NOVEMBER 17, 1998 NINETEENTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, November 17, 1998 at 9:00 A.M. Board members present were Batcheller, Burnight, Clausen, and Welte. Boykin absent. Staff members present were Nancy Hodge, Board Administrative Coordinator, and Patrick F. Gill, County Auditor/Board Secretary.

The Claims were approved as presented.

Motion by Batcheller second by Burnight to go into Executive Session per Iowa Code Section 20.17(3). Carried 4-0 on roll call vote.

Motion by Burnight second by Batcheller to go out of Executive Session. Carried 4-0 on roll call vote.

Meeting called to order.

Motion by Burnight second by Welte to approve the Regular Board Minutes of November 10, 1998 as submitted. Carried 3-0. Batcheller abstained.

Motion by Clausen second by Burnight to approve the Executive Session #1 of November 3, 1998 as submitted. Carried 4-0.

Motion by Burnight second by Clausen to approve the Executive Session #2 of November 3, 1998 as submitted. Carried 4-0.

The Board approved the reclassification of Susan H. Grover, Legal Secretary III, County Attorney, @$11.14/hr., effective 11/27/98. Per AFSCME Courthouse. Contract agreement, from Grade 6, Step 1 to Grade 6, Step 2. Copy filed.

There was a discussion about the emergency closing policy for the courthouse.

The Chairperson asked for a unanimous consent to defer on the public hearing. There was unanimous consent to defer on the public hearing for the sale of parcel #105660 to the City of Sioux City for $1.00.

The Public Hearing and sale of Real Estate Parcel #008775 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Burnight second by Clausen to approve and authorize the to close the public hearing for the sale of Parcel # 008775. Carried 4-0.

Motion by Batcheller second by Clausen to sell Parcel #008775 to Daniel R. Tramp for the minimum bid of $200.00 plus recording fees. Carried 4-0.

RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA: #9134

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: DANIEL R. TRAMP.

In the sum of TWO HUNDRED AND NO/100 ($200.00) Dollars for the following described real estate to wit:


NORTH TWENTY-SIX FEET AND FOUR INCHES (N 26 4) OF LOT EIGHTEEN (18) IN BLOCK THIRTY-ONE (31) OF THE SIOUX CITY ADDITION, CITY OF SIOUX CITY, WOODBURY COUNTY, IOWA

Now and included in and forming a part of City of SIOUX CITY, Iowa, the same is hereby accepted; said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.


BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3&4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s)

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

A Public Hearing was held for the vacation of a portion of Lakeport Road Right-of-Way.

Motion by Batcheller second by Clausen to close the public hearing for the vacating of a portion of Lakeport Road Right-Of-Way. Carried 4-0.

Motion by Batcheller second by Burnight to close the public hearing for Local Law Enforcement Block Grant. Carried 4-0.

Motion by Batcheller second by Burnight to authorize the Chairman to sign the 1998 Local Law Enforcement Block Grants Program Follow-Up Information Form. Carried 4-0.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign a lease agreement with U.S. west for equipment space in the Trosper-Hoyt County Services Building. Carried 4-0.

A public hearing was held regarding a rezoning request by Steve Sitzmann on behalf of Beane Plumbing. Steve Sitzmann appeared on behalf of Beane Plumbing in support of the request. Pat Rooney appeared on behalf of his in-laws, Mr. & Mrs. Loren Parks, to object to the request.

Motion by Clausen second by Burnight to close the public hearing for rezoning request by Steven Sitzmann on behalf of Beane Plumbing. Carried 4-0.

Motion by Batcheller second by Clausen to refer the request to the Planning and Zoning Commissioner. Carried 4-0.

A public hearing was held for the vacating of a portion of Stoddard Avenue. Ken Miller appeared to support the vacation. David Blutt and Clarence Uhl appeared in opposition.

Motion by Burnight second by Batcheller to close the public hearing for the vacation of a portion of Stoddard Avenue. Carried 4-0.

There was a discussion about funding sources for project in the immediate future.

Motion by Clausen second by Batcheller to authorize the Chairman to sign a letter to the City Manager relating to the proposal to move the Communication Center to Trosper Hoyt County Services Building. Carried 4-0.

Mr. Burnight excused himself at 12:25 A.M.

Motion by Batcheller second by Clausen to go into Executive Session per Iowa Code Section 21.5(1)(j). Carried 3-0 on roll call vote.

Motion by Batcheller second by Clausen to go out of Executive Session. Carried 3-0 on roll call vote.

Motion by Welte second by Clausen to extend the offer. Carried 3-0.

The Board approved the Quarterly Report of Commission of Veteran Affairs ending September 30, 1998. Carried 3-0. Copy filed.

The Board adjourned the meeting until November 24, 1998.
