APRIL 25, 2000 FORTIETH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 25, 2000 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Welte to approve the regular Board minutes of April 18, 2000 as submitted. Motion by Clausen second by Walish to amend the motion by amending the minutes by striking April 1, 2000 and insert May 1, 2000 in the seventh motion. Carried 5-0. The main motion as amended Carried 5-0.

Motion by Welte second by Batcheller to amend the twenty-third motion of April 11, 2000 Board Meeting to include the 155th Street and Buchanan Avenue paving project in FY 02/03. Carried 4-1, Clausen opposed.

The Board approved the appointment of Michael J. Weber, P/T Operations Officer, Disaster Services, @$12.46/hr., effective 5-1-00. Per Wage Plan, from Part-time to Full-time Appointment. Copy filed.

The Board approved the reclassification of Wendy N. Sassman, Correctional Officer, County Sheriff, @$12.83/hr., effective 5-1-00. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of Ryan T. Denney, Correctional Officer, County Sheriff,
@$12.36/hr., effective 5-1-00. Per DSA Contract agreement, from Class 5 to Class 4. Copy filed.

The Board approved the end of probation of Rosalie A. Ellefson, Safety/Training Officer, Human Resources, @29,870/yr., effective 5-1-00. Per End of Probation Salary Increase. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Part-time Operations Officer, Disaster Services, @ $10.31/hr. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to approve Workers Compensation self-insurance license with the State of Iowa. Carried 5-0. Copy filed.

Motion by Clausen second by Walish to receive for signatures and approve Sheriffs Civil Division Third Quarter and Year to Date Report. Carried 5-0. Copy filed.

Motion by Welte second by Clausen to receive for signatures and approve Auditors Third Quarter Report. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to receive and approve Auditor/Recorders Third Quarter Report. Carried 5-0. Copy filed.

Motion by Clausen second by Welte to authorize Chairman to sign amendment/short form contract with DMG-Maximus, Inc. for consultant services. Carried 5-0. Copy filed.

Motion by Welte second by Clausen to authorize Chairman to sign Resolution No. 9284 adopting and levying special assessment in the Little Sioux Inter-County Drainage District. Carried 5-0.

RESOLUTION NO. 9284

RESOLUTION ADOPTING AND LEVYING SPECIAL ASSESSMENT
IN THE LITTLE SIOUX INTER-COUNTY DRAINAGE DISTRICT

WHEREAS, the Board of Trustees of the Little Sioux Inter-County Drainage District, in session on the 5th day of April, 2000, requested that the Board of Supervisors levy a special assessment of Forty-three (43%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona, Woodbury and Harrison Counties, Iowa, acting as a Drainage Board for the Little Sioux Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the Little Sioux Inter-County Drainage District of Monona, Woodbury and Harrison Counties, Iowa, a special assessment in the amount of Forty-three (43%) Percent of the Original Assessment, and the Auditors of Monona, Woodbury and Harrison Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2000-2001.

RESOLUTION ADOPTING AND LEVYING SPECIAL ASSESSMENT
IN THE MCCANDLESS INTERCOUNTY DRAINAGE DISTRICT

WHEREAS, the Board of Trustees of the McCandless Inter-County Drainage District, in session on the 15th day of March, 2000, requested that the Board of Supervisors levy a special assessment of Seventy-Five percent (75%) of the Original Assessment on all tracts of land, lots, public roads, and railroads in the McCandless Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona and Woodbury Counties, Iowa, acting as a Drainage Board for the McCandless Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the McCandless Inter-County Drainage District of Monona and Woodbury Counties, Iowa, a special assessment in the amount of Seventy-Five percent (75%) of the Original Assessment, and the Auditors of Monona and Woodbury Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2000-2001.

WHEREAS, the Board of Trustees of the Sandhill-Lakeport Inter-County Drainage District, in session on the 13th day of March, 2000, requested that the Board of Supervisors levy a special assessment of Twenty-One (21%) Percent of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Sandhill-Lakeport Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

IN THE WOODBURY-MONONA INTERCOUNTY DRAINAGE DISTRICT

WHEREAS, the Board of Trustees of the Woodbury-Monona Inter-County Drainage District, in session on the 12th day of April, 2000, requested that the Board of Supervisors levy a special assessment of Fifty percent (50%) of the Original Assessment on all tracts of land, lots, public roads, and railroads in the Woodbury-Monona Inter-County Drainage District to procure funds from which to pay the costs and expenses of repair and maintenance incurred.

NOW, THEREFORE, BE IT RESOLVED by the Joint Board of Supervisors of Monona and Woodbury Counties, Iowa, acting as a Drainage Board for the Woodbury-Monona Inter-County Drainage District, that there be and is hereby levied upon all tracts of land, lots, public roads, and railroads in the Woodbury-Monona Inter-County Drainage District of Monona and Woodbury Counties, Iowa, a special assessment in the amount of Fifty percent (50%) of the Original Assessment, and the Auditors of Monona and Woodbury Counties, Iowa, be directed and ordered to spread such levy upon said lands, to be collected under 468.55 in semi-annual installments in the same manner as general property taxes are collected pursuant to 445.36 in the year 2000-2001.

Motion by Welte second by Walish to set a public hearing on May 16, 2000 at 10:30 a.m. for Budget Amendment # 2 for FY 1999-2000. Carried 5-0. Copy filed.

The Board discussed consideration of a request from the City of Danbury to abate taxes on Parcel #604155.

Motion by Welte second by Walish to approve and authorize the chairman to sign Resolution No. 9288 to abate taxes on Parcel #604155 for the City of Danbury. Carried 5-0.

WOODBURY COUNTY, IOWA

RESOLUTION # 9288

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the City of Danbury is the titleholder of real estate Parcel #604155, located in, the
City of Danbury and legally described as follows:

Parcel #604155

Lot One (1) Block Seven (7), in the Town of Danbury, Woodbury County, Iowa

WHEREAS, the above-stated property has taxes owing for March 31, 2000, and the parcel is owned by a political subdivision of the state; and

WHEREAS, the political subdivision, namely the City of Danbury, Iowa is failing to immediately
pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors
hereby abates the taxes owing on the above parcel according to Code of Iowa, 445.63, and
hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the
tax records.

SO RESOLVED this 25th day of April, 2000.

The Board discussed hosting a hot dog luncheon for county employees.

The consensus was to hold the hot dog luncheon June 27, 2000.

Bid letting was held at 10:20 a.m. for a front-end loader.

The Board discussed initiating the budget process for FY 2001-2002 with a facilitator.

The consensus was to have the budget process placed on the agenda after lunch next week for one hour.

Motion by Batcheller second by Clausen to authorize Chairman to sign a letter approving Woodbury County Solid Waste Agency (Sanitary Landfill) as designee for Waste Tire Management County Grant Program Application. Carried 5-0. Copy filed.

Motion by Welte second by Clausen to authorize Chairman to sign releases and settlement agreements of the Wellmark, Blue Cross and Blue Shield of Iowa litigation. Carried 5-0. Copy filed.

The Board discussed consideration of proposed county ordinances.

Motion by Batcheller second by Welte to recess until 1:00 p.m. Carried 5-0.

The Board reconvened at 1:00 p.m.

The Board discussed Comprehensive Planning and updating the Zoning Ordinance with Zoning Commission members.

The Board adjourned the regular meeting until May 4, 2000.
