AUGUST 12, 2003 - SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 12, 2003 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

The Board canvassed the August 5, 2003 City of Sioux City Special Election at 9:00 AM with the following official results:

Patrick F. Gill, Commissioner of Elections, announced there were fourteen (14) challenged ballots, of which four (4) were accepted and added to the Tally, and two (2) after-election absentee ballots which were received timely and added to the Tally.

For the special proposition, upon the public measure Question A:

Shall the City of Sioux City, Iowa, adopt the Commission Form of City Government?

There were Eleven thousand, six hundred and eighty-three (11,683) ballots cast as follows:

For the question there were Three thousand, seven hundred and ninety-eight (3,798) votes cast.

Against the question there were Seven thousand, eight hundred and seventy-six (7,876) votes cast.

We therefore declare the public measure not to be adopted.

Motion by Boykin second by Clausen to accept the official canvass of the August 5, 2003 City of Sioux City Special Election. Carried 5-0. Copy filed.

Meeting called to order.

Motion by Boykin second by Batcheller to amend the agenda to postpone indefinitely action on a county
litter ordinance. Carried 5-0.

Motion by Clausen second by Boykin to approve the minutes of the August 5, 2003 Board meeting. Carried 4-0, Welte abstained.

The Board approved the end of leave of absence of Fern J. Marrinan, M.V. Clerk II, County Treasurer

The Board approved the separation of Casey J. Hancock, Temporary Summer Laborer, Secondary Roads Dept., effective 8-06-03. End of Temporary Employment. Copy filed.

The Board approved the reclassification of David A. Dawson, Assistant County Attorney, County Attorney Dept., @$45,912/year., effective 8-19-03. Per AFSCME Assistant County Attorney Contract, from Step 3 to Step 4. Copy filed.

The Board approved the reclassification of Kent W. Roepke, Deputy Sheriff, County Sheriff Dept., @$20.24/hour, effective 8-21-03. Per DSA Contract agreement, from Class 2 to Class 1. Copy filed.

The Board approved the reclassification of Todd A. Trobaugh, Deputy Sheriff, County Sheriff Dept., @$20.24/hour, effective 8-21-03. Per DSA Contract agreement, from Class 2 to Class 1. Copy filed.

The Board approved the reinstatement of Nathan M. Sands, Correctional Officer, County Sheriff Dept., @$14.72/hour, effective 8-20-03. Due to End of Military Leave of Absence. Copy filed.

Motion by Welte second by Batcheller to authorize the Chairman to sign the request to deauthorize a
position in juvenile detention, a part-time interim male youth worker. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to receive the Commission of Veteran Affairs Quarterly Report for
the quarter ending June 30, 2003. Carried 5-0. Copy filed.

Motion by Batcheller second by Welte to receive the quotes for full depth concrete patching on County
Route K-35 and accept the quote of Ten Point Construction Co., Denison, Iowa, per recommendation of
the county engineer. Carried 5-0. Copy filed.

There was discussion of a request to rent Crisafulli pump and operator at $50/hour to Lieber Construction
Co., Lawton, Iowa. The consensus was not to approve the request.

Motion by Clausen second by Batcheller to receive the final plats submitted by Randall Rogers for Fox
View Second Addition Subdivision and refer to the zoning commission for review and recommendation.

Motion by Welte second by Boykin to receive the final plats submitted by Roger L. and Ida M. Millgan
for Hilltop View Addition Subdivision and refer to the zoning commission for review and
recommendation. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to receive the final plats submitted by Michael and Theresa
Kuhlmann for Kuhlmanns First Addition Subdivision and refer to the zoning commission for review and
recommendation. Carried 5-0. Copy filed.

John Pylelo, Planning and Zoning Administrator, discussed with the Board the consideration of final plats
for Russell Addition Subdivision.

Motion by Clausen second by Boykin to postpone action on the Russell Addition Subdivision item because the zoning commission had not made a recommendation due to paving agreement not being received. Carried 5-0.

There was a discussion between John Pylelo and the Board concerning suspension of prior reading and
approval requirement for Woodbury County Comprehensive Plan Ordinance.

Motion by Boykin second by Batcheller to approve suspension of prior reading and approval requirement for Woodbury County Comprehensive Plan Ordinance pursuant to Iowa Code Section 331.302(5). Carried 5-0.

The Board discussed Woodbury County Comprehensive Plan Ordinance with John Pylelo of planning and
zoning department.

Motion by Welte second by Batcheller to adopt the Woodbury County Comprehensive Plan Ordinance. Carried 5-0.

The Board discussed general relief with Jean Logan of Woodbury County Community Action Agency.

Motion by Boykin second by Clausen approve and receive for signatures a resolution approving the adoption of the updated General Assistance Department Manual. Carried 5-0. Copy filed.

A RESOLUTION ADOPTING
WOODBURY COUNTY GENERAL ASSISTANCE
DEPARTMENT MANUAL

WHEREAS, the Woodbury County Board of Supervisors shall provide for the assistance of poor persons lawfully in the county who are ineligible for, or are in immediate need and are awaiting approval and receipt of, assistance under programs provided by state or federal law, or whose actual needs cannot be fully met by the assistance furnished under those programs, and

WHEREAS, the Woodbury County Board of Supervisors has established general rules as deemed necessary to properly discharge their responsibilities as stated in the 2003 Iowa Code Section 252.25, and

WHEREAS, the Woodbury County Board of Supervisors in accordance with the Iowa Code adopt the updated Woodbury County General Assistance Manual and thereby abolish any rules and/or guidelines prior to this date, and

WHEREAS, the Woodbury County Board of Supervisors in accordance with the Iowa Code will hereinafter follow the updated Woodbury County General Relief Manual in the administering of services to eligible applicants, and

WHEREAS, it is not the intention of the Woodbury County Board of Supervisors to provide ongoing, long term, financial and medical aid to any individual or family, and

WHEREAS, the Woodbury County Board of Supervisors want that all individuals should remain as self-sufficient as possible.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY that the Board of Supervisors hereby adopts the updated Woodbury County General Assistance Manual this 12th Day of August, 2003.

