MARCH 19, 2013 — TWELVETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 19, 2013 at 10:00 a.m.  Board members present were Clausen, Tripp, Monson, Smith and Boykin.  Staff members present were Karen James, Board Administrative Coordinator, Dennis Butler, Finance/Operations Controller, Joshua Widman, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board. 
      
The Claims were approved as presented.  Copy filed.

The meeting was called to order.

Motion by Tripp second by Monson to approve the minutes of the 3/12/2013 Board meeting.  Carried 5-0.  Copy filed.

Motion by Smith second by Boykin to approve Woodbury County Extension Health Insurance request.  Carried 5-0.  Copy filed.
      
Motion by Tripp second by Monson to receive the appointment of Lillyan Gonzalez-Gaytan, 1001 Clairmont Circle, Sergeant Bluff, Iowa to the office of Woodbury County Extension Council Member, to fill a vacancy for the office previously held by Cathie Bishop, until the next regular Election.  Carried 5-0.  Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairperson to sign a Resolution approving petition for suspension of taxes for Lorrettia Tedford, 1720 & 1724 Claridge, Sioux City, parcel #894822232001 & #894822232002.  Carried 5-0.

RESOLUTION APPROVING SUSPENSION OF TAXES
      
WHEREAS, Lorrettia Tedford is the titleholder of  properties located at 1720 & 1724 Claridge Sioux City,  Woodbury County, Iowa, and legally described as follows:  
    
Parcel #894822232001  

Lot One (1) Block Five (5) Edgewater Park Addition, City of Sioux City, Woodbury County, Iowa

Parcel #894822232002

Lot Two (2) Block Five (5) Edgewater Park Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Lorrettia Tedford is the titleholder of the aforementioned properties have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 2009 Iowa Code section 427.9, and 

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension  for this property.

Motion by Boykin second by Smith to approve and authorize the Chairperson to sign a Resolution approving a 28E  Agreement among Woodbury County, Iowa, City of Moville, Iowa, Woodbury County Fair Association, Inc., and Woodbury County Expo Center forming the Woodbury County AG and Expo Association.  Carried 5-0.

RESOLUTION APPROVING 28E AGREEMENT AMONG WOODBURY COUNT, IOWA, CITY
OF MOVILLE, IOWA, WOODBURY COUNTY FAIR ASSOCIATION, INC., AND WOODBURY COUNTY EXPO
CENTER IN ORDER TO FORM THE WOODBURY COUNTY AG AND EXPO ASSOCIATION

WHEREAS, the City of Moville, Iowa, Woodbury County, Iowa, Woodbury County Fair Association, Inc., and Woodbury County Expo Center desire to enter in an Agreement to form a separate organization, all in compliance with and as authorized by Chapter 28E,  for the purpose of establishing and operating an exposition center; and

WHEREAS, the parties have prepared a 28E Agreement relating to said purpose, a copy of which is attached hereto and by this reference made a part hereof, which will establish and set forth the powers, duties, responsibilities, and obligations of each party to the 28E Agreement; and

WHEREAS, the name of the entity created by said 28E Agreement is the Woodbury County Ag and Expo Association; and

WHEREAS, said 28E Agreement should be approved as to form and content and the Chairman of the Board of Supervisors be authorized and directed to execute said 28E Agreement for and on behalf of Woodbury County, Iowa.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the 28E Agreement forming the Woodbury County Ag and Expo Association, referred to in the preamble herein, be and the same is hereby approved as to form and content and the Chairman of the Board of Supervisors be and he is hereby authorized and directed to execute the same for and on behalf of Woodbury County, Iowa.

Motion by Boykin second by Monson to approve FY2014 Indirect Cost Rate Proposal.  Carried 5-0.  Copy filed.

Motion by Monson second by Boykin to approve State Homeland Security Grant Budget Reduction Proposal.  Carried 5-0.  Copy filed.

Motion by Monson second by Tripp to approve and authorize the Chairman to sign a Permit to Work in the County Right of Way for Charlie Oehlerking , per recommendation of County Engineer Mark Nahra.   Carried 5-0.  Copy filed.

Motion by Smith second by Tripp to approve the contract and bond for Project Number STP-S-CO97(117)—5E-97.  Carried 5-0.  Copy filed.

Motion by Tripp second by Monson to approve the contract and bond for Project Number FM-CO97(118)—55-97, PCC Paving D51.  Carried 5-0.  Copy filed.

The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.
      
The Board adjourned the regular meeting until March 26, 2013.
