MAY 11, 1999 FORTY THIRD MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, May 11, 1999 at 9:00 A.M. Board members present were Batcheller, Walish, and Welte. Clausen and Boykin absent. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, County Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

Meeting called to order.

Motion by Walish second by Batcheller to appoint Welte Chairman Pro Tem. Carried 3-0.

There was open discussion period held by the Board.

Motion by Batcheller second by Walish to approve the Board minutes of May 4, 1999 as submitted. Carried 3-0.

Motion by Batcheller second Walish by to approve the minutes of Executive Session #1 of May 4, 1999 as submitted. Carried 3-0.

Motion by Welte second by Walish to approve the minutes of Executive Session #2 of May 4, 1999 as submitted. Carried 3-0.

Motion by Walish second by Batcheller to approve the minutes of Executive Session #3 of May 4, 1999 as submitted. Carried 3-0.

The Board approved the appointment of Joseph A. Roepke, Temporary M.V. Clerk II, County Treasurer, @$8.76/hr., effective 5/10/99. Not to exceed 120 days. Copy filed

The Board approved the reclassification of Donald C. Groves, Correctional Officer, County Sheriff, @$12.40/hr., effective 5/31/99. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the separation of Susan K. Conway, Real Estate/Mapping Clerk II, County Auditor/Recorder, effective 5/21/99. Copy filed.

The Board approved the separation of Rachelle A. Martin, Payroll Clerk II, County Auditor/Recorder, effective 5/21/99. Copy filed.

Motion by Batcheller second by Walish to authorize Chairman to sign the Authorization to Initiate Hiring Process for M.V. Clerk II, County Treasurer, AFSCME Courthouse/Grade 4.5, Step 1: $8.76/hr., Real Estate/Mapping Clerk II, County Auditor/Recorder, AFSCME Courthouse/Grade 4/Step 1: $8.63/hr., and a Payroll Clerk II, County Auditor/Recorder, AFSCME Courthouse/Grade 4/Step 1: $8.63/hr. Carried 3-0. Copy filed.

Motion by Walish second by Batcheller to approve and authorize the Chairman to sign Workers Compensation License. Carried 3-0. Copy filed.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign Amendment #1 to the Disaster Assistance Agreement between Iowa Department of Economic Development (IEMD) and Woodbury County. Carried 3-0. Copy filed.

Motion by Walish second by Batcheller to authorize the Chairman to sign agreement with City of Moville to use Secondary Road Department Equipment. Carried 3-0. Copy filed.

Motion by Batcheller second by Walish to authorize the Chairman to sign request for Utility Accommodation Permit to be submitted to Iowa DOT. Carried 3-0. Copy filed.

There was a discussion of a retaining wall on county property. Frank Gray, an adjacent property owner appeared to discuss the issue. The County Engineer will report back to the Board after further research.

Mike Neswick, RML Architects discussed the Change Order #G4 for remodeling of Trosper-Hoyt County Services Buildings third floor.

Motion by Batcheller second by Walish to approve Change Order #G4 from Global Engineering & Const. for remodeling of Trosper-Hoyt County Services Buildings third floor. Carried 3-0. Copy filed.

Nancy Hodge, Board Administrative Coordinator discussed bids for flagpoles, stands and tops for flags.

Motion by Batcheller second by Walish to award the bid for flagpoles, stands and tops to Mullin Awning & Siding Company for $106.50. Carried 3-0.

Motion by Batcheller second by Walish to approve lifting a tax suspension for D.W. Carried 3-0.

The Claims were approved as presented.

Craig Jorgensen, Clerk of the District Court appeared before the Board to inform them about an effort to improve courthouse security.

Randy Carpenter of the City of Sioux City planning appeared before the Board to inform them about the Northern Loess Hills Water Quality Project.

The Chairman Pro-Tem asked for and received unanimous consent to add an item to the agenda due to the urgency and timeliness of the issue.

Motion by Welte second by Batcheller to go into Executive Session under section 21.5(c)c to discuss possible litigation. Carried 3-0 on a roll call vote.

Motion by Batcheller second by Walish to go out of Executive Session. Carried 3-0 on roll call vote.

The Public Hearing and sale of Real Estate Parcel #626100 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Batcheller second by Walish to close the Public Hearing on the sale of Real Estate Parcel #626100 as there was no one present wishing to be heard on said sale. Carried 3-0.

Chairman called for bids on Real Estate Parcel #626100.Kevin Jorgensen bid $1,550.00 plus recording fees and Gene Sherman bid $1,500.00 plus recording fees. There were no further bids.

Motion by Batcheller second by Walish to accept Kevin Jorgensens $1,550.00 bid for Real Estate Parcel #626100 plus recording fees. Carried 3-0.


RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA #9193

BE IT RESOVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: KEVIN JORGENSEN AND JEAN JORGENSEN, HUSBAND AND WIFE, AS JOINT TENANTS WITH FULL RIGHTS OF SURVIVORSHIP AND NOT AT TENANTS IN COMMON

in the sum of ONE THOUSAND FIVE HUNDRED FIFTY AND NO/100 ($1,550.00) Dollars for the following described real estate to wit:

Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

Motion by Walish second by Batcheller to close the Public Hearing on the sale of Real Estate Parcel #281430 as there was no one present wishing to be heard on said sale. Carried 3-0.

Chairman called for bids on Real Estate Parcel #281430. Troy Jones bid the minimum bid of $1,000.00 plus recording fees. There were no further bids.

in the sum of ONE THOUSAND NO/100 ($1,000.00) Dollars for the following described real estate to wit:
