JUNE 17, 2003 FIFTIETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, June 17, 2003 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Victoria L. Ritz, Deputy/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Welte to approve the Board minutes of June 10, 2003 as submitted. Carried 4-0. Boykin abstained.

Motion by Batcheller second by Clausen to approve the minutes of the first Executive Session of May 27, 2003 as submitted. Carried 5-0.

Motion by Clausen second by Boykin to approve the minutes of the second Executive Session of May 27, 2003 as submitted. Carried 5-0.

Motion by Clausen second by Boykin to approve the minutes of the first Executive Session of June 3, 2003 as submitted. Carried 5-0.

Motion by Clausen second by Boykin to approve the minutes of the second Executive Session of June 3, 2003 as submitted. Carried 5-0.

Motion by Batcheller second by Boykin to approve the minutes of the third Executive Session of June 3, 2003 as submitted. Carried 5-0.

Motion by Clausen second by Boykin to approve the minutes of the fourth Executive Session of June 3, 2003 as submitted. Carried 5-0.

Motion by Batcheller second by Clausen to approve the minutes of the first Executive Session of June 10, 2003 as submitted. Carried 4-0. Boykin abstained.

Motion by Clausen second by Batcheller to approve the minutes of the second Executive Session of June 10, 2003 as submitted. Carried 4-0. Boykin abstained.

The Board approved the reclassification of Lynn dell Spink, Tax Clerk II, County Treasurer Dept., @$13.15/hour, effective 6-29-03. Per AFSCME Cthouse. Contract agreement, from Grade 3, Step 4 to Grade 3, Step 5. Copy filed.

The Board approved the separation of John J. Sullivan, Assistant County Attorney - Civil, County Attorney Dept., effective 7-01-03. Resignation. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign the authorization to initiate hiring process for an Assistant County Attorney - Civil, County Attorney Dept. AFSCME Attys.: Range: $39,700-$45,912/yr. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to approve lifting a tax suspension for E.S.C. Carried 5-0. Copy filed.

The Board discussed re-appointment to the Commission of Veteran Affairs.

Motion by Welte second by Boykin to approve the re-appointment of Ronald Kerr to the Commission of Veteran Affairs. Motion was withdrawn and replaced by the following motion.

Motion by Boykin second by Batcheller to table the re-appointment for one week to check on residency requirement as Mr. Kerr moved to Plymouth County. Carried 5-0.

Motion by Clausen second by Boykin to set the Public Hearing and Sale of Real Estate Parcel #435915 on the 1st day of July, 2003 at 10:15 a.m. Carried 5-0.

NOTICE OF PROPERTY SALE

Parcel #435915

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Riverview 2nd Addition, City of Sioux City, Woodbury County
Lot 8 Block 5
(1829 W 1st St, Sioux City IA 51101)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on
the 1st Day of July, 2003 at 10:15 o'clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 1st Day of July, 2003, immediately
following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $ 1,048.00 plus recording
fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

Motion by Welte second by Batcheller to authorize the Chairman to sign Final Progress Voucher for STP-S-CO97(49)5E-97. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to authorize the Chairman to sign Certificate of Completion for Project L-79273-97. Carried 5-0. Copy filed.

The Board discussed funding considerations for Route K-35 Project with Dick Storm, County Engineer.

Alex Shumansky and Clint Jiroux reported to the Board that the residents are willing to contribute one-third of the cost regarding improvements to DeRocher Path. Consensus was to defer for two weeks so Dick Storm can research the project further.

Bid letting was held at 10:20 a.m. for a 2003 diesel powered front end loader.

The Board discussed preliminary plats for Reinholdts Subdivision.

Motion by Boykin second by Batcheller to approve preliminary plats for Reinholdts Subdivision. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to refer preliminary plats for Dickson Addition Subdivision to the Zoning Commission for recommendations. Carried 5-0. Copy filed.

Motion by Welte second by Boykin to refer preliminary plats for Fox View Addition Subdivision to the Zoning Commission for recommendations. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to refer preliminary plats for Russell Addition Subdivsion to the Zoning Commission for recommendations. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Walish reported that the air-conditioner went out at Prairie Hills. Consensus was to fix the unit.

Motion by Boykin second by Clausen to go into Executive Session per Iowa Code Section 21.5(i). Carried 5-0 on roll call vote.

Motion by Batcheller second by Clausen to go out of Executive Session. Carried 5-0 on roll call vote.

The Board adjourned the regular meeting until June 24, 2003.
