SEPTEMBER 9, 2003 - ELEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 9, 2003 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Clausen second by Batcheller to approve the Board minutes of September 2, 2003 as submitted. Carried 5-0.

Motion by Welte second by Boykin to approve the minutes of the Executive Session of September 2, 2003 as submitted. Carried 5-0.

The Board approved the appointment of Jayme A. Kirsch, Assistant County Attorney, County Attorney Dept., @$45,912/year, effective 9-02-03. Job Vacancy Posted: 8-05-03. Salary Range: $39,700-$45,912/year. Copy filed.

The Board approved the reclassification of Kevin W. Gosch, Correctional Officer, County Sheriff Dept., @$16.80/hour, effective 9-20-03. Per DSA Contract agreement, from Class 1 to Senior Class. Copy filed.

Motion by Welte second by Boykin to approve flu and tetanus vaccination for county employees. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign Resolution No. 9700 for tax suspension for B. E. O. Carried 5-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION
OF TAXES

WHEREAS, Blanche E. Oslin, as titleholder of property located 2004 N. Rustin, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel # 282361

Lots 73 76 Kendon Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Blanche E. Oslin as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Welte second by Boykin to authorize the Chairman to sign a Utility Accommodation Permit submitted by Mid-American Energy Co. to install an underground electrical line across Route K-45 at Warrior Road, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to authorize the Chairman to sign a Utility Accommodation Permit submitted by Woodbury County R.E.C. to install a section of underground electrical line replacing an existing overhead line along Route D-51, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Batcheller second by Welte to authorize the Chairman to sign a Utility Accommodation Permit submitted by Eneco Tech Midwest, Inc. to install a section of waterline along Deer Run Path and Climbing Hill Path, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to receive and approve plans for Project L-EWP03(1)73-97. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to receive and approve plans for Project LB-03(5)73-97. Carried 5-0. Copy filed.

Motion by Clausen second by Welte to approve and authorize the Chairman to sign Resolution No. 9702 abating 2003-04 drainage assessments for Wolf Creek Pump District. Carried 4-1, Boykin opposed.

WOODBURY COUNTY, IOWA

RESOLUTION # 9702

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the Woodbury County Board of Supervisors, are the Trustees for Wolf Creek Pump District, and

WHEREAS, the Board assessed taxes on Wolf Creek Pump District for the tax year 2003/2004, and

WHEREAS, none of the real estate located in the Wolf Creek Pump District that was assessed taxes for the tax year 2003/2004 benefits from the drainage and pumping that occurs.

WHEREAS, the assessment can only be made upon lands that benefit from pumping activity;

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors, acting as trustees for the Wolf Creek Pump District, hereby abates the taxes owing on all of the real estate located within the Wolf Creek Pump District for the tax year 2003/2004, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

The Board discussed the consideration of purchase of meeting room furniture.

Motion by Batcheller second by Welte to spend under $2,500 to equip the Meeting Room with eight black walnut colored tables and 36 brown colored (desert sand) chairs and a podium from General Business Interiors paid from the River Boat account. Carried 3-2, Clausen and Boykin opposed. Copy filed.

Skip Meisner gave an update presentation on the Lewis and Clark Bicentennial.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until September 16, 2003.
