APRIL 24, 2001FORTY-FIRST MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, April 24, 2001 at 9:00 A.M. Board members present were Boykin, Clausen, Batcheller, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Diane Swoboda Peterson, Deputy Recorder, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Welte second by Walish to approve the Board minutes of April 17, 2001 as submitted. Carried 5-0.

The Board approved the promotion of Eric J. Stolpe, Lead Custodian, Building Services Dept., @$11.16/hr., effective 4-23-01. Per AFSCME Cthouse. Contract agreement, from Grade 1, Step 6 to Grade 2, Step 6. Copy filed.

The Board approved the separation of Marcia L. Ronfeldt, Motor Vehicle Clerk II, County Treasurers Dept., effective 5-4-01. Resignation. Copy filed.

The Board approved the reclassification of Christopher A. Persinger, Deputy Sheriff, County Sheriffs Dept., @$16.93/hr., effective 5-14-01. Per DSA Contract agreement, from Class 3 to Class 2. Copy filed.

Motion by Welte second by Batcheller to approve and authorize the Chairman to sign the authorization to initiate hiring process for a M.V. Clerk II, County Treasurer. AFSCME Cthouse., Grade 4.5/Step 1: $9.39/hour. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to authorize the Chairman to sign a Utility Accommodation Permit submitted by Hunt Family Farms, Inc., Sloan, Iowa, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Welte second by Clausen to receive the County Recorders Report of Fees Collected for the period of 1/1/01 through 3/31/01. Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to table the discussion regarding the transfer of funds. Carried 5-0. Copy filed.

Motion by Batcheller second by Welte to authorize the Chairman to sign agreement with SIMPCO for Holly Springs 404 Hazard Mitigation Grant Program Project. Carried 5-0. Copy filed.

Motion by Walish second by Welte to authorize the Chairman to sign the amendment with SIMPCO for Holly Springs 404 Hazard Mitigation Grant Program Project. Carried 5-0. Copy filed.

The Board discussed lease of land to Frances Kirsch for the purpose of farming. Frances Kirsch addressed the Board.

Motion taken under advisement until next week.

The Public Hearing and sale of Real Estate Parcel #650790, 121 Main Street, Smithland, IA, was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Clausen second by Batcheller to close the Public Hearing on the sale of Real Estate Parcel #650790 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #650790. Helen Peterson and Les Bayne came forward to bid on the property. Helen Peterson started the bid at $1,500.00 and ended at $20,000.00 including recording fees. There were no further bids.

Motion by Clausen second by Walish to accept Helen Petersons bid of $20,000.00 including recording fees for Real Estate Parcel #650790. Carried 5-0.

RESOLUTION OF THE BOARD OF SUPERVISORS
OF WOODBURY COUNTY, IOWA:
RESOLUTION # 9487

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Helen A. Peterson, 212 Main Street, Smithland, Iowa in the sum of $ 20,000 (Twenty-Thousand

Dollars) for the following described real estate, To Wit:

LOTS ONE (1), TWO (2), AND THREE (3), BLOCK TEN (10), CITY OF SMITHLAND, IOWA

Now and included in and forming a part of the City of Sioux City , Iowa, the same is hereby accepted: said

Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

Motion by Batcheller second by Walish to approve Change Order #1 for alterations to Department of Motor Vehicles at Trosper Hoyt County Services Building. Carried 5-0. Copy filed.

The Board heard a presentation from Woodbury County Assessor, Kathy Sands, on Woodbury County GIS Web Site.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Pat Benjamin of 29 Deer Run Trail has a concern for safety of building on property next to his; that parcel was sold on a tax sale to Gene Sherman who sold it to Alan Mercuriali but no one has been around the property in over a year; not safe and children in the area. John Rusch will have the Sheriff review the situation as a public safety issue.

Motion by Welte second by Batcheller to adjourn the regular meeting until May 1, 2001. Carried 5-0.
