MARCH 20, 2001THIRTY-SIXTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, March 20, 2001 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller and Walish. Welte was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Victoria Ritz, Deputy Commissioner of Elections, announced the canvass results of the City of Sloan Special Election held on March 13, 2001. There were no special challenged ballots and no after election absentee ballots added to the tally. There were 183 votes cast for the office of Council Member in the City of Sloan and the results were as follows:

Rob Copple received Fifty (50) votes
Dick V. Jelken received Thirty-Eight (38) votes
Larry Johnson received Twenty-Seven (27) votes
Kirk Douglas Wiggs received Sixty-Five (65) votes
Scattered Write-ins received Three (3) votes.

We therefore declare Kirk Douglas Wiggs duly elected to the office of Council Member, City of Sloan, for the residue of the term ending December 31, 2003.

Motion by Clausen second by Batcheller to accept the Official Canvass results of the City of Sloan Special Election held on March 13, 2001 as presented. Carried 4-0.

Meeting called to order.

Motion by Clausen second by Walish to approve the Board minutes of March 13, 2001 as submitted. Carried 3-0, Batcheller abstained.

Motion by Clausen second by Walish to approve the minutes of the Executive Session of March 13, 2001, as submitted. Carried 3-0, Batcheller abstained.

The Board approved the reclassification of Lisa M. Wilson, Secretary, Social Services, @$12.41/hr., effective 10-19-00. Wage Plan comparability with AFSCME Cthouse. Contract, from Grade 6, Step 2 to Grade 6, Step 3. Retro Pay due: $449.28. Copy filed.

The Board approved the separation of Anthony A. Pierce, Correctional Officer, County Sheriff, effective 3-8-01. Resignation. Copy filed.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Male Correctional Officer, County Sheriff, DSA Entry: $11.90/hr.; and for a Lead Custodian, Building Services, AFSCME Cthouse./Grade 2 Range: $8.36-$11.16/hr. Carried 4-0. Copy filed.

The Board discussed sale of real estate Parcels #228600 and #228585.

Motion by Clausen second by Walish to approve and authorize the Chairman to sign Resolution No. 9476 setting the sale of real estate Parcels #228600 and #228585 for April 3, 2001 at 10:15 A.M. Carried 4-0.

NOTICE OF PROPERTY SALE

Parcels #228600 and #228585

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

2640 Highland Park Edition; Lots 9-12 BLK 8; and Lot 8, BLK 8 (a.k.a. 1705 Wabash Street and 1707 Wabash Street, Sioux City, Iowa)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on
the 3rd Day of April, at 10:15 o'clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 3rd Day of April, 2001, immediately
following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $ 1,114.00 plus recording
fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

WOODBURY COUNTY BOARD OF SUPERVISORS

The Board reviewed a farm lease to be signed on behalf of Woodbury County.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign Farm Lease between Kevin Schmidt and Woodbury County with changes recommended by Assistant County Attorney John Rusch. Carried 4-0. Copy filed.

Motion by Batcheller second by Walish to authorize the Chairman to sign an agreement with the Iowa Department of Transportation concerning replacement of two bridges on Iowa 982 near Holly Springs per recommendation of the county engineer. Carried 4-0. Copy filed.

The Board received a report from Richard Storm, Woodbury County Engineer, on budget impact of winter operations.

The County Engineer will bring the five-year plan to the Board in the near future.

John Malloy, Director Information Technology, WCICC, and Jason Kolda of WCICC gave a presentation of the County IntraNet.

The Board heard an update of telecommunication options from John Malloy, WCICC, and John Rusch, Assistant County Attorney.

Motion by Clausen second by Walish to pursue the recommendation to update the Countys telecommunication system. Carried 4-0. Copy filed.

Dennis Butler, County Auditors Office, discussed implementation of Tax Billing software training with the Board.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Jeff Harcum, LEC Planner, presented a grant application requesting authorization for the Chairman to sign from the Iowa Department of Public Health for the D.A.R.E. Program.

Motion by Clausen second by Walish to approve and authorize the Chairman to sign the Grant Application for the D.A.R.E. Program. Carried 3-1, Batcheller opposed. Copy filed.

Darlene Schultz, 2221 Allison Avenue, Sergreant Bluff, informed the Board about a drainage problem at her property.

Eugene Willems, 3773 180th Street, Correctionville, addressed the Board about a weed control problem at his property.

Motion by Batcheller second by Clausen to go into Executive Session #1 per Iowa Code Section 21.5(1)(c). Carried 4-0 on roll call vote.

Motion by Walish second by Clausen to go out of Executive Session #1. Carried 4-0 on roll call vote.

Motion by Batcheller second by Walish to approve the recommendation by the attorney representing the County on a claim brought by Jansen. Carried 4-0.

Motion by Clausen second by Walish to go into Executive Session #2 per Iowa Code Section 21.5(1)(c). Carried 4-0 on roll call vote.

Motion by Batcheller second by Walish to go out of Executive Session #2. Carried 4-0 on roll call vote.

Motion by Clausen second by Batcheller to go into Executive Session #3 per Iowa Code Section 20.17(3). Carried 4-0 on roll call vote.

Motion by Walish second by Clausen to go out of Executive Session #3. Carried 4-0 on roll call vote.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign the collective bargaining agreements with the Communication Workers of America (Secondary Roads); American Federation of State, County and Municipal Employees, Council 61 (Juvenile Detention Center); American Federation of State, County and Municipal Employees, Council 61 (Courthouse Employees); Woodbury County, Iowa Deputy Sheriffs Association; and the American Federation of State, County and Municipal Employees, Council 61 (Assistant County Attorneys and Investigator). Carried 4-0.

Motion by Walish second by Boykin to approve the recommendation from Human Resources for the wage plan employees. Carried 3-1, Clausen opposed.

The Board adjourned the regular meeting until March 27, 2001.
