MAY 25, 2004 FORTY-SEVENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, May 25, 2004 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Batcheller to approve the Board minutes of May 18, 2004 as submitted. Carried 5-0.

The Board approved the reclassification of David L. Tripp, Correctional Officer, County Sheriff Dept., @$16.80/hour, effective 6-03-04. Per DSA Contract agreement, from Class 1 to Senior Class. Copy filed.

The Board approved the reclassification of Eva L. Lambert, Custodian, Building Services Dept., @$10.62/hour, effective 6-05-04. Per AFSCME Cthouse. Contract agreement, from Grade 1, Step 2 to Grade 1, Step 3. Copy filed.

The Board approved the reclassification of Kay R. Wagner, Vital Statistics Clerk II, County Auditor/Recorder Dept., @$11.63/hour, effective 6-05-04. Per AFSCME Cthouse. Contract agreement, from Grade 3, Step 2 to Grade 3, Step 3. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign the Request to De-authorize County Positions for Laborer, Mechanic, Rodman I, Rodman and Inspector, Inspector, Bridge Foreman/Equipment Operator, and Assistant Survey Chief for Secondary Roads Dept. These positions will be eliminated effective 7-01-04 to be replaced within the new CWA Contract by those positions on the Authorization of New Position Title Request. Carried 5-0. Copy filed.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign the Authorization of New Position Titles for Engineering Technician I, and Certified Engineering Technician II, Secondary Roads Dept., to replace those being de-authorized in the CWA Contract agreement, effective 7-01-04. Carried 5-0. Copy filed.

County Auditor Patrick Gill discussed with the Board allocation of revenue received from Siouxland District Health in regard to remodeling of the District Health Building.

Motion by Boykin second by Walish to place the proceeds of a reimbursement check for the establishment of Siouxland District Health into the fund from which the project was funded. Carried 5-0. Copy filed.

County Auditor Patrick Gill and the Board discussed the funding of Phase VI Courthouse Restoration not covered by the proposed Capital Loan Note. There was no action taken.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign Resolution No. 9776 approving a tax suspension for I.M.S. Carried 5-0.

RESOLUTION # 9776

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Ilene M. Shepherd, as titleholder of real estate located at 1118 27th Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel #271170

Lot Eight (8) Block Two (2), Hyde Park Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Ilene M. Sepherd as titleholder of the aforementioned real estate has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

The Public Hearing and sale of Real Estate Parcel #546301 was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Clausen second by Boykin to close the Public Hearing on the sale of Real Estate Parcel #546301 as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #546301. Debra Twyford bid $530.00 plus recording fees. There were no further bids.

Motion by Boykin second by Walish to accept Debra Twyfords bid for $530.00 plus recording fees on Real Estate Parcel #546301.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign an amendment to the contract with Schoon Construction of Cherokee, Iowa, for Fiber Optic Project with cost not to exceed $25,000.00. Carried 5-0. Copy filed.

The Board reviewed status of the contract on the AT&T Moville Tower Site with Gary Brown, Director of Disaster & Emergency Services and Glenn Sedivy, Director of Communication Center.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign agreement with Micro Tower, Inc. for work completion and removal of the microwave equipment from the former AT&T Moville Tower Site. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to approve the transfer of Liquor License from Mistys Restaurant, Moville, to Mistys Restaurant located at Flathers Hall-Woodbury County Fair Grounds. Carried 5-0. Copy filed.

Motion by Walish second by Batcheller to approve and authorize Chairman to sign agreement with the City of Moville to use Secondary Roads Equipment, per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign addendum to contract with GeoTek Engineering for services at former Woodbury County facility at Salix, Iowa, and completing Site Monitoring Report (SMR), per recommendation of the county engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to approve and receive for signatures a resolution vacating excess roadway right-of-way, per recommendation of the county engineer. Carried 5-0.

WOODBURY COUNTY, IOWA

RESOLUTION NO. 9781

A RESOLUTION VACATING EXCESS ROADWAY RIGHT-OF-WAY

WHEREAS, The Woodbury County Board of Supervisors in accordance with Section 306.10 (Code of Iowa 2003), as amended, has determined that a portion of the roadway right-of-way of Old Christy Road lying south of relocated Christy Road is no longer needed for roadway purposes. The portion to be vacated is described as follows and shown on the attached map:

A portion of Old Christy Road lying on the North Line of Section 16, T88N, R47W, Woodbury County, Iowa, established as Road No. 872 also known as Scwartz Road described as follows; Beginning at a point 1,085.2 feet East of the NW Corner of said Section 16; thence easterly 1,405.0 feet to a point 181.1 feet west of N corner of said Section 16. Area to be vacated is 33 feet north and south of said line.

NOW THEREFORE BE IT RESOLVED that the Woodbury County Board of Supervisors, in accordance with Section 306.10 (Code of Iowa), hereby vacates that excess right of way described above. From and after the date this resolution is recorded, the identified property shall no longer constitute a street, highway, or public right of way, but shall revert to private ownership pursuant to operation of law.

Motion by Walish second by Clausen to receive and accept the bid of Murphy Tractor to furnish a John Deere 770CH Series II motor grader in the amount of $159,870.00, per recommendation of the county engineer. Carried 5-0. Copy filed.

The Board had a discussion with a delegation from Moville, led by Pat Rogers, regarding the status of Route K-64 improvements.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board discussed the cars to be purchased for civil process servers and the gas costs.

The Board adjourned the regular meeting until June 1, 2004.
