MARCH 23, 2004 THIRTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 23, 2004 at 9:00 AM. Board members present were Batcheller, Clausen, and Walish; Welte and Boykin were absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Clausen second by Walish to approve the Board minutes of March 16, 2004 as submitted. Carried 3-0.

Motion by Walish second by Clausen to approve the minutes of the Executive Session of March 16, 2004 as submitted. Carried 3-0.

The Board approved the appointment of Dawn L. Zahnley, F/T Secretary II (Grant), Disaster Services Dept., @$10.26/hour, effective 3-24-04. Job Vacancy Posted: 2-18-04. Entry Level Salary: $10.26/hour. Copy filed.

Motion by Clausen second by Walish to approve the request by Larry A. Harshfield, retiring on May 31, 2004, to remain on Woodbury Countys health and dental insurance plan at his own expense. Carried 3-0. Copy filed.

Motion by Walish second by Clausen to approve and authorize the Chairman to sign an application for a Class A Liquor License Renewal Application and Sunday Sales Privilege for White Horse Patrol Club, 1689 Old Hwy #141, Sergeant Bluff, IA. Carried 3-0. Copy filed.

Motion by Walish second by Clausen to set the Public Hearing and Sale of Real Estate Parcel #174435 on April 6, 2004 at 10:15 a.m. Carried 3-0.

NOTICE OF PROPERTY SALE

Parcel #174435

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Parcel #174435
Franklins Addition
North Half (N ) of Lot One (1) in Block Six (6) of Franklins Addition, Sioux City, Woodbury County, Iowa
(North Half of 201 W 19th Street, Sioux City, Iowa 51104)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on
the 6th Day of April, 2004, at 10:15 o'clock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 6th Day of April, 2004, immediately
following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $ 530.00 plus recording
fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

WOODBURY COUNTY BOARD OF SUPERVISORS

Motion by Walish second by Clausen to authorize the Chairman to sign Utility Accommodation Permits submitted by Woodbury County R.E.C. to install underground electrical lines along county roads near Lawton and Correctionville during the summer of 2004, per recommendation of the county engineer. Carried 3-0. Copy filed.

County Engineer Richard Storm gave a presentation of a draft of the Five-Year Secondary Roads Construction Program followed by a discussion with the Board.

Russ Olson, 1445 220th St., discussed paving 220th Street with the Board.
Alex Shumansky, 1895 Elk Creek Rd., discussed paving Derocher Path with the Board.

The Board discussed request for document execution authority with John Pylelo from Planning and Zoning.

There was a presentation of a status report on Glen Ellen Sub Watershed Project and a discussion on distribution requests.

Motion by Walish second by Clausen to distribute to Crary, Huff et al, P.C., as closing agent for Larry H. and C. Eileen Gordon property for purchase of Parcels #825945 and #825960 aka 1982 Elk Creek Road, Sergeant Bluff for $260,000.00, per appraisal. Carried 3-0.

Motion by Clausen second by Walish to distribute to Crary, Huff et al, P.C., as closing agent for Gene G. Cook and Phyllis J. Cook for purchase of Parcel #825915 aka 1994 Elk Creek Road, Sergeant Bluff for $147,000.00, per appraisal. Carried 3-0.

Motion by Walish second by Clausen to distribute to Vander Werff and Associates, Inc., for appraisal services rendered $1,500.00 plus interest. Carried 3-0.

The Board received an update on Zoning Task Force.

There was a presentation of recommendations.

Motion by Clausen second by Walish to refer the recommendation of the Zoning Task Force on regulations to the zoning commission for their review. Carried 3-0.

Motion by Clausen second by Walish to go into Executive Session per Iowa Code Section 21.5(1) (c). Carried 3-0 on a roll call vote.

Motion by Clausen second by Walish to go out of Executive Session. Carried 3-0 on a roll call vote.

Motion by Clausen second by Walish to approve a settlement with Angel White. Carried 3-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until March 30, 2004.
