JANUARY 23, 2007FOURTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, January 23, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen and Monson; Walish was absent. Staff members present were Karen James, Board Administrator, Bobbier Johnson, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Monson to approve the Board minutes of the January 16, 2007 meeting as submitted. Carried 4-0. Copy filed.

The Board approved the promotion of Michael N. Bouton, Senior Assistant Director, Juvenile Detention Dept., $50,000.00/year, effective 01/29/2007. Promoted from Assistant Director to Senior Assistant Director, effective 01/29/2007. Copy filed.

The Board approved the appointment of Izzlee F. Hanson, Full-time Custodian, Building Services Dept., $10.45/hour, effective 01/30/2007. Job vacancy posted 11/07/2006. Entry level salary $10.45/hour. Copy filed.

The Board approved the appointment of Ryan M. Hansen, Temporary Correctional Officer, County Sheriff Dept., $14.32/hour, effective 02/07/2007. Not to exceed 120 days. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign an Authorization To Initiate Hiring Process for a Temporary Correctional Officer, County Sheriff Dept. Entry level: DSA comparability $14.32/hour. Carried 4-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign the 2006 annual report of the Iowa Individual Health Benefit Reinsurance Program. Carried 4-0.

Motion by Boykin second by Monson to receive the 2006 OSHA 300A reports, by department, as submitted. Carried 4-0.

Motion by Monson second by Boykin to receive the appointment of Hubert Pepin, 1568 300th Street, Salix, Iowa, to serve as Lakeport Township Trustee, to fill the office vacancy until the 2008 General Election. Carried 4-0.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign the County Substance Abuse Prevention (DARE) Program application to the Iowa Department of Health, per recommendation of Social Services Director Patty Erickson-Puttmann. Carried 4-0.

Motion by Monson second by Boykin to approve the appointment of Teresa Delfs, 205 W. 45th Street, Sioux City, Iowa, to the Commission to Assess Damages Category C. Carried 4-0.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Resolution authorizing the suspension of taxes for Marjorie V. Harmon, 1824 25th Street, Sioux City, Iowa. Carried 4-0.

RESOLUTION APPROVING PETITION FOR SUSPENSION OF TAXES

WHEREAS, Marjorie V. Harmon, are the titleholders of property located at 1824 25th Street, City of Sioux City, Woodbury County, Iowa, and legally described as follows:

Parcel # 894722156011

Lot Thirteen (13) Block Four (4) Lowell Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Marjorie V. Harmon as titleholders of the aforementioned real estate have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1997 Iowa Code section 427.9, and

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Resolution establishing road closures for 2007 construction projects, per recommendation of Richard Storm, County Engineer. Carried 4-0.

WOODBURY COUNTY, IOWA
RESOLUTION #10,129

BE IT RESOLVED, by the Woodbury County Board of Supervisors, duly assembled, pursuant to Section 306.41 of the Code of Iowa, 2005, as amended, that the following highways or sections of highways described and shown on Exhibit A and B respectively, attached hereto and by this reference made a part hereof, will become temporarily closed for a undetermined period for construction, re-construction, and/or maintenance and thereupon the County Engineer is directed to cause signs and partial or total barricades to be erected in the roadway at each end of said described highway or section of highway, and on said highway where intersected by other highways, reading Road Closed. Said described highways shall become closed effective upon the erection of signs and barricades, and shall remain closed until said signs and barricades are removed.

SO RESOLVED, Dated this 23rd day of January, 2007.

Motion by Boykin second by Monson to approve the appointment of Gary Brown as the County authorized representative for the Regional Institute for Preparedness. Carried 4-0.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign amendment #2 to the Regional Hazardous Materials Agreement, per recommendation of Gary Brown, Emergency Services Director. Carried 4-0. Copy filed.

Mr. Batcheller excused himself at 10:15 a.m.

A public hearing and sale was held at 10:15 a.m. for the real estate parcel #074025 (1108 Rustin Street).

Motion by Boykin second by Monson to close the hearing. Carried 3-0.

The Chairman called for bids.

Carol Goulette bid $257.00.

Motion by Boykin second by Monson to accept the bid from Carol Boulette for $257.00 plus recording fees. Carried 3-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:
