OCTOBER 27, 1998 SIXTEENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, October 27, 1998 at 9:00 A.M. Board members present were Batcheller, Boykin, Burnight, and Clausen. Mr. Welte was absent. Staff members present were Nancy Hodge, Board Secretary and Patrick F. Gill, County Auditor/Board Secretary.

The Claims were approved as presented.

Meeting called to order.

Motion by Clausen second by Boykin to approve the Regular Board Minutes of October 20, 1998 as submitted. Carried 3-0. Batcheller abstained.

Motion by Clausen second by Boykin to approve the minutes of the 1st Executive Session of October 20, 1998. Carried 3-0. Batcheller abstained.

Motion by Boykin second by Clausen to approve the minutes of the 2nd Executive Session of October 20, 1998. Carried 3-0. Batcheller abstained.

Motion by Clausen second by Boykin to approve the minutes of the 3rd Executive Session of October 20, 1998. Carried 3-0. Batcheller abstained.

Motion by Batcheller second by Boykin to approve the minutes of the Executive Session of October 6, 1998. Carried 4-0.

The Board approved the appointment of Jeffery L. King, Assistant Building Superintendent, Building Services, @ $31,450/year, effective 10/28/98. Job Vacancy Posted: 9/9/98. Copy filed

The Board approved the transfer of Gerald S. Stevens, Sr. Real Estate/Recorders Clerk, County Auditor/Recorder, @ $12.38/hour, effective 10/20/98, from Grade 4.5, Step 6 to Grade 5, Step 6. In-House Posting: 10/7/98. Copy filed.

The Board approved the transfer of Christine A. Murphy, Real Estate Clerk II, County Auditor/Recorder, @ $11.47/hour, effective 10/20/98, from Grade 5, Step 4 to Grade 4.5, Step 6. Copy filed.

The Board approved the appointment of Kevin D. Horsley, Correctional Officer, County Sheriff, @ $11.11/hour, effective October 28 1998. Job Vacancy Posted: 9/23/98. Copy filed.

The Board approved the Mark J. Petit, Equipment Operator, County Engineer, @ $12.85/hour, Per CWA Contract Agreement, effective October 5, 1998. End of Probation salary increase. Copy filed.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign the authorization to hire.

Boykin requested and received unanimous consent to withdraw his motion.

Motion by Boykin second by Clausen to close the public hearing for the sale of Parcels #351495 and #351510. Carried 4-0.

Motion by Batcheller second by Boykin to sell Parcels #351495 and #351510 to Rene Bergner for the minimum bid of $300 plus recording fees. Carried 4-0.

RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA: #9124

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: RHONDA J. BERGNER SINGLE PERSON.

In the sum of THREE HUNDRED AND NO/100 ($300.00) Dollars for the following described real estate to wit:

LOT FOUR (4), BLOCK FIFTEEN (15) AND LOTS FIVE THROUGH EIGHT (5-8) BLOCK FIFTEEN (15) MILLERS ADDITION, CITY OF SIOUX CITY, WOODBURY COUNTY, IOWA

Now and included in and forming a part of the City of SIOUX CITY, Iowa, the same is hereby accepted; said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3&4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

Motion by Clausen second by Batcheller to appoint Bob Jones to the Woodbury County Community Action Agency Board of Directors. Carried 4-0.

The Board directed the Board Administrative Coordinator to consult with an architect on proposals for chairs for the boardroom.

Motion by Clausen second by Boykin to authorize the Chairman to sign an agreement with the City of Moville for use of secondary road equipment. Carried 4-0.

Motion by Boykin second by Batcheller to close the public hearing for vacating a portion of 150th Street. Carried 4-0.

Motion by Clausen second by Boykin to vacate a portion of 150th Street. Carried 4-0.

Motion by Clausen second by Batcheller to close the public hearing for vacation of secondary road property containing an unused gravel pit and access road. Carried 4-0.

Motion by Clausen second by Batcheller to vacate secondary road property containing an unused gravel pit and access road. Carried 4-0.

Motion by Clausen second by Batcheller to close a public hearing for the vacation of a portion of Benton Avenue. Carried 4-0.

Motion by Clausen second by Boykin to vacate a portion of Benton Avenue. Carried 4-0.

Motion by Batcheller second by Clausen to close a public hearing for vacation of a portion of road #25 and #26. Carried 4-0.

Motion by Burnight second by Batcheller to vacate a portion of road #25 and #26. Carried 4-0.

Consideration of an amendment to Siouxland Mental Health Case Management contract was postponed by unanimous consent.

The Board approved the Auditors 1st Quarter Report, FY 99. Copy filed.

The Board approved the Sheriffs Civil Division 1st Quarter and Year To Date Report. Copy filed.

The Board meeting adjourned until November 3rd, 1998.
