MARCH 27, 2007THIRTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, March 27, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Bobbier Johnson, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Monson to approve the Board minutes of the March 20, 2007 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the reclassification of Douglas E. Washburn, Equipment Operator, Secondary Roads Dept., $16.55/hour, effective 04/11/2007. End of probation salary increase. Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign a corrected deed for parcel #686205, sold at the Public Bidder auction held on 09/12/2006, Resolution #10,094, showing the new owner as the executor of the estate, rather than the estate itself. Carried 5-0. Copy filed.

Motion by Batcheller second by Monson to approve using Court Security funds for payment of the $2,200.00 invoice received from W. A. Klinger, for remodeling work performed week ending 12/24/2006 in Juvenile Courtroom #2. Carried 5-0.

Motion by Monson second by Boykin to approve the liquor license application for Anthon Golf Club, Incorporated, 2236 Hwy 31, Anthon, Iowa, for a one-year Class C liquor license, with outdoor service and Sunday sales privileges. Carried 5-0.

County Sheriff Glenn Parrett and County Attorney P. J. Jennings discussed with the Board the Countys participation with the City of Sioux City in the submission of the Edward J. Byrne Memorial Justice Assistance Grant (J. A. G.) program grant application to the Governors office of Drug Control Policy.

Motion by Boykin second by Monson to approve participation with the City of Sioux City in the submission of the J. A. G. program grant application. Carried 5-0.

Rural Economic Development Director Rob Marqusee presented the Board with a revised Owego Dairy development agreement.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign the revised Owego Dairy development agreement. Carried 5-0. Copy filed.

Motion by Monson second by Batcheller to approve and receive for signatures, a Resolution supporting Time-21 legislation to increase funding of the State Road Use Tax Fund, per recommendation of County Engineer Richard Storm. Carried 5-0.

WOODBURY COUNTY, IOWA
RESOLUTION NO. 10,147

WHEREAS, Senators Rielly and Noble, Chair and Ranking Member respectively of the Transportation Committee, are seeking input concerning transportation needs with public meetings that are being held throughout the state; and

WHEREAS, the Road Use Tax Fund is an important source of support for construction and maintenance projects at the city, county, and state level; and

WHEREAS, an integral part of the R.U.T.F. is the fuel tax, which has not increased since 1989, and during that time frame construction costs have more than doubled; and

WHEREAS, the Iowa Good Roads Association, the Iowa County Supervisors Association, the Iowa County Engineers Association and a consortium of additional public and private individuals and organizations, has promoted the TIME-21 program (Transportation Investment Moves the Economy in the 21st Century) to underscore that steady deterioration of the construction dollar; and

WHEREAS, TIME-21 supports the Iowa Department of Transportations request for an additional $200 million added to the R.U.T.F. that would be committed to roadway infrastructure and would be generated by increasing transportation-related fees;

NOW THEREFORE BE IT RESOLVED that the Woodbury County Board of Supervisors recognizes the vital role that our transportation system performs for Iowa and encourages the legislature to consider funding alternatives to increase revenue to the Road Use Tax Fund.

Motion by Boykin second by Monson to approve and receive for signatures, a Resolution establishing weight restrictions on certain roads, per recommendation of County Engineer Richard Storm. Carried 5-0.

WOODBURY COUNTY, IOWA
RESOLUTION NO. 10,148

WHEREAS, the Woodbury County Board of Supervisors believe that certain secondary roads in Woodbury County, Iowa which are paved or unpaved, will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or the permissible weight thereon reduced, and

WHEREAS, Chapter 321, Section 471 of the Code of Iowa, gives said Board the power to prohibit the operation of said vehicles on such roads, and to impose restrictions as to the weight of vehicles on said roads.

NOW THEREFORE BE IT RESOLVED by the Woodbury County Board of Supervisors, that, where signs are erected on a highway, operation of vehicles weighing in excess of said weight limit are prohibited on said highway.

IT IS FURTHER RESOLVED that the said secondary roads subject to this resolution are more particularly described in EXHIBIT A, attached thereto and by this reference made a part hereof. The effective date of this resolution is March 28, 2007 through and including May 18, 2007.

EXHIBIT A

All Secondary Roads as listed below in Woodbury County, Iowa shall be limited to vehicles, including load, of a gross weight of six (6) tons per axle.

1. County Route L-27 from intersection of County Route D-50 south approximately six (6) miles to intersection of County Route D-54.

2. County Route L-21 from intersection of County Route D-38 south and west approximately eight (8) miles to intersection of County Route D-54.

Motion by Boykin second by Clausen to approve and receive for signatures, a Resolution vacating excess road right-of-way for a portion of vacated Highway 141, which is no longer used for road purposes, per recommendation of County Engineer Richard Storm. Carried 5-0.

WOODBURY COUNTY, IOWA
RESOLUTION NO. 10,149
A RESOLUTION VACATING EXCESS ROADWAY RIGHT-OF-WAY

WHEREAS, The Woodbury County Board of Supervisors in accordance with Section 306.10 (Code of Iowa), as amended, has determined that a portion of the roadway right-of-way of vacated Highway 141 is no longer used for roadway purposes. The portion to be vacated is described as follows and shown on the attached map:

Vacate a portion of right-of-way established by the Iowa State Highway Commission on June 23, 1918 through the Woodbury County Board of Supervisors. This portion (severed by the relocation of Iowa Highway 141 in 1960, then abandoned by the Iowa DOT in 1971) is further described as that portion lying between the east right-of-way of relocated Old Highway 141, AKA Iowa Highway 982, and now known as County Route D-25 easterly to the west right-of-way of County Route D-38 AKA Bronson Black Top in part of the NE of Section 31, T88N, R46W of the 5th P.M., Woodbury County, Iowa. This section was established as part of Road No. 261 AKA Adams Road. All utility easement occupying said section shall remain with rights of ingress and egress.

NOW THEREFORE BE IT RESOLVED that the Woodbury County Board of Supervisors, in accordance with Section 306.10 (Code of Iowa), hereby vacates that excess right-of-way described above. From and after the date this resolution is recorded, the identified property shall no longer constitute a street or highway, but shall revert to private ownership pursuant to operation of law.

The Board discussed Secondary Roads Dept.s five-year construction improvement program with County Engineer Richard Storm.

Bid letting was held at 10:30 a.m. for two motor graders for Secondary Roads Dept. The bids were as follows:

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

John Malloy of W.C.I.C.C. brought to the Board concerns about water leaking into their facilities.

Jack Burright of 1198 Minnesota Avenue discussed his property tax bill with the Board.

The Chairperson addressed the Boards concerns about the hiring of a new city assessor. The consensus was to send a letter expressing the Boards concerns to the Chair of the conference Board.

The Board adjourned the regular meeting until April 3, 2007.
