JUNE 13, 2006TWENTY-FOURTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, June 13, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson; and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

The Board of Supervisors canvassed the General Primary Election held on the 6th day of June, 2006 with the following official results:

Victoria L. Ritz, Deputy Commissioner of Elections, announced there were six (6) provisional ballots of which four (4) were accepted and added to the Tally, and three (3) after-election absentee ballots, two (2) of which were timely postmarked and added to the Tally.

WHEREAS, Rita Lowe, as titleholder of a properties located 2829 E. 1st Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Lot One (1) Block Three (3) Ludwigs Addition, City of Sioux City, Woodbury County, Iowa
WHEREAS, Rita Lowe of the aforementioned properties has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

NOTICE OF PROPERTY SALE

WHEREAS, Woodbury County, Iowa is the owner of Excess Right-of-Way real estate described as follows:

All that part of the Northwest Quarter (NW) of section (20), Township Eighty Seven
(87) North, Range Forty Six (46) West of the Fifth (5th) Principal Meridian, Woodbury
County, Iowa, described as commencing at the Southeast (SE) Corner of the NW, (also known as the Center Quarter Corner) of Section 20-87-46; thence North 89 27 00 West along the South line of the NW of said section 20, a distance of 204.47 feet; thence North 39 54 59 West a distance of 932.00 feet; thence North 50 05 01 East a distance of 181.82 feet to the Point of Beginning; thence North 39 54 59 West a distance of 167.70 feet; thence North 50 05 01 East a distance of 75.00 feet; Thence North 39 54 59 West a distance of 359.81 feet; thence North 50 05 01 East a distance of 43.18 feet; Thence South 39 54 59 East a distance of 527.51 feet; thence South 50 05 01 West a distance of 118.18 feet to the Point of Beginning.

NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors as follows:

1. That said Board proposes to sell the said real estate at a public auction to be held on the 11th day of July 2006, immediately following the closing of the public hearing.

2. That a public hearing on the aforesaid proposal shall be held on the 11th day of July, 2006 at 10:15 AM CDST in the Board of Supervisors Meeting Room on the first floor of the Woodbury County Courthouse.

3. That said Board proposes to sell the said real estate to the highest bidder at or above the minimum bid of $750.

4. That each bidder must have a certified letter of credit from an Iowa bank or any bank located outside of Iowa which is chartered under the laws of the United States, or a certified letter of credit drawn on a credit union in Iowa or chartered under the laws of the United States, for the amount of one-hundred and ten percent (110%) of the total purchase price. A cash down payment shall be equal to or in excess of five percent (5%) of the total purchase price. Should the bidder receiving the award fail to execute a satisfactory contract within fourteen (14) days after tender of the prescribed forms to the County Engineer, unless additional time is allowed by t he Engineer, the cash shall be forfeited or the check shall be cashed and the full amount retained by the County as fixed or liquidated damages.

5. That the sale of the said real estate, shall be subject to easement of record, zoning regulations and upon the conditions that the tract, parcel, or piece of land so sold shall not be used in any manner so as to interfere with the use of the highway by the public, or endanger public safety in the use of the highway, or the material damage to the adjacent owner(s).

RESOLUTION ACCEPTING AND APPROVING KOLLBAUMS REPLAT
OF PART OF LOT 4 OF NEVILLES COUNTRY ESTATES ADDITION
TO WOODUBY COUNTY, IOWA

WHEREAS, the owner and proprietor did on the 1st day of June, 2006, file with the Woodbury County Zoning Commission a certain plat designated as Kollbaums replat of part of lot 4, Nevilles Country Estates addition to Woodbury County, Iowa; and

WHEREAS, it appears that said plat conforms with all of the provisions of the code of the State of Iowa and ordinances of Woodbury County, Iowa, with reference to the filing of same; and

WHEREAS, the Zoning Commission of Woodbury County, Iowa has recommended the acceptance and approval of said plat; and

WHEREAS, the County Engineer of Woodbury County, Iowa has recommended the acceptance and approval of said plat.

NOW THEREFORE, BE, AND IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, that the plat of Kollbaums replat of part of lot 4, Nevilles Country Estates Addition to Woodbury County, Iowa be, and the same is hereby accepted and approved, and the Chairman and Secretary of the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, are hereby directed to furnish to the owner and proprietor a certified copy of this resolution as required by law.

Motion by Boykin second by Monson to approve the recommendation of the Zoning Administrator regarding the preliminary plats for Tomoson Addition Subdivision (Parcel #GIS8847 21 101 001) and refer it to the Zoning Commission for review and recommendations. Carried 5-0.

The Board adjourned the regular meeting until June 20, 2006.
