AUGUST 22, 2006THIRTY-THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 22, 2006 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Patrick F. Gill, Auditor/Clerk to the Board, and Bobbier Johnson, Assistant County Attorney.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Walish to approve the Board minutes of the August 15, 2006 meeting as submitted. Carried 5-0. Copy filed.

Motion by Walish second by Monson to approve lifting the tax suspension for Robert C. Hutchinson (520 Center Street, Sioux City), per his request. Carried 5-0.

The Board discussed a request from the City of Moville to abate property taxes for property owned by the City of Moville, parcel #894432101002.

Motion by Monson second by Boykin to approve and authorize the chairman to sign Resolution to abate taxes on parcels #894432101002 for the City of Moville. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the City of Moville are the titleholders of real estate Parcel #894432101002, located in Woodbury County, Iowa and legally described as follows:

Parcel #894432101002

Lots 1-3, Block 5, First Addition and Other Land Adjacent

WHEREAS, the above stated property has an unpaid balance of taxes owing, and the parcels are owned by a political subdivision of the state; and

WHEREAS, the City of Moville requests the Board of Supervisors abate 10/12s of the tax or $4,363 representing that part of the taxes after which the City of Moville was in sole possession; and

WHEREAS, the political subdivision, namely the City of Moville is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against these parcels; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcels according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Motion by Batcheller second by Monson to approve the second reading of an ordinance requiring keg registration. Carried 5-0.

The Board discussed placements at Youth State facilities with Robert Sheehan, President and CEO of Boys and Girls Home and Family Services, Incorporated.

Motion by Boykin second by Monson to draft a letter for signatures to the Iowa Legislature urging action to address the issue of shifting costs of troubled youth to the local level. Carried 5-0.

Motion by Batcheller second by Walish to receive and approve plans for project #L-EWP02(5)73-97, for the installation of a stream stabilization weir, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign amendment #1 to agreement #69-6114-6-11 (Little Sioux Watershed), between Woodbury County and USDA Natural Resources Conservation Service, to add additional time needed to complete work, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign amendment #2 to project agreement #HC04-9 with Hungry Canyons Alliance, extending the completion date of the agreement to September 30, 2007, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a proposal from Certified Testing Services, Incorporated, Sioux City, to provide subsurface exploration services for project #BROS-CO97(77)5F-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.

The Board held a discussion with County Engineer Richard Storm, regarding improvements to the Moville Maintenance Facility.

Motion by Monson second by Walish to receive the recommendation of the county engineer regarding the Moville maintenance facility improvements. Carried 5-0.

The Board approved a leave of absence, due to family medical purposes, for Christopher C. Cox, Part-time Youth Worker, Juvenile Detention Dept., effective 06/12/2006. Copy filed.

The Board approved a leave of absence, due to military activation, for Vincent T. Dvorak, Correctional Officer, County Sheriff Dept., effective 07/31/2006. Copy filed.

The Board approved the separation of Christopher N. Lord, Temporary Summer Laborer, Secondary Roads Dept., effective 08/09/2006. End of temporary work. Copy filed.

The Board approved the separation of Cody F. Forch, Temporary Summer Laborer, Secondary Roads Dept., effective 08/11/2006. End of temporary work. Copy filed.

The Board approved the separation of Clifford D. Hindman, Temporary Custodian, Building Services Dept., effective 08/18/2006. End of temporary work. Copy filed.

The Board approved the reclassification of Jayme A. Kirsch, Assistant County Attorney, County Attorney Dept., $58,741/year effective 09/02/2006. Per AFSCME Assistant Attorney contract agreement, from Step 6 to Step 7. Copy filed.

The Board discussed Juvenile Detention personnel issues with J. D. Pellersels, Human Resources Director, and Mark Olson, Juvenile Detention Director.

Motion by Boykin second by Batcheller to approve the request of the juvenile detention director to restructure the department organization and create two full time night shift managers. Carried 5-0. Copy filed.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for two Night Shift Managers, Juvenile Detention Department. Entry level: Wage Plan $40,477/year. Carried 5-0. Copy filed.

The Chairman asked if there were any individual or group wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until August 29, 2006.
