OCTOBER 2, 2007FORTIETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, October 2, 2007 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, and Monson; Walish was absent. Staff members present were Karen James, Board Administrator and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Boykin second by Monson to approve the Board minutes of the September 25, 2007 meeting as submitted. Carried 4-0. Copy filed.

The Board approved the reclassification of Ryan M. Weber, Assistant Director, Juvenile Detention Dept., $45,132/year, effective 09/21/2007. End of probation salary increase. Copy filed.

The Board approved the reclassification of John P. Pylelo, Administrator, Planning and Zoning Dept., $60,878/year, effective 09/24/2007. Per Board approval on 09/18/2007. Copy filed.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for a Temporary Male Correctional Officer, County Sheriff Dept. Entry level: D.S.A. $14.32/hour. Carried 4-0. Copy filed.

The Board discussed flu vaccinations for County employees, with J. D. Pellersels, Human Resource Director.

Motion by Boykin second by Monson to approve providing flu vaccinations for County employees with funding provided from previous source. Carried 4-0.

Motion by Boykin second by Monson to refund erroneously paid taxes to Kathy Cole, in the amount of $592.00. Carried 4-0.

Motion by Boykin second by Monson to postpone for one week action to approve and authorize the Chairman to sign a Resolution to end future tax abatement for the Gospel Mission, real estate parcels #894729288004, #89472928806, #8947292988010, #8947292988013, #894729288014, and #894729288015. Carried 4-0.

Motion by Monson second by Boykin to approve a temporary removal of the embargo on Warrior Road, between Old Lakeport Road and Lewis Boulevard, for one month, to allow the movement of grain during harvest, per recommendation of the County Engineer. Carried 4-0.

Motion by Boykin second by Batcheller to receive and approve the quote of Ten Point Construction, 2212 Hwy 59, Denison, Iowa, for full depth concrete patching at various locations, for a total price of $78,979.00, per recommendation by the County Engineer. Carried 4-0. Copy filed.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a proposal from HGM Associated for engineering services involving bridge plans and grading for future paving of Glen Ellen (from County Route D-25 to Elk Creek Road), per recommendation by the County Engineer. Carried 4-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a contract, and approve bonds, for project #BRS-CO97(80)60-97, with Elk Horn Construction Company, Sergeant Bluff, Iowa, per recommendation by the County Engineer. Carried 4-0. Copy filed.

A public hearing and sale was held at 10:15 a.m. for parcel #278160 (3046 Melrose Avenue) The Chairman called on anyone wishing to be heard.

Motion by Boykin second by Batcheller to close the public hearing, as there was no one to be heard. Carried 4-0.

Motion by Batcheller second by Monson to accept the bid of $100.00, plus recording fees, from Gary Ostermeyer. Carried 4-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By GARY OSTERMEYER AND CAROL OSTERMEYER, AS JOINT TENANTS AND NOT AS TENANTS IN COMMON in the sum of ONE HUNDRED & 00/100 ($100.00)-------------------------------------------------------------------------------------------------------------- dollars.

For the following described real estate, To Wit:

Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).
BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Rob Marqusee, Economic Development Director, presented the Board with the rollout of the joint County, Chamber, and City Organic Market Project, with a web presentation.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Woodbury County Treasurer Bob Knowler clarified questions on a resolution to end future tax abatement for the Gospel Mission previously considered.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution to end future tax abatement for the Gospel Mission, real estate parcels #894729288004, #89472928806, #8947292988010, #8947292988013, #894729288014, and #894729288015. Carried 4-0.

RESOLUTION ENDING ABATEMENT OF FUTURE TAXES

WHEREAS, the Sioux City Gospel Mission is the titleholder of real estate Parcel #894729288004, #89472928806, #8947292988010, #8947292988013, #894729288014, #894729288015 located in Woodbury County, Iowa and legally described as follows:

WHEREAS, accumulated current and delinquent taxes were abated on the above stated parcels. Future taxes that may be levied were also abated on the above listed parcels.

WHEREAS, it has come to the attention of the Board of Supervisors that the tax abatement should have been done pursuant to Iowa Code section 427.8 and not under 445.63. Furthermore, Iowa Code section 427.8 limits the Boards ability to abate taxes to prior years and to the current year. It does not give the Board the authority to abate taxes for future years.

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby ends the future tax abatement granted to the Sioux City Gospel Mission and hereby directs the Woodbury County Treasurer to assess and collect all future taxes, other than that of the current year, owed to the above stated parcels, unless a further tax abatement is granted. The Sioux City Gospel Mission may continue to petition each year for a tax suspension or tax abatement pursuant to Iowa Code section 427.8.
