MAY 22, 2007TWENTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, May 22, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrator, Loan Hensley, Assistant County Attorney, and Diane Swoboda Peterson, Deputy/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Monson second by Batcheller to approve the Board minutes of the May 15, 2007 meeting as submitted. Carried 4-0; Boykin abstained. Copy filed.

The Board approved the appointment of Nicholas J. Christiansen, Part-time Male Youth Worker, Juvenile Detention Dept., $13.52/hour effective 05/24/2007. Job vacancy posted 02/28/2007. Entry level salary: $13.52/hour. Copy filed.

The Board approved the separation of Linda G. Shelton, Motor Vehicle Clerk II, County Treasurer Dept., effective 05/31/2007. Retirement. Copy filed.

The Board approved the separation of Ryan M. Hansen, Temporary Correctional Officer, County Sheriff Dept., effective 06/06/2007. End of temporary work. Copy filed.

The Board approved the reclassification of Kimberlee K. Koepke, Part-time Youth Worker, Juvenile Detention Dept., $14.54/hour effective 06/06/2007. Per AFSCME J.D. contract agreement, from Grade 1, Step 2 to Grade 1, Step 3. Copy filed.

The Board approved the reclassification of Cynthia L. Foxhoven, Custodian, Building Services Dept., $12.22/hour effective 06/15/2007. Per AFSCME Courthouse contract agreement, from Grade 1, Step 3 to Grade 1, Step 4. Copy filed.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for a Motor Vehicle Clerk II, County Treasurer Dept. Entry level: AFSCME Courthouse, fiscal year 2007/2008 $12.05/hour. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to approve the submission of two grant applications by the Human Resources/Safety Dept., to the Siouxland Community Foundation and to the Automated External Defibrillators (AED) program, per recommendation by the County Safety Committee and Subcommittee for CPRS, first aid, automated external defibrillator (AED) training. Carried 5-0.

Motion by Batcheller second by Clausen to approve lifting the tax suspension for Marian E. Nelson, 1215 S. Mulberry Street, Sioux City, Iowa, as the property has been sold. Carried 5-0.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a Resolution approving tax abatement for the City of Sioux City, for parcels #894734128010, #894734128007, and #894734128006, Woodbury County, Iowa. Carried 5-0.

WHEREAS, the City of Sioux City requests the Board of Supervisors abate the tax representing that part of the taxes after which the City of Sioux City was in sole possession; and

WHEREAS, the political subdivision, namely the City of Sioux City is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against these parcels; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcels according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

OF TAXES THROUGH THE REDEMPTION PROCESS

WHEREAS, Dorothy M. Murfield as joint titleholder of a real estate located at 1717 W. 2nd Street, Sioux City, Woodbury County, Iowa, and legally described as follows:

Lot Eight (8) Block Fifteen (15) Hornicks Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, Dorothy M. Murfield, as joint titleholder of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and,

WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem Parcel #894730287009 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign a letter of support for the Center for Siouxland, for a HUD housing counseling grant. Carried 5-0.

Bid letting was held at 10:20 a.m. for project #L-CO6(1)73-07 (construction of twin 10 x 10 concrete box culvert). The bids were as follows:

Dixon Construction Company, Correctionville, Iowa $223,272.80

Godbersen-Smith Construction Company, Ida Grove, Iowa $220,197.96

Graves Construction Company, Incorporated, Spencer, Iowa $222,024.13

There were no other bids.

Motion by Batcheller second by Monson to receive the bids and award to the lowest bidder, Godbersen-Smith Construction Company. Carried 5-0. Copy filed.

Motion by Monson second by Batcheller to approve and authorize the Chairman to sign the following utility accommodation permits, submitted by Hi-Tech Electric LLC, Sioux City, Iowa, on behalf of Qwest Communications, per recommendation by the County Engineer:

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Bennett-McDonald Drainage District, that a special tax and/or assessment in the sum of $ 1,000 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Orton Slough Drainage District, that a special tax and/or assessment in the sum of $ 1,500 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies, and public highways within the boundaries of the said Pumping District.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Wolf Creek Pumping District #2, that a special tax and/or assessment in the sum of $ 12,000 be levied against all the tracts of land, lots, railroad companies, and public highways within said Pumping District and same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon

WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies, and public highways within the boundaries of the said Pumping District.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Wolf Creek Pumping District #3, that a special tax and/or assessment in the sum of $ 3,000 be levied against all the tracts of land, lots, railroad companies, and public highways within said Pumping District and same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Dave Dorsett and Kurt Peterson, from the City of Sioux City, addressed the Board in regards to County spaces at City cemeteries for burial of indigent people. They provided a list of charges with proposed increases for the County.

The Board adjourned the regular meeting until May 29, 2007.
