FEBRUARY 23, 1999 THIRTY-SECOND MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, February 23, 1999 at 9:00 A.M. Board members present were Clausen, Walish and Welte. Batcheller and Boykin absent. Staff members present were Nancy Hodge, Board Administrative Coordinator and Patrick F. Gill, County Auditor/Board Secretary.

The Claims were approved as presented.

Meeting called to order.

Motion by Welte second by Walish to approve the Board minutes of February 16, 1999 as submitted with the elimination of Supervisors Batcheller and Boykin who were shown as present. Carried 3-0.

There was open discussion period held by the Board.

The Board approved the appointment of Scot L. Lilly, Custodian, Building Services, @$7.35/hr., effective 2/17/99. Copy filed.

Motion by Welte second by Walish to authorize the Chairman to sign the Authorization to Initiate the Hiring Process for Temporary Summer Engineering Aid(s), County Engineer, Salary Range: $7.00-$8.50/hr. (Based on Experience with Woodbury County) and Temporary Summer Laborer(s), County Engineer, Salary Range: $7.00-$8.00/hr. (Based on Experience with Woodbury County). Carried 3-0. Copy filed.

Motion by Welte second by Walish to approve and receive for signatures a resolution designating sections of roads to be temporarily closed for 1999 construction projects. Carried 3-0. Copy filed.

RESOLUTION NO. 9158

BE IT RESOLVED, by the Woodbury County Board of Supervisors, duly assembled, pursuant to Section 306.41 of the Code of Iowa, 1997, as amended, that the following highways or sections of highways described and shown of Exhibits A and B respectively, attached hereto and by this reference made a part hereof, will become temporarily closed for a period not exceeding one hundred sixty (160) days for construction, receipt-construction, and/or maintenance and thereupon the County Engineer is directed to cause signs and partial or total barricades to be erected in the roadway at each end of said described highway or section of highway, and on said highway where intersected by other highways, reading Road Closed. Said described highways shall become closed effective upon erection of signs and barricades, and shall remain closed until said signs and barricades are removed.

Motion by Welte second by Walish to approve and authorize Chairman to sign Grant Agreement between Iowa Department of Natural Resources and Woodbury County. Carried 3-0. Copy filed.

The Public Hearing and sale of Real Estate Parcel #262245 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Welte second by Walish to close the Public Hearing on the sale of Real Estate Parcel #262245 as there was no one present wishing to be heard on said sale. Carried 3-0.

Chairman called for bids on Real Estate #262245. Sandra Kay Robley bid $500.00 plus recording fees. There were no further bids.

Motion by Welte second by Walish to accept Sandra Kay Robleys $500.00 bid for Real Estate Parcel #262245. Carried 3-0.

RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA #9159

BE IT RESOVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: Sandra Kay Robley

in the sum of FIVE HUNDRED AND NO/100 ($500.00) Dollars for the following described real estate to wit:

LOT FIVE (5), BLOCK EIGHT (8), HORNICKS 2ND ADDITION, CITY OF SIOUX CITY, WOODBURY COUNTY, IOWA

now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted; said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa is the owner under a tax deed of a certain parcel of real estate described as:

Lots one (1) and Two (2) Block One (1) Kelloggs Addition, City of Correctionville, Woodbury County, Iowa

NOT THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 9th day of March, 1999, at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 9th day of March, 1999, immediately following the closing of the public hearing, to the City of Correctionville, Iowa only per Code on Iowa 331.361(3)..

3. That said Board proposes to sell the said real estate to the City of Correctionville Iowa, only for consideration of $1.00 recording fees.

4. That this resolution, preceded by the caption Notice of Property Sale and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Welte second by Walish to approve letter of authorization for Rick D. Schneider to sign on behalf of Woodbury County all paperwork and documentation associated with Wetland Acquisition and Development on the Owego Wetland Complex. Carried 3-0. Copy filed.

Motion by Welte second by Walish to approve the appointments of Charles A. Johnson, 1 yr. term, Maurice Welte, 2 yr. term and Les Juon, 3 yr. term to the County Board of Commission to the Loess Hills Alliance. Carried 3-0.

Motion by Walish second by Welte to rescind motion of Board of Supervisors of December 22, 1998 regarding sale of farm by auction by March 1, 1999. Carried 3-0.

Motion by Clausen second by Walish to cash rent the tillable land at the county farm for one year with the property to be vacated by December 1, 1999. Carried 3-0.

The Board recessed for five minutes.

Motion by Welte second by Clausen to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 3-0 on roll call vote.

Motion by Welte second by Walish to go out of Executive Session. Carried 3-0 on roll call vote.


Motion by Welte second by Walish to approve the attorneys recommendation in a workers compensation claim made against the county. Carried 3-0.

The Chairman asked for and received unanimous consent to add an item to the agenda for an executive session due to the urgency of the issue.

Motion by Welte second by Walish to go into executive session under section 21.5.(1) (a). Carried 3-0 on roll call vote.

Motion by Walish second by Clausen to go out of executive session. Carried 3-0 on roll call vote.

The Board adjourned the regular meeting until March 2, 1999
