SEPTEMBER 22, 1998 ELEVENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, September 22, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight and Welte. Clausen absent. Staff members present were Nancy Hodge, Board Administrative Coordinator, Diane Swoboda Peterson, Real Estate/Recorder Deputy and Ann Long, Board Legal Counsel.

The Claims were approved as presented.

Meeting called to order.

Motion Burnight second by Boykin to approve the Regular Board Minutes of September 15, 1998 as submitted. Carried 4-0.

The Board approved the separation of Amy C. Egdorf, Temporary Clerk County, Auditor/Recorder, effective 9/11/98. End of Temp Work. Copy filed.

The Board approved the separation of Eric D. France, Correctional Officer, County Sheriff, effective 9/15/98. Copy filed.

Motion by Boykin second by Burnight to authorize the Chairman to sign the authorization to Initiate Hiring Process for a Male Correctional Officer, County Sheriff, @$11.11/hr. Carried 4-0.

Motion by Boykin second by Batcheller to allow District Health to provide Flu shots for 1998 to County Employees. Carried 4-0.

Motion by Batcheller second by Burnight to authorize Chairman to sign the plat for Schoenherr Subdivision. Carried 4-0. Copy filed.

RESOLUTION ACCEPTING AND APPROVING SCHOENHERRS ADDITION.

WHEREAS THE OWNERS AND PROPRIETORS DID ON 22ND DAY OF SEPTEMBER, 1998, FILE WITH THE WOODBURY COUNTY AUDITOR OF WOODBURY COUNTY, IOWA, A CERTAIN PLAT DESIGNATED AS SCHOENHERRS ADDITION, AND WHEREAS IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME.

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT;


NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE PLAT OF SCHOENHERRS ADDITION BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRMAN AND SECRETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNERS AND PROPRIETORS A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes; and

The Public Hearing and sale of Real Estate Parcel #213840 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Batcheller to close the Public Hearing on the sale of Real Estate Parcel # 213840 as there was no one present wishing to be heard on said sale. Carried 4-0.

Chairman called for bids on Real Estate Parcel #213840. William F. Chauncey bid $2020.00 plus recording fees. There were no further bids.

Motion by Batcheller second by Burnight to accept William F. Chauncey $2020.00 bid plus recording fees for Real Estate Parcel #213840. Carried 4-0.

RESOLUTION OF THE BOARD OF SUPERVIORS OF WOODBURY COUNTY, IOWA #9117

BE IS RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: WILLIAM F. CHAUNCEY SINGLE PERSON

in the sum of TWO THOUSAND TWENTY AND NO/100 ($2,020.00) Dollars for the following described real estate to wit:

Lots One (1), Two (2), and Three (3) of Block Seven (7) and vacated Washington Street Adjacent; All Lying North of Martha Street Auditors Plat and Lots Two (2), Three (3), Four (4), Five (5), Six (6), Seven (7) and Eight (8) in Block Six (6) and all lying North and East of Martha Street Auditors Plat and Lots Nine (9) and Ten (10), Vacated Washington Street, Vacated South St. Marys Street Adjacent and Except Small Triangle in Southwest corner of Lot Eleven (11) in Block Six of Hedges 3rd Table Addition to City of Sioux City, Woodbury County, Iowa

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8 (3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of the Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

Max C. Rasmussen from Apar Brokerage Company addressed the Board about tax forgiveness on Parcels #5822872 and #90008.

The Board has no authority on tax assessments and suggested Mr. Rasmussen discuss this matter with City Assessor.

Motion by Boykin second by Burnight to authorize the Chairman to sign a Utility Accommodation Permit. Carried 4-0.

Motion by Batcheller second by Boykin to authorize the Chairman to sign agreement with NRCS for construction of grade control at three (3) locations. Carried 4-0.

Motion by Boykin second by Burnight to authorize the Chairman to sign agreement with NRCS for construction of stream stabilization at three (3) locations. Carried 4-0.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign resolutions for setting Public Hearing for vacation of roads at three (3) locations and vacation of property at one (1) site. Carried 4-0.

WOODBURY COUNTY, IOWA
RESOLUTION NO. 9112

A RESOLUTION SETTING DATE FOR PUBLIC
HEARING FOR VACATING ROAD

WHEREAS, Woodbury County relocated and reconstructed a section of 150th Street in Banner and Arlington Township from County Route D-22 (Old U.S. 20) northeasterly and now desires to vacate a section of established roadway.

