JANUARY 25, 2005 FOURTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, January 25, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and John Sullivan, Board Legal Counsel.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Monson to approve the Board minutes of January 18, 2005 as submitted.
Carried 5-0. Copy filed.

Motion by Batcheller second by Walish to approve the Executive Session Board minutes of January 18, 2005 as submitted. Carried 5-0. Copy filed.

The Board approved the appointment of Lanae C. Minten, Correctional Officer, County Sheriff Dept., $14.18/hour, effective 01-26-05. Job vacancy posted: 12-08-04. Entry level salary: $14.18/hour. Copy filed.

The Board approved the reclassification of Stuart W. Betsworth, Engineering Technician I, Secondary Roads Dept., $15.43/hour, effective 02-02-05. Per C. W. A. contract agreement, end of probation salary increase. Copy filed.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign OSHA 300A forms for 2004. Carried 5-0. Copy filed.

The Board discussed with J. D. Pellersels, Human Resource Director, the need to add a part-time clerical/operation position to the Human Resource Department. Delayed action until budget review.

Motion by Batcheller second by Clausen to set the Public Hearing and Sale of Real Estate Parcel #244350
on February 8, 2005 at 10:15 a.m. Carried 5-0.

NOTICE OF PROPERTY SALE

WHEREAS, Woodbury County, Iowa is the owner under a warranty deed of a certain parcel of real estate described as:

EAST 41.2 FEET NORTH 58 FEET
LOT ONE (1) BLOCK TWO (2)
HIGMANS ADDITION
(508 15th Street, Sioux City, Woodbury County, Iowa))

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 8th Day of February 2005 at 10:15 a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse;

2. That said Board proposes to sell said parcel of real estate at a public auction to be held on the 8th Day of February, 2005, immediately following the closing of the public hearing;

3. That said Board proposes to sell said real estate to the highest bidder at or above a total minimum bid of $339.00 plus recording fees;

4. That this resolution, preceded by the caption Notice of Property Sale and except for this subparagraph 4, be published as notice of the aforesaid proposal, hearing and sale.

with North West Environmental Services, Inc., Alton, Iowa, for environmental services at Davidson
Oil Co. site, Moville, Iowa, per recommendation of the county engineer. Copy filed.

Motion by Batcheller second by Walish to authorize Chairman to sign contract for Project
SBRFM-CO97(63)-5D-97, per recommendation of the county engineer. Carried 5-0. Copy filed.

John Pylelo, Planning and Zoning Administrator, provided an update on comprehensive plan. Grady Marx discussed the involvement of the task force as a mediator.

Motion by Walish second by Monson to authorize the Chairman to meet with Riley Simpson and the Zoning Director to discuss the process. Carried 5-0.

Motion by Walish second by Monson to approve the Board minutes of January 11, 2005 as submitted.
Carried 5-0.

Patty Erickson-Puttman, Social Services Coordinator, discussed County Mental Health Services Management Plan, 3-Year Strategic Plan.

Motion by Monson second by Batcheller to approve Woodbury County Mental Health Services 3-Year Strategic Plan. Carried 5-0. Copy filed.

Motion by Walish second by Monson to appoint Leon Koster, 3407 Pine Crest Ct, Sioux City,
to serve on the Veteran Affairs Commission to finish Ray Burnights term. Carried 5-0.

Motion by Batcheller second by Clausen to appoint Mark Taylor, 3718 S Briar Path, Sioux City to the Conservation Board. Carried 5-0.

Motion by Walish second by Batcheller to appoint Larry Williams, Superintendent of Schools, to the Siouxland District Health Board of Directors. Motion withdrawn. Board decision was to publish notice of appointment.

A contest for the official county newspapers was held as follows:
a. Sioux City Journal 42,897 daily subscribers, 43,197 Sunday subscribers
b. Moville Record 1,012 subscribers
c. Sergeant Bluff Advocate 1,063 subscribers
d. Sioux Valley News 597 subscribers

Motion by Clausen second by Walish to appoint Sioux City Journal, Sergeant Bluff Advocate and
Moville Record as the official County newspapers for legal publications. Carried 5-0. Copy filed.

Motion by Walish second by Clausen to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 5-0 on a roll call vote.

Motion by Batcheller second by Walish to go out of Executive Session. Carried 5-0 on a roll call vote.

Motion by Batcheller second by Walish to accept the recommendation of the attorney as presented in Executive Session. Carried 5-0.

Motion by Clausen second by Batcheller to go into Executive Session per Iowa Code Section 21.5(1)(c). Carried 5-0 on a roll call vote.

Motion by Batcheller second by Clausen to go out of Executive Session. Carried 5-0 on a roll call vote.

Motion by Monson second by Clausen to approve the purchase of a house near Climbing Hill for the mentally ill. Carried 5-0.

Bob Batcheller excused himself.

Dennis Butler discussed FY 2006 Budget with the Board as follows:

County Treasurer Motor Vehicle/Management - Motion by Walish second by Monson to receive the Treasurers budget for Motor Vehicle. Carried 4-0.

Medical Examiner Move $42,000.00 from line item 4285 to line item 3520.

Motion by Clausen second by Monson to and to receive the budget as amended. Carried 4-0.

Communication Center Motion by Clausen second by Walish to receive the budget. Carried 4-0.

Human Resources Motion by Walish second by Monson to receive the budget and add a part-time
position. Carried 4-0.

Motion by Walish second by Clausen to authorize Human Resources to hire a part-time person, effective 03/01/2005. Carried 4-0.

Risk Management Services Motion by Clausen second by Walish to receive the budget. Carried 4-0.

The Board recessed until 1:00 p.m.

Meeting reconvened at 1:00 p.m.

Emergency Services Motion by Walish second by Monson to receive the budget. Carried 4-0.

Animal Control Motion by Clausen second by Monson to receive the budget. Carried 4-0.

Law Library Reduce budget by $2,500 due to reduction of books to be purchased out of Riverboat.

Motion by Clausen second by Walish to, and receive the budget as amended. Carried 4-0.

Juvenile Detention Receives additional $100,000 in fiscal year 2006 from the State for reimbursement of operating expenses of Juvenile Detention.

Motion by Clausen second by Monson to receive the budget. Carried 4-0.

Debt Service Motion by Monson second by Clausen to receive the budget. Carried 4-0.

Centralized Intake Motion by Clausen second by Walish to receive the budget. Carried 4-0.

Sanitary Landfill Motion by Walish second by Clausen to receive the budget. Carried 4-0.

Soil Conservation Motion by Walish second by Clausen to receive the budget. Carried 4-0.

Township Trustees Motion by Clausen second by Monson to receive the budget. Carried 4-0.

Mental Health Services Motion by Walish second by Monson to receive the budget. Carried 4-0.

Planning and Zoning Motion by Clausen second by Monson to receive the budget. Carried 4-0.

Children and Family Services Motion by Monson second by Clausen to receive the budget. Carried 3-0, Boykin abstained.

Roadside Management Add $2,000 to line item 2220 and delete the line item for temporary help plus related matching FICA.

Motion by Monson second by Walish to receive budget as amended. Carried 4-0.

Secondary Roads Motion by Walish second by Clausen to receive fiscal year 2006 tax allocation at $588,000. Carried 4-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not
on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until February 1, 2005.
