NOVEMBER 22, 2005 FORTY-FIFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, November 22, 2005 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, and Diane Swoboda Peterson, Deputy/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Walish second by Monson to approve the Board minutes of November 15, 2005 as submitted. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to approve the Canvass of the November 8, 2005 City Regular Election. Carried 5-0.

The Board approved extending temporary status for Michael S. Sweisberger, Temporary Aide, Social Services Dept., $6.00/hour, effective 10/22/2005. Temporary status extended indefinitely. No retro pay needed. Copy filed.

The Board approved the salary increase of Jennifer L. Kvidera, Case Manager, Social Services Dept., $33,476/year, effective 12/13/2005. End of probation salary increase. Copy filed.

The Board approved the salary increase of Clinton S. Meadows, Director, Homeland Security Dept., $53,948/year, effective 12/14/2005. End of probation salary increase. Copy filed.

John Pylelo, Zoning Director, Planning and Zoning Chairman Don Groves, and Riley Simpson, Consultant from Flat Earth Planning, presented recommendations to the Board, regarding the 2005 General Development Plan. Grady Marx, 1461 158th Street, and Robert L. Logan, 89 Pinney Road, Moville, addressed the Board regarding the Plan.

Motion by Batcheller second by Walish to approve and authorize the Chairman to sign a Resolution accepting the Woodbury County Zoning Commission 2005 General Development Plan. Carried 5-0.

RESOLUTION NO. 9982
2005 GENERAL DEVELOPMENT PLAN
FOR THE UNINCORPORATED AREA OF
WOODBURY COUNTY, IOWA

The 2005 General Development Plan is a policy statement consisting of a comprehensive blueprint designed to identify, assess, and develop actions and policies in the areas of population, land use, transportation, housing, economic development, community facilities, and utilities.

WHEREAS chapter 335, Code of Iowa requires the Board of Supervisors to adopt a comprehensive plan prior to adoption of zoning regulations and to provide for their administration and amendment; and

WHEREAS Woodbury Countys last previous adoption of a Comprehensive plan occurred in 1970 the Board of Supervisors deem it necessary, for the purpose of promoting the health, safety, morals and general welfare of the County to adopt such a Plan to be named the 2005 General Development Plan for Woodbury County, Iowa; and

WHEREAS The Board of Supervisors has appointed the County Zoning Commission to recommend a 2005 General Development Plan including mapping of future land use showing the potential areas and boundaries of various future zoning districts; and

WHEREAS the County Zoning Commission has recommended adoption of the attached Exhibit A entitled The 2005 General Development Plan for Woodbury County, Iowa consisting of twenty-four (24) pages and attached exhibit B Woodbury County Future Land Use Map consisting of one (1) page; and

WHEREAS the County Zoning Commission has given reasonable consideration after public hearing among other things, to the character of the districts and their peculiar suitability for particular uses, with a view to encouraging the most appropriate future use of land throughout the County; and

WHEREAS the Board of Supervisors has given the due public notice of hearing related to the Plan and mapping, and has held such public hearing, approved changes to the mapping pursuant to testimony at said hearing reflected within exhibit B; and

WHEREAS all requirements of Chapter 335, Code of Iowa with regard to the preparation of the report of the County Zoning Commission and the subsequent action of the Board of Supervisors has been met; NOW THEREFORE,

BE IT RESOLVED on this 22nd day of November, 2005 the Board of Supervisors of Woodbury County, Iowa adopts exhibit A attached consisting of twenty-four (24) pages as the Countys 2005 General Development Plan and attached exhibit B consisting of one (1) page as the Woodbury County Future Land Use Map .

A public hearing was held at 10:15 a.m. for amendment #1 for fiscal year 2005-2006 budget.

Motion by Batcheller second by Walish to recess the public hearing. Carried 5-0.

A public hearing was held at 10:15 a.m. for the sale of real estate parcel #081195 (aka 421 Colon Street). The Chairman called on anyone wishing to be heard on said sale.

Motion by Clausen second by Batcheller to close the hearing, as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on real estate parcel #081195. Randy Sands bid $400.00.

Motion by Batcheller second by Walish to accept the bid of Randy Sands for $400.00 plus recording fees, for real estate parcel #081195. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Randy Sands and Sue Gill in the sum of Four Hundred ($400.00) dollars

For the following described real estate, To Wit:

Parcel #081195
Lot 18, Block 8 Bradstreet Addition, City of Sioux City,
Woodbury County, Iowa (aka 421 Colon St.)


Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said

Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.
BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

The Board resumed the public hearing for fiscal year 2005-2006 budget amendment #1 at 10:20 a.m.

Motion by Walish second by Monson to close the public hearing for fiscal year 2005-2006 budget amendment #1. Carried 5-0.

Motion by Batcheller second by Monson to approve budget amendment #1 for fiscal year 2005-2006. Carried 5-0. Copy filed.

Motion by Clausen second by Monson to approve lifting the tax suspension for Patrick M. Murray, 6500 6th Avenue, Sioux City, per his request on November 10, 2005. Carried 5-0

Motion by Batcheller second by Monson to approve lifting the tax suspension for Janet S. Miller, 3334 Orleans Avenue, Sioux City, as this person is deceased. Carried 5-0.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

Jane Gilbert, Co-Director of SIMPCO would like to incorporate what the County and cities within the County do in regards to enforcing ordinances. SIMPCO could be the liaison in working with individuals.

Rick Van Hatten thanked the Board for paving 220th Street.

Motion by Monson second by Walish to cancel the 12/27/2005 Board of Supervisors meeting. Carried 5-0.

The Board adjourned the regular meeting until November 29, 2005.
