FEBRUARY 28, 2006--NINTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, February 28, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen and Walish, Monson was absent. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Boykin to approve the Board minutes of the February 21, 2006 meeting as submitted. Carried 4-0. Copy filed.

The Board approved the reclassification of Jerardo Z. Cruz, Correctional Officer, County Sheriff Dept., effective 03/09/2006. Per DSA contract agreement from Class 4 to Class 3. Copy filed.

The Board approved the reclassification of Randy D. Robinson, Jail Custodian, County Sheriff Dept., $12.86/hour, effective 03/12/2006. Per AFSCME Courthouse contract agreement from Grade 1, Step 4 to Grade 1, Step 5. Copy filed.

The Board approved the reclassification of Deborah Fuller, Part-time Youth Worker, Juvenile Detention Dept., $13.65/hour effective 03/14/2006. Per AFSCME Juvenile Detention contract agreement from Grade 1, Step 1 to Grade 1, Step 2. Copy filed.

Motion by Walish second by Batcheller to approve and authorize the Chairman to sign, a resolution adopting a safety policy for all Woodbury County employees, per recommendation of J. D. Pellersels, Human Resources Director and the County Safety Committee. Carried 4-0.

WOODBURY COUNTY SAFETY RESOLUTION
RESOLUTION #10,020

The success of Woodbury County government depends upon our efficient use of resources to produce a high quality product for the citizens of the County. One of our most important resources is our employees. To protect this resource, the Woodbury County Board of Supervisors is committed to providing a safe workplace for all employees by establishing and maintaining an effective safety and health program. The Woodbury County Board of Supervisors considers safety to be a core value of County government operations.

The Woodbury County Board of supervisors requires all employees at all levels of our workforce to make safety a matter of continuing concern, equal in importance to all other job duties and operational considerations. As a Woodbury County employee, all are expected to cooperate in implementing safety practices and to adopt the concept that the safest way to perform a task is the most efficient and the only way to perform it.

The Board discussed providing first aid/CPR training for all County employees, over a 12-month period.

Motion by Boykin second by Walish to approve the training. Carried 4-0.

The Board discussed the submission of a DARE grant application to the Iowa Department of Public Health for County Substance Abuse Prevention Services, with Social Services Coordinator Patty Erickson-Puttmann.

Motion by Batcheller second by Boykin to approve submission of the DARE grant application. Carried 4-0.

Motion by Boykin second by Walish to approve and authorize the submission of a Section 402 funding request to be submitted to the Governors Traffic Safety Bureau, Iowa Department of Public Safety, for funding of overtime enforcement, training, education materials, and equipment and the submission of a Section 410 funding request to be submitted to the Governors Traffic Safety Bureau, Iowa Department of Public Safety, for funding of overtime enforcement, training, education materials, and equipment, per recommendation of Patti Erickson-Puttmann, Social Services Coordinator. Carried 4-0.

The Board discussed a Justice Assistance Grant application with Social Services Coordinator, Patty Erickson-Puttmann.

Motion by Walish second by Boykin to designate Patti Erickson-Puttmann to electronically submit the application. Carried 4-0.

Motion by Boykin second by Batcheller to approve Resolution #10,023 relating to the Inter-local agreement. Carried 4-0. Copy filed.

INTERLOCAL AGREEMENT
BETWEEN THE CITY OF SIOUX CITY, IOWA AND COUNTY OF WOODBURY, IOWA

2006 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD

This agreement is made and entered into the 28th day of February, 2006 by and between the COUNTY of Woodbury County, Iowa acting by and through its governing body, the Board of Supervisors hereinafter referred to as COUNTY, and the CITY of Sioux City, Iowa acting by and through its governing body, the City Council, hereinafter referred to as CITY, both of Woodbury County, State of Iowa, witnesseth:

WHEREAS, this Agreement is made under the authority of Iowa Code: and

WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance of those payments from current revenues legally available to that party: and

WHEREAS, each governing body finds that the performance of this Agreement is in the best interests of both parties, that the undertaking will benefit the public, and that the division of costs fairly compensates the performing party for the services of functions under this agreement: and

WHEREAS, the CITY agrees to provide the COUNTY fifty percent of the amount of funds received from the JAG awards for the JAG program: and

WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate the JAG funds.

NOW THEREFORE, the COUNTY and CITY agree as follows:

Section 1.

