JULY 13, 2004 SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, July 13, 2004 at 9:00 AM. Board members present were Batcheller, Boykin, Clausen, and Welte; Walish was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Motion by Batcheller second by Clausen to go into executive session per Iowa Code Section 21.5(1)(c). Carried 4-0 on a roll call vote.

Motion by Batcheller second by Boykin to go out of executive session. Carried 4-0 on a roll call vote.

Motion by Clausen second by Boykin to approve the recommendation of the attorney for matters discussed in the prior executive session. Carried 4-0.

Meeting called to order.

Motion by Batcheller second by Boykin to approve the Board minutes of July 6, 2004 as submitted. Carried 4-0.

Motion by Boykin second by Clausen to authorize the Chairman to sign a 28E Agreement with the City of Oto for Maintenance of Farm-to-Market Extensions within the Citys corporate limits, per recommendation of County Engineer Richard Storm. Carried 4-0. Copy filed.

Motion by Batcheller second by Clausen to receive the quotes and accept the quote of Midwest Service & Sales Co., Schuyler, Nebraska, to provide sign posts in the amount of $16,819.60, per recommendation of the County Engineer. Carried 4-0. Copy filed.

Motion by Clausen second by Batcheller to receive Auditors Quarterly Report for the 4th Quarter ending 6-30-04. Carried 4-0. Copy filed.

Motion by Batcheller second by Clausen to receive County Sheriffs Report of Unadjudicated Condemnation Funds. Carried 4-0. Copy filed.

Mike Arndt from Juvenile Court Services gave an update report of the electronic monitoring program.

Motion by Clausen second by Boykin to approve and receive for signatures a resolution to ratify previous Board action to approve a Block Grant to Siouxland Mental Health for the purchase of a County building. Carried 3-1. Batcheller opposed.

WOODBURY COUNTY, IOWA

RESOLUTION #9806

WHEREAS, on June 8, 2004, the Woodbury County Board of Supervisors approved and ordered the payment of a claim of $225,000 to Siouxland Mental Health Center; and,

WHEREAS, the claim may have not been supported by sufficient documentation to lawfully validate said claim; and,

WHEREAS, the Woodbury County Board of Supervisors intended to grant to Siouxland Mental Health Center the sum of $236,000 to assist said entity in purchasing a building to expand mental health services in Woodbury County, Iowa; and,

WHEREAS, the Woodbury County Board of Supervisors could have lawfully authorized said expenditure to Siouxland Mental Health Center through resolution at the time the claim was presented and paid;

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the June 8, 2004 action in approving the claim of $225,000 to Siouxland Mental Health is adopted and the Board of Supervisors hereby ratifies, confirms, and approves the same in as full a manner as if this resolution was enacted at the time the claim was approved by the board; and,

NOW, THEREFORE, LET IT BE FURTHER RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that Woodbury County grant an additional $11,000 to Siouxland Mental Health Center, for the purpose of assisting said entity to purchase a building to expand mental health services in Woodbury County, Iowa;

SO RESOLVED this 13th day of July, 2004.

The Public Hearing and sale of Real Estate Property to Siouxland Mental Health, Parcels #017745 & #017760, also known as 508 Water Street & 201-205 5th Street, Sioux City, was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Jim Jung, 2222 Jackson St., Janeese Martin, Tax Research Conference and Jim Rixner, Siouxland Mental Health addressed the Board on the sale of the building.

Motion by Boykin second by Clausen to close the Public Hearing on the sale of Real Estate Parcels #017745 & #017760. Carried 4-0.

Siouxland Mental Health Services, Inc. bid $236,000.00 plus recording fees. There were no further bids.

Motion by Clausen second by Boykin to accept the bid of Siouxland Mental Health Services, Inc. in the amount of $236,000.00 plus recording fees on Real Estate Parcels #017745 & #017760 (a.k.a. 508 Water Street & 201-205 5th Street, Sioux City). Carried 3-1. Batcheller opposed. Copy filed.

RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA: #__9810_____

RESOLUTION OF THE WOOBURY COUNTY BOARD OF SUPERVISORS APPROVING THE SALE OF COUNTY PROPERTY

WHEREAS, Iowa Code 331.361(2) authorizes the Board of Supervisors to dispose of an interest in real property upon providing notice and public hearing of its proposal, in accordance with Iowa Code 331.305; and

WHEREAS, the Board of Supervisors published its proposal to sell real property and provided notice of the public hearing to sell said property, in accordance with Iowa Code 331.305;

WHEREAS, the Board of Supervisors held said public hearing on todays date;

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer of
Siouxland Mental Health Services, Inc. for the sum of $236,000 dollars for the following described real estate, to wit:

LOTS FOUR (4), FIVE (5) AND SIX (6), BLOCK SEVEN (7) , SIOUX CITY EAST ADDITION, CITY OF SIOUX CITY, WOODBURY COUNTY, IOWA
Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted;

NOW THEREFORE BE IT FURTHER RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that such body approves the sale of the above-described real property to Siouxland Mental Health Services, Inc. for the sum of $236,000, and the chairman of the Woodbury County Board of Supervisors is authorized on behalf of the County to issue a Quitclaim deed for the property according to the terms of the sale, upon full cash payment;

Fran Sadden, Health Director, discussed Siouxland District Health Department public health plan with the Board.

Motion by Batcheller second by Clausen to authorize the Chairman to sign Siouxland District Health Department bio-emergency response plan for Woodbury County. Carried 4-0. Copy filed.

The Board had a discussion regarding host agency participation with the Community Action Agency of Siouxland Senior Aides Program.

Motion by Batcheller second by Boykin to approve host agency participation with the Senior Aides Program through the Community Action Agency of Siouxland. Carried 4-0. Copy filed.

Patty Erickson-Puttmann, Social Services, Dave Amick, Sheriff, and Jim Rixner from Siouxland Mental Health discussed the purchase of a pepper gun from Mental Health Funds with the Board.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until July 20, 2004.