WHEREAS, Woodbury County Board of Supervisors in accordance with Section 306.11, (Code of Iowa 1997), as amended, seeks to set a date for public hearing to vacate a road legally described as follows:

Vacate all that portion of county road right-of way, more commonly known as 150th Street established as Road No. 216 and described as:

Beginning at N1/4 Section 36-89-45 proceeding northerly to NE Corner of SW1/4SW1/4 Section 25-89-45 and then easterly approximately 250 feet

NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors that on Tuesday, October 27, 1998 at 10:25 a.m. the County will hold a public hearing to vacate the above described roads.

HEARING FOR VACATING ROAD

WHEREAS, The Iowa DOT in granting permission to Woodbury County to construct the intersection of Buchanan Avenue with U.S. 20 requested closure of the Benton Avenue/U.S. 20 intersection for Access Control.

WHEREAS, Woodbury County Board of Supervisors in accordance with Section 306.11, (Code of Iowa 1997), as amended, seeks to set a date for public hearing to vacate a road legally described as follows:

Vacate all that portion of county road right-of way, more commonly known as Benton Avenue established as Road No. 872 and described as:

Beginning at U.S. 20 and proceeding northerly between Section 31 and 32-89-46 to 158th Street.


NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors that on Tuesday, October 27, 1998 at 10:35 a.m. the County will hold a public hearing to vacate the above described roads.

HEARING FOR VACATING ROAD

WHEREAS, Woodbury County received a request to vacate a portion of right of way near the city of Sloan and approved this request at their February 12, 1998 meeting.

WHEREAS, Woodbury County Board of Supervisors in accordance with Section 306.11, (Code of Iowa 1997), as amended, seeks to set a date for public hearing to vacate a road legally described as follows:

Vacate all that portion of county road right-of way, more commonly known as Road No. 25 and 26 described as;

Beginning Section 29 and 32-86-46 from west ROW of Union Pacific RR (formerly Chicago & NW RR) westerly 165.5 feet to east ROW of the elevator access.

NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors that on Tuesday, October 27, 1998 at 10:40 a.m. the County will hold a public hearing to vacate the above described roads.

A RESOLUTION SETTING DATE FOR PUBLIC
HEARING FOR VACATING SECONDARY ROAD
DEPARTMENT PROPERTY

WHEREAS, Woodbury County Secondary Roads Department has determined that is no longer has need for an interest in a gravel pit and access road located in a parcel bounded by 170th Street on the north, Mason Avenue on the West southeast of Pierson.

WHEREAS, Woodbury County Board of Supervisors in accordance with Section 306.11, (Code of Iowa 1997), as amended, seeks to set a date for public hearing to vacate a parcel legally described as follows:

Vacate all that portion of county property used as a gravel pit and access road, located in a parcel of ground lying in the following plat:

0.614 acres for access road and 5.906 acres for gravel pit in NE1/4 Section 17-89-42.

NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors that on Tuesday, October 27, 1998 at 10:30 a.m. the County will hold a public hearing to vacate the above described roads.

Harold Nash addressed the Board regarding the hard surfacing ofK-64 and presented a petition from the City of Moville, School Board, and Chamber.

Dick Storm, Secondary Roads will look at putting a 5-year plan into affect for K-64.

Lloyd Tresham of Hornick , IA addressed the Board regarding a bridge that is out.

Dick Storm, Secondary Roads gave three (3) alternatives and cost proposals. Mr. Storm will come back to the Board with proposals.

Motion by Boykin second by Batcheller to approve payment and placement for M.C. at New Haven Group Home. Carried 4-0.

Motion by Burnight second by Batcheller to approve payment and placement for J.C. at Northwood Group Home from Siouxland Residential Services. Carried 4-0.

Glenn Sedwig addressed the Board regarding the 911-surcharge increase.

Dave Amick, Sheriffs Department spoke stressing the importance of recommendation and hope for support of the Board.

This 911-surcharge increase item will be placed on the next weeks agenda.

Stephen Quirk, Director of Siouxland District Health and Dennis Butler, Budget/Tax Analyst discussed the building expansion project with proposals for financing.

Mr. Butler will come back to the Board with recommendation in 2 weeks as to how the county will finance this project and Mr. Quirk will come back with his funding sources.

John Handla, Goodwill Industries introduced Dean Williams who came to Goodwill Industries from The Boys & Girls Home as a new employee.


Motion by Boykin second by Welte to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 4-0 on roll call vote.

Motion by Boykin second by Burnight to go out of Executive Session. Carried 4-0 on roll call vote.

The Board adjourned the meeting until September 29, 1998.