WHEREAS, the Woodbury County Board of Supervisors shall provide for the assistance of poor persons lawfully in the county who are ineligible for, or are in immediate need and are awaiting approval and receipt of, assistance under programs provided by state or federal law, or whose actual needs cannot be fully met by the assistance furnished under those programs, and

WHEREAS, the Woodbury County Board of Supervisors has established general rules as deemed necessary to properly discharge their responsibilities as stated in the 2003 Iowa Code Section 252.25, and

WHEREAS, the Woodbury County Board of Supervisors in accordance with the Iowa Code adopt the guidelines set in U.S. Department of Housing and Urban Development Rental Assistance Guidelines as part of the Woodbury County General Assistance guidelines, and

WHEREAS, the Woodbury County Board of Supervisors in accordance with the Iowa Code will hereinafter follow the U.S. Department of Housing and Urban Development Rental Assistance Guidelines for the State of Iowa, for the metropolitan service area of Sioux City, Iowa in determining an applicants level of need, and

WHEREAS, it is not the intention of the Woodbury County Board of Supervisors to provide ongoing, long term, financial and medical aid to any individual or family, and

WHEREAS, the Woodbury County Board of Supervisors want that all individuals should remain as self-sufficient as possible.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY that the Board of Supervisors hereby adopt the U.S. Department of Housing and Urban Development Rental Assistance Guidelines as part of the Woodbury County General Assistance Manual this 12th Day of August, 2003.

WOODBURY COUNTY, IOWA

RESOLUTION NO. 9689

A RESOLUTION THANKING AND COMMENDING
NANCY L. FELTS

FOR HER SERVICE TO WOODBURY COUNTY

WHEREAS, Nancy L. Felts has capably served Woodbury County as an employee of the Woodbury County Library from December of 1969 to August 2003; and

WHEREAS, the service given by Nancy L. Felts as a Woodbury County employee, has been characterized by her dedication to the best interests of the citizens of Woodbury County; and

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA that the undersigned members of this Board thanks and commends Nancy L. Felts for her years of service to Woodbury County; and

BE IT FURTHER RESOLVED that it is the wish of all those signing below that the future hold only the best for this very deserving person, Nancy L. Felts; and

BE IT SO RESOLVED this 12th day of August, 2003.

Woodbury County Board of Supervisors, Woodbury County Soil and Water Conservation District, Iowa
Department of Agriculture and Land Stewardship Division of Soil Conservation and the United States
Department of Agriculture Natural Resources Conservation Service. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to approve Memorandum of Understanding between Natural Resources Conservation Service, United States Department of Agriculture, and the Woodbury County Soil and Water Conservation District, and Woodbury County Board of Supervisors, sponsors for Glen Ellen Watershed Project, Structures 2-2, 3-1, and 3-2. Carried 5-0. Copy filed.

The Board discussed the consideration of appointing a Woodbury County budget advisory task force.

Motion by Batcheller second by Welte to approve a Woodbury County budget advisory task force. Carried 5-0.

The Chairman appointed Maurice Welte as the Supervisor representative to the task force.

The Board discussed clarification to 28E agreement and amendment to agreement with Fran Sadden of
Siouxland District Health Department.

Motion by Welte second by Batcheller to approve and authorize the Chairman to sign the Clarification to 28E Agreement and Amendment to 28E Agreement between Woodbury County, Iowa and Siouxland District Board of Health. Carried 5-0. Copy filed.

There was a discussion of Community Development Block Grant (CDBG) audit from Iowa Department
of Economic Development.

Motion by Clausen second by Batcheller to approve an additional addendum to Architectural Contract Form AIA Documents B151-1997 with RML Architects, LLC for Community Development Block Grant (CDBG) requirements. Carried 5-0. Copy filed.

Motion by Batcheller second by Welte to set a close out public hearing for 10:30 AM August 26, 2003. Carried 5-0.

The Board discussed with Fran Sadden, Iowa Department of Revenue and Finance tax refund.

Motion by Welte second by Clausen to apply the $15,458.00 sales tax refund to Siouxland District Healths lease payment owed to the county. Carried 5-0. Copy filed.

Dave Wornson, Attorney with Department of Natural Resources, presented an update concerning
Climbing Hill Water Well Project.

There was a discussion of ownership of the school building in Climbing Hill.

Mr. Walish excused himself at 10:15 AM; Mr. Welte assumed the chair.

Motion by Clausen second by Batcheller to approve Tri-State Behavioral Health Association, Inc. contract
extension for Woodbury County Mental Health Services Management Plan for 36 months. Carried 4-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on
the agenda or Supervisors concerns.

Motion by Boykin second by Clausen to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 4-0 on roll call vote.

Motion by Boykin second by Welte to go out of Executive Session. Carried 4-0 on roll call vote.

The Board adjourned the regular meeting until August 19, 2003.