Upon receipt of JAG Award funds by COUNTY, COUNTY agrees to pay CITY fifty percent of the total funds received.

Section 2.

CITY agrees to use one-hundred percent of JAG funds for the JAG program by 3/31/2010.

Section 3.

Nothing in the performance of this Agreement shall impose any liability for claims against COUNTY other than claims for which liability may be imposed by the Iowa Tort Claims Act.

Section 4.

Nothing in the performance of this Agreement shall impose any liability for claims against CITY other than claims for which liability may be imposed by the Iowa Tort Claims Act.

Section 5.

Each party to this agreement to this agreement will be responsible for its own actions in providing services under this agreement and shall not be liable for any civil liability that may arise from the furnishing of the services by the other party.

Section 6.

The parties to this agreement do not intend for any third party to obtain a right by virtue of this Agreement.

Section 7.

By entering into this Agreement, the parties do not intend to create any obligations express or implied other than those set out herein: further, this Agreement shall not create any rights in any party not a signatory hereto.

Motion by Boykin second by Walish to approve designating use of JAG funds for personnel costs associated with County participation in the Drug Task Force. Carried 4-0.

The Public Hearing and Sale of Property for Parcel #035130 (aka 1207/1209 11th Street) was held at 10:15 a.m. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Walish to close the Public Hearing and Sale of Parcel #035130. Carried 4-0.

The Chairman called for bids on Real Estate Parcel #035130.

Betty McManaman bid the minimum bid of $305.00 plus recording fees.

There were no further bids.

Motion by Batcheller second by Walish to accept the bid of $305.00 plus recording fees, from Betty McManaman. Carried 4-0.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Batcheller second by Walish to accept and award the bid for maintenance culvert pipe project #CP-2006 to Northern Iowa Construction Products, Cedar Rapids, IA, in the amount of $54,965.50, per recommendation of Richard Storm, County Engineer. Carried 4-0. Copy filed.

Motion by Boykin second by Walish to receive and approve a proposal from Schmillen Construction Company for concrete crushing south of the Sioux Gateway Airport, in the amount of $5,000.00 for mobilization plus $4.75 per ton. Carried 4-0. Copy filed.

The Public Hearing of fiscal year 2007 Woodbury County Budget was held at 10:30 a.m. The Chairman called on anyone wishing to be heard on said County budget.

Dennis Butler, Budget/Tax Analyst from the Auditor's Office, notified the Board of Supervisors prior to the Public Hearing on the County's FY 07 Budget that the Debt Service Tax asking would be $ 200,000 higher than published. Exceeding the published estimate is authorized by Chapter 76 of the Code of Iowa.

Tim Botarro, Chairperson of the Compensation Commission, presented the Compensation Commissions Recommendation to the Board.

Motion by Boykin second by Walish to receive the compensation schedule as submitted. Carried 3-1, Batcheller opposed.

Jim Jung, 2222 Jackson St., Sioux City, discussed the budget proceedings with the Board.

Janeese Martin, Executive Director of the Tax Research Conference, presented concerns and discussed options for the budget with the Board.

Motion by Boykin second by Walish to close the Public Hearing on fiscal year 2007 County Budget. Carried 4-0.

Motion by Boykin second by Walish to adopt the fiscal year 2007 Woodbury County Budget. Carried 4-0. Copy filed.

Motion by Boykin second by Walish to approve tax abatements for the following persons, per recommendation of Bob Knowler, County Treasurer:

1. Sherie Ann Arens, building on leased land for a mobile home that has been removed and is no longer assessed, parcel #981185.

2. Ellen L. Bock, building on leased land for a mobile home that has been removed and is no longer assessed, parcel #884730301941.

3. Iseman Corporation or Iseman Homes, building on leased land for a mobile home that has been removed and is no longer assessed, parcel #884730301969.

4. Luis A. or Cathy M. Young, building on leased land for a mobile home that has been removed and is no longer assessed, parcel #894701200940.

Carried 4-0. Copy filed.

Gary Brown, Emergency Services and Glenn Sedivy, Communications Center, provided the Board with an update on the StarComm project.

There was no action taken to approve and authorize the Chairman to sign a project completion certificate.

The Board discussed the five-year bridges construction program with Richard Storm, County Engineer.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until March 7, 2006.
