JUNE 6, 2000 FORTY-SIXTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, June 6, 2000 at 9:00 A.M. Board members present were Clausen, Batcheller, Walish and Welte, Boykin was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Welte second by Walish to appoint Larry Clausen Chairman Pro Tem for this meeting. Carried
4-0.

Motion by Batcheller second by Welte to approve the regular Board Minutes of May 30, 2000 as submitted. Carried 4-0.

Motion by Welte second by Batcheller to approve the Board Minutes of the executive session held May 30, 2000 as submitted. Carried 4-0.

The Board approved the appointment of Jay C. Menke, Temporary M.V. Clerk II, County Treasurer, @$9.07/hr., effective 6-7-00. Not to exceed 120 days. Copy filed.

The Board approved the resignation of Brian D. Van Berkum, Correctional Officer, County Sheriff, effective 6-7-00. Copy filed.

The Board approved the appointment of Jeremy J. Cross, Temporary Summer Laborer, Secondary Roads, @$7.25/hr., effective 6-7-00. Not to exceed 120 days. Copy filed.

Motion by Welte second by Walish to approve and authorize the Chairman Pro Tem to sign the authorization to initiate hiring process for (1) Male or Female Correctional Officer, County Sheriff, DSA Contract: $11.50/hour; and for a Part-time Operations Officer, Disaster Services, Wage Plan: $10.01/hour. Carried

Motion by Welte second by Walish to approve and authorize the Chairman Pro Tem to sign Resolution No. 9297 setting a public hearing for sale of a 1977 Deerfield mobile home. Carried 4-0.

NOTICE OF MOBILE HOME SALE

WHEREAS Woodbury County, Iowa is the owner under a tax title of a certain mobile home described as follows:
A 1977 Deerfield Mobile Home
VIN #RII070166, 952.0 square feet,
last located at 4101 Gordon Drive, Lot #215,
City of Sioux City, Woodbury County, Iowa

WHEREAS, it is the desire of the Board of Supervisors of Woodbury County to place the aforesaid mobile home back on the tax rolls, and

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall
be held on the 20th day of June, 2000 at 10:15
o'clock a.m. in the meeting room of the Board of
Supervisors on the first floor of the Woodbury County
Courthouse.

2. That said Board proposes to sell the said mobile home
at a public auction to be held on the 20th day of June,
2000, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said mobile home to the highest bidder at or above a total minimum bid of $658.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of
Mobile Home Sale' and except for this subparagraph 4, be
be published as notice of the aforesaid proposal, hearing and
sale.

The request for a Utility Accommodation Permit submitted by Heartland Construction, Correctionville, IA was withdrawn and there was no action taken.

There was no action taken to authorize Secondary Roads Department to negotiate with Rohlin Construction Co. for maintenance asphalt overlay of three sections of road pending further research by the Secondary Roads Department.

The Board reviewed a draft of proposed Dust Control Policy. Grady Marx of 212 North Fairmont commented on the proposed policy.

The Board received a report from Richard Storm, County Engineer, on proposed maintenance shed improvements.

Motion by Welte second by Batcheller to adjourn the regular meeting to convene the Orton Slough Drainage District Meeting. Carried 4-0.

Motion by Batcheller second by Walish to adopt a resolution scheduling a public hearing for clean outs and improvements in the district. Carried 4-0.

RESOLUTION NO. 9298
IN THE ORTON SLOUGH DRAINAGE DISTRICT
RESOLUTION TO RECEIVE PETITION TO CLEANOUT
EAST ROAD DITCH ADJOINING BARKER AVENUE
(LIBERTY TOWNSHIP) AND TO FIX AND
DIRECT NOTICE OF HEARING ON PETITION

WHEREAS, John T. Hall has petitioned the Woodbury County Board of Supervisors for authority to excavate and cleanout the east road ditch of Barker Avenue, Section 16, Liberty Township, Woodbury County, Iowa, deepening the existing road ditch for a distance of approximately 3000 feet from 1 foot to 4 feet, deepening the said road ditch from the field side of the road ditch, to expedite the drainage of surface water into the drainway of the Orton Slough Drainage District, to be completed under the Direction of the Woodbury County Engineer at the cost of the Hall Family Partnership; and
WHEREAS, the intended purpose is to expedite the flow of surface water entering the east road ditch of Barker Avenue, located in Section 16, Liberty Township, Woodbury County, Iowa, and included within the Orton Slough Drainage District under the jurisdiction of the Woodbury County Board of Supervisors, as Trustees; and
WHEREAS, the drained surface water may accumulate in the drainage ditch of the Orton Slough Drainage District, increasing the level of drainage waters in the Orton Slough drainage ditch.
NOW THERFORE, the letter Petition of John T. Hall for the Hall Family Partnership is to be placed on file in the office of the Auditor for Woodbury County, Iowa, and hearing on said Petition is fixed for July 18th, 2000 at 10:30 oclock a.m. (DST) at the Board Room, Woodbury County Courthouse, and said Auditor is directed to cause notice to be given to the owner of each tract of land or lot within the Orton Slough Drainage Ditch as shown by the transfer books of the Auditors office, including railway companies having right of way in the said Orton Slough Drainage District and to all lien holders or encumbrancers of any land within the said Orton Slough Drainage District without naming them, and also to all other persons whom it may concerns, and without naming individuals all actual occupants of the land in the Orton Slough Drainage District of the pendency of the Petition, and including with the mailed notices a copy of the letter Petition of the Hall Family Partnership.
IN ADDITION, the Woodbury County Auditor shall cause the notice of hearing to be published in the Sioux City Journal noting that the Petition of the Hall Family Partnership is on file in the Auditors office, said publication to be made at least 20 days before the hearing date.

Motion by Batcheller second by Walish to adjourn the Orton Slough Drainage District meeting. Carried 4-0.

The Board reconvened the regular meeting.

Bid letting for sale of structures in Holly Springs was held at 10:30 A.M.

There were no bids submitted.

The Board held a discussion on the Comprehensive Plan Zoning Ordinance with JEO & Associates and SIMPCO.

Motion by Batcheller second by Welte to authorize the chairman to sign an agreement with JEO Consulting Group, Inc. for services relating to a comprehensive development plan and department regulations for $37,500.00. Carried 4-0.

Motion by Walish second by Batcheller to authorize the chairman to sign a Cooperative Agreement with the Loess Hills Alliance to provide a $10,000.00 grant to fund a portion of the Countys Comprehensive Development Plan. Carried 3-0. Welte abstained.

The Board adjourned the regular meeting until June 13, 2000.
