MARCH 31, 1998 FORTY-FIRST MEETING OF THE BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 31, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight and Clausen. Welte was absent. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, County Auditor/Board Secretary.
Meeting called to order.
The Claims were approved as presented.
Motion by Batcheller second by Boykin to amend the Board Minutes of March 17, 1998 as submitted. Carried 4-0.
Motion by Batcheller second by Boykin to approve the minutes of the regular Board Minutes of March 24, 1998 as submitted. Carried 3-0. Clausen abstained.
Motion by Boykin second by Batcheller to approve the minutes of Executive Session of March 24, 1998 as submitted. Carried 3-0. Clausen abstained.
The Board approved the appointment of Mark J. Petit, Equipment Operator, Secondary Roads, @$12.06/hr., effective 4/1/98. Copy filed.
The Board approved the separation of Phyllis M. Knapp, Temporary Clerk II, County Auditor, effective 1/23/98. Copy filed.
Motion by Clausen second by Batcheller to authorize the Chairman Pro Tem to sign the authorization to Initiate Hiring Process for (3) Temporary Engineering Aides, for Secondary Roads, $6.50 - $8.00/hr. (Based upon experience with Woodbury County), (4) Temporary Summer Laborers, for Secondary Roads, $6.50 - $7.50/hr. (Based upon experience with Woodbury County) and (2) Case Management Officers, for Social Services, $22,000/year. Carried 4-0. Copy filed.
The Public Hearing and sale of Real Estate Parcel # 145905, was held at 10:15 A.M. The Chairman Pro Tem called on anyone wishing to be heard on said sale.

Motion by Clausen second by Burnight to close the Public Hearing on the sale of Real Estate Parcel #145905, as there was no one present wishing to be heard on said sale. Carried 4-0.

Chairman Pro Tem called for bids on Real Estate Parcel #145905. Gene Sherman for S. & S. Development bid $1,231.00 plus recording fees. There were no further bids.

RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA #9032

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of S. & S. DEVELOPMENT.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8 (3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

NOW THEREFORE,
BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:
1. That a public hearing on the aforesaid proposal shall be held on the 14th day of April, 1998, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.
2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 14th day of April, 1998, immediately following the closing of the public hearing.
3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $2,000.00 plus recording fees.
4. That this resolution, preceded by the caption Notice of Property Sale and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Wayne Prichard appeared for Ellen Galland before the Board to ask that the County accept a road in the Gallands Lakeview sub-division (Browns Lake). The consensus was not to accept the road.
Motion by Boykin second by Batcheller to refer a proposed amendment to the County Zoning Commission for recommendations. Carried 4-0.
Motion by Boykin second by Clausen to approve two proposals submitted by Shelly Malcom, 404 Project Manager for Holly Springs Commercial Properties and Church. Carried 4-0. Copy filed.
A Public Hearing was opened on the Woodbury Countys Mental Retardation Plan. Theresa Jochum presented the plan. Sharon Caskey appeared to support goal #6 of the plan.
Motion by Clausen second by Batcheller moved to close the Public Hearing for the Woodbury Countys Mental Retardation Plan. Carried 4-0.
Motion by Batcheller second by Clausen to approve the proposed Woodbury Countys Mental Retardation Plan with the deletion of Goal #6. Carried 4-0. Copy filed.
A Public Hearing was opened for Woodbury Countys Mentally Ill Plan. Patty Erickson Puttmann presented committees proposed plan and amendments.
Motion by Clausen second by Boykin to close the Public Hearing for the Woodbury Countys Mentally Ill Plan. Carried 4-0.
Motion by Boykin second by Clausen to approve the Woodbury Countys Mentally Ill Plan as proposed and amended by the committee. Carried 4-0.
Motion by Boykin second by Batcheller to authorize the Chairman to sign a letter of support for a Drug Court Grant for adults and juveniles from the U.S. Department of Juvenile Justice. Carried 4-0.
Motion by Boykin second by Batcheller to approve subject to the awarding of the Drug Court Grant the matching funds of $20,000.00 for the first year with the intent to fund through out the life of the grant.
JD Pellersells and Patty Erickson-Puttmann addressed the Board about the possibility of Woodbury County Employees having a picnic this summer.
The Board adjourned the meeting until April 7, 1998.
