporated Concord Township.

SUPPORTING REQUEST FOR FINANACIAL ASSISTANCE FROM
THE 2011 STATE OF IOWA COMMUNITY DEVELOPMENT
BLOCK GRANT (CDBG) TORNADO AND WIND
DAMAGE ASSISTANCE PROGRAM

WHEREAS, the County of Woodbury, Iowa was declared a state disaster area due to the severe storms which swept through Iowa on April 9 and 10, 2011; and

WHEREAS, the County of Woodbury, Iowa suffered extensive damage due to severe thunderstorms and winds; and

WHEREAS, the County of Woodbury, Iowa supports the 2011 State of Iowa CDBG Tornado and Wind Damage Assistance Program application for financial assistance to uninsured or underinsured homeowners whose homes were affected by the disaster; and

WHEREAS, the County of Woodbury, Iowa will use financial assistance received from the 2011 State of Iowa CDBG Tornado and Wind Damage Assistance Program to provide assistance to low-to-moderate income homeowners who are unable to complete home repairs on their home caused by the April 9 and 10, 2011 storms; and

WHEREAS, the County of Woodbury, Iowa plans to work with the Siouxland Interstate Metropolitan Planning Council (SIMPCO) for grant-writing services and administration, including application processing and housing management.

NOW THEREFORE, BE IT RESOLVED by the County of Woodbury, Iowa that the Board of Supervisors supports the application requesting funding from the 2011 State of Iowa CDBG Tornado and Wind Damage Assistance Program.
