MAY 7, 2002FORTY-THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, May 7, 2002 at 9:00 A.M. Board members present were Batcheller, Boykin and Clausen; Walish and Welte were absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Rusch, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Boykin to approve the Board minutes of April 30, 2002 as submitted. Carried 3-0.

The Board approved the appointment of Charles W. Dose, P/T Temporary Roadside Driver, Secondary Roads Dept., @$8.00/hour, effective 5-8-02. Job Vacancy Posted: 4-04-02. Salary Range: $7.50-$8.50/hour, based on previous County experience. Copy filed.

The Board approved the reclassification of Korey C. VonderLieth, Senior Correctional Officer, County Sheriff Dept., @$15.68/hour, effective 6-08-02. Per DSA Contract agreement, from Class 3 to Senior Class (4 yrs. Employ + BS Degree). Copy filed.

Motion by Boykin second by Batcheller to approve request for proposals for a) real estate property and contents coverage, b) faithful performance coverage, and 3) boiler and machinery insurance coverage. Carried 3-0. Copy filed.

Motion by Boykin second by Batcheller to set the Public Hearing and Sale of Real Estate Parcel #051391 on May 21, 2002, at 10:15 a.m. Carried 3-0.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Vacated West 20th Street Lying Between Lot Three (3) in Block One (1) of the North Sioux City addition, Lot One (1) in block Seven (7) of the Franklins Addition and Lot One (1) in Block Eleven (11) of the Gillman Terrace Addition, North Sioux City Addition, City of Sioux City, Woodbury County, Iowa.

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on
the 21st Day of May, 2002, at 10:15 o'clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 21st Day of May, 2002, immediately
following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $ 558.00 plus recording
fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

The Board presented the Certificate of Appreciation to Secondary Roads Department employee Don Smith.

Motion by Batcheller second by Boykin to approve Application to Adopt-A-Highway submitted by Pierson Blue Ribbon 4-H Club, per recommendation of the county engineer. Carried 3-0. Copy filed.

Motion by Boykin second by Batcheller to approve Supplemental Secondary Road Construction Program for FY 2001-02. Carried 3-0. Copy filed.

Motion by Batcheller second by Boykin to approve and receive for signatures Resolution No. 9565 for temporary closure of roads during 2002 construction season. Carried 3-0.

RESOLUTION NO. 9565

BE IT RESOLVED, by the Woodbury County Board of Supervisors, duly assembled, pursuant to Section 306.41 of the Code of Iowa, 2001, as amended, that the following highways or sections of highways described and shown on Exhibits A and B respectively, attached hereto and by this reference made a part hereof, will become temporarily closed for a period not exceeding one hundred sixty (160) days for construction, re-construction, and/or maintenance and thereupon the County Engineer is directed to cause signs and partial or total barricades to be erected in the roadway at each end of said described highway or section of highway, and on said highway where intersected by other highways, reading Road Closed. Said described highways shall become closed effective upon erection of signs and barricades, and shall remain closed until said signs and barricades are removed.

The Board discussed purchase of the Eagles Club Building.

Motion by Batcheller second by Boykin to approve the purchase of the Eagles Club Building. Carried 3-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Doug Phillips, legal counsel to the Board, discussed the jail food contract with Board.

Jack Jolin, 2416 Allison Ave., discussed property he bought from the county and the condition of secondary roads he uses.

Motion by Boykin second by Batcheller to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 3-0 on roll call vote.

Motion by Batcheller second by Boykin to go out of Executive Session. Carried 3-0 on roll call vote.

The Board adjourned the regular meeting until May 14, 2002.
