JANUARY 10, 2012 — SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, January 10, 2012 at 10:00 a.m.  Board members present were Boykin, Clausen, Monson, Smith, and Tripp.  Staff members present were Heather Satterwhite, Public Bidder, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented.  Copy filed.

The meeting was called to order.

Motion by Boykin second by Monson to approve the minutes of the 01/03/2012 Board meeting.  Carried 4-0; Clausen abstained.  Copy filed.

The Board approved the salary of Mark A. Monson, from Board Chairman to Board Member, Board of Supervisors Dept., $30,935/year, effective 01/03/2012.  Copy filed.

The Board approved the salary of Jaclyn D. Smith, from Board Member to Board Chairman, Board of Supervisors Dept., $36,831/year, effective 01/03/2012.  Copy filed.

The Board approved the reclassification of Willie E. Garrett, Deputy Sheriff, County Sheriff Dept., $25.13/hour, effective 01/28/2012.  Per CWA Deputy Sheriff contract agreement, from Class 1 to Senior Class, due to 4 years employment and 4 year Bachelor’s Degree.  Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign a Resolution approving tax abatement for St. Thomas Episcopal Church, 1106 ½ and 1108 Douglas Street, Sioux City.  Carried 4-0; Boykin abstained.

RESOLUTION 10,853
 
WHEREAS, St. Thomas Episcopal Church is the titleholder of  real estate Parcel #894734251004 located in Woodbury County, Iowa and legally described as follows: 

Parcel #894728112002

Except Irregular Tract in Southeast Corner Lot Four (4) and North Six Feet ( N 6 ft) West Ninety-three Feet (N 93 Ft) Lot Five (5) Block Sixty-four (64) Sioux City East Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, the abovestated property has taxes owing for the 2010/2011, tax year, and the parcel is owned by St. Thomas Episcopal Church; and

WHEREAS, the organization, namely St. Thomas Episcopal Church is failing to immediately pay the taxes due; and 

WHEREAS,  the Board of Supervisors sees that good cause exists for the abatement of these taxes; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates  the taxes owing on the above parcel according to Code of Iowa, 445.16 for the taxes owed for the 2010/2011 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Motion by Boykin second by Tripp to receive as submitted the Commission of Veteran Affairs Quarterly Report of Assistance for the 2nd quarter (October, November, and December 2011).  Carried 5-0.  Copy filed.

Motion by Tripp second by Monson to approve the appointment of Erica DeLeon, 900 Jennings Street, Sioux City, to the Siouxland District Health Board of Directors.  Carried 5-0.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution in support of the Siouxland Historical Railroad Association submitting a funding request to the Vision Iowa Community Attraction and Tourism Program.  Carried 5-0.

RESOLUTION #10,854
 
WHEREAS, the Siouxland Historical Railroad Association is a private, non-profit museum organization and owner of the Milwaukee Railroad Shops Historic District, located adjacent to the Loess Hills National Scenic Byway - Iowa Highway 12 in Woodbury County; and

WHEREAS, the Milwaukee Railroad Shops Historic District preserves and interprets the railroad heritage of Woodbury County and the surrounding tri-state Siouxland region; and

WHEREAS, in order to further the mutual tourism goals of Woodbury County and the Siouxland Historical Railroad Association to redevelop the Milwaukee Railroad Shops Historic District as a railroad museum for current and future generations to enjoy; and

WHEREAS, the Siouxland Historical Railroad Association will not be able to complete their preservation and redevelopment of the Milwaukee Railroad Shops Historic District without the aid of a Vision Iowa Community Attraction and Tourism (CAT) Program grant; and

WHEREAS, the Vision Iowa Board of Directors requires county governments to provide an official resolution of support approved by the governing boards of local governments to a CAT-eligible project located within its jurisdiction as part of the project’s application;

NOW, THEREFORE IT BE RESOLVED BY THE BOARD OF SUPERVISORS THAT WOODBURY COUNTY has demonstrated its financial support for the Milwaukee Railroad Shops Historic District Preservation Project with financial contributions of $17,000 and other in-kind services within the past fifteen years, including a $5,000 contribution in 2010; and.

BE IT FURTHER RESOLVED THAT THE BOARD OF SUPERVISORS OF WOODBURY COUNTY does hereby support and endorse the Siouxland Historical Railroad Association’s efforts to obtain grant funding to preserve and rehabilitate the Milwaukee Railroad Shops Historic District.

The Board discussed the possibility of providing support for the Sloan Public Library Grant application to Vision  Iowa.

Motion by Boykin second by Monson to approve providing $10,000.00 from Riverboat Funds for the support of the Sloan Public Library Project.  Carried 5-0.

The Board reviewed and discussed the scope of work performed by McClure Engineering.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign a 2012 construction evaluation Resolution, per recommendation of Planning and Zoning Director John Pylelo.  Carried 5-0.

RESOLUTION #10,855
 
WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and

WHEREAS,  by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2012 and January 31, 2013 and submit an adopted recommendation regarding that application to the DNR; and

WHEREAS,  the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3).

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.

Dan Lee, 1405 @60th St., Salix, addressed the Board with concerns about the location of an interchange currently located at the Port Neal complex. 

The Board discussed the proposed fiscal year 2013 County budget with Dennis Butler, County Budget/Tax Analyst.

Motion by Boykin second by Monson to receive the County Sheriff (General Basic) Uniform Patrol budget reduced by $500.00.  Carried 5-0.

Motion by Boykin second by Monson to receive the County Sheriff (General Basic) Investigations budget as submitted.  Carried 5-0.

Motion by Boykin second by Monson to receive the County Sheriff (General Basic) LEC – Correctional Facility budget reduced by $500.  Carried 4-0; Tripp abstained.

Motion by Monson second by Boykin to receive the County Sheriff (General Basic) Prairie Hills – Correctional Facility budget reduced by $2,000.00.  Carried 5-0.

Motion by Monson second by Boykin to receive the County Sheriff (General Basic) Administration budget reduced by $2,000.00.  Carried 5-0.

Motion by Tripp second by Boykin to postpone action on budgets other than public safety that were scheduled for today.  Carried 5-0.

Motion by Clausen second by Monson to receive the County Sheriff (General Basic) Civil Division budget reduced by $1,000.00.  Carried 5-0.

Motion by Clausen second by Monson to receive the County Sheriff (General Basic) Crime Prevention budget reduced by $1,500.00.  Carried 5-0.

Motion by Monson second by Boykin to receive the County Sheriff (General Supplemental) Court Security budget reduced by $54,000.00.  Carried 4-0; Tripp abstained.

Motion by Boykin second by Tripp to receive the County Sheriff (Rural Basic) Uniform Patrol budget as submitted. Carried
5-0.

Motion by Boykin second by Monson to receive the County Sheriff’s Forfeiture – 278 budget as submitted.  Carried 5-0.

The Board adjourned the regular meeting until January 17, 2012.
