NOVEMBER 5, 2002NINETEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, November 5, 2002 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Sonya Pierce, Executive Secretary, Diane Swoboda Peterson, Deputy/Clerk to the Board, and John Sullivan, Board Legal Counsel.

1. The Claims were approved as presented. Copy filed.

2. Meeting called to order.

Motion by Walish second by Boykin to approve the Board minutes of October 29, 2002 as submitted. Carried 5-0.

3a. Motion by Welte second by Boykin to approve and authorize the Chairman to sign Resolution No. 9599 approving abatement of taxes for Parcel #696105 and Parcel #696120. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the Woodbury County Conservation is the titleholder of real estate Parcels #696105 and #696120 located in Woodbury County, Iowa and legally described as follows:

Parcel: #696105
2.41 ACRES IN SE NE 11-86-46 all in Sloan Township.

Parcel: #696120
E OF RR 8.46 ACRES IN SE NE 11-86-46 all in Sloan Township.

WHEREAS, the above-stated property has taxes owing for September 1, 2002 and the parcels are owned by Woodbury County Conservation, and

WHEREAS, the organization, namely the Woodbury County Conservation is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against the parcels; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors herby abates the taxes owing on the above parcel according to the Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

SO RESOLVED this 5th day of November, 2002.

4. Motion by Batcheller second by Welte to receive the Sheriffs Civil Division First Quarter and Year to Date report for the first quarter ending September 30, 2002. Carried 5-0. Copy filed.

5a. Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign final plats for Page Subdivision submitted by Mr. and Mrs. Jeff Page, per recommendation of the Zoning Commission. Carried 5-0.

RESOLUTION ACCEPTING AND APPROVING THE FINAL PLAT OF PAGE SUBDIVISION, WOODBURY COUNTY, IOWA

WHEREAS, THE OWNERS & PROPRIETORS DID ON THE 23RD DAY OF SEPTEMBER, 2002, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION, A CERTAIN PLAT DESIGNATED AS THE FINAL PLAT OF PAGE SUBDIVISION, WOODBURY COUNTY, IOWA; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCE OF WOODBURY COUNTY, IOWA, WITH PREFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

WHEREAS, THE COUNTY ENGINEER OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT.

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED BY THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, THAT THE FINAL PLAT OF PAGE SUBDIVISION, WOODBURY COUNTY, IOWA, BE, AND THE SAME IS HEREBY ACCEPTED AND APPROVED, AND THE CHAIRMAN AND SECETARY OF THE WOODBURY COUNTY BOARD OF SUPERVISORS, WOODBURY COUNTY, STATE OF IOWA, ARE HEREBY DIRECTED TO FURNISH TO THE OWNER AND PROPRIETORS A CERTIFIED COPY OF THIS RESOLUTION AS REQUIRED BY LAW.

RESOLUTION ACCEPTING AND APPROVING DUNN ESTATES, WOODBURY COUNTY, IOWA.

WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 28 DAY OF OCTOBER, 2002, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS DUNN ESTATES, WOODBURY COUNTY, IOWA; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE SATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

The Board approved the reclassification of Bradley J. Uhl, Correctional Officer, County Sheriff Dept., @$14.22/hour, effective 11-12-02. Per DSA Contract agreement, from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of Gregory J. Stallman, Deputy Sheriff, County Sheriff Dept., @$19.56/hour, effective 11-15-02. Per DSA Contract agreement, from Class 2 to Class 1. Copy filed.

6b. Motion by Welte second by Walish to approve and authorize the Chairman to sign the authorization to initiate hiring process for a Custodian, Building Services Dept. Entry Level: AFSCME Cthouse./Grade 1: $9.30/hour. Carried 5-0. Copy filed.

6c. The Board discussed with J.D. Pellersels, Human Resources Department, Woodbury County employees who operate a county vehicle or a privately owned vehicle in the performance of their job.
The Board asked J.D. Pellersels to review the citys policy and begin drafting a policy for the county.

7a. Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign an Agreement for Professional ServicesSteam Locomotive Restoration, Project No. STP-E-CO97(40)8V-97, per recommendation of the county engineer. Carried 5-0. Copy filed.

7b. Motion by Boykin second by Walish to approve and authorize the Chairman to sign proposal from Calhoun-Burns & Associates, Inc., for Woodbury County Bridge Inspection and Rating Program for 2003, per recommendation of the county engineer. Carried 5-0. Copy filed.

7c. Motion by Boykin second by Walish to approve and authorize the Chairman to sign Utility Accommodation Permit submitted by Qwest to install underground telephone line along a section of Christy Road, per recommendation of the county engineer. Carried 5-0. Copy filed.

7d. Motion by Walish second by Boykin to approve and authorize the Chairman to sign Agreement for professional services with HGM & Associates, Omaha, NE for Bridge Replacement Projects BROS-CO97(58)5F-97 and BROS-CO97(61)5F-97, per recommendation of the county engineer. Carried 5-0. Copy filed.

7e. Motion by Walish second by Boykin to approve and authorize the Chairman to sign Certificate of Completion for Project G-2002, Maintenance Gravel Contract completed by Hallett Materials, Lake View, Iowa. Carried Copy filed.

7f. Motion by Batcheller second by Walish to receive annual report from Weed Commissioner dated 10-21-02. Carried 5-0. Copy filed.

8. The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Rick Schneider reminded the Board of the meeting on this Thursday at 4:00 p.m.

Larry Countryman, Ryan Ross, and Janeese Martin of Tax Research Conference asked the Board not to spend $250,000 of taxpayers money for an architect to evaluate the need for a new jail; suggested they spend $50,000 to hire expeditor to make sure people get to trial sooner like Scott County did; would like to suggest to use work release, electronic release to help eliminate overcrowding; suggested looking for alternative solutions; consultant working with current architect gave a report to Sheriff/ Board which didnt address any alternative solutions. Each Board member responded.

The Board recessed for lunch

9. The Board reconvened the meeting for a progress meeting/jobsite walk through of Siouxland District Health Department.

The Board adjourned the regular meeting until November 12, 2002.
