OCTOBER 16, 2007FORTY-SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, October 16, 2007 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, and Walish; Batcheller was absent. Staff members present were Denise Fletcher, Executive Secretary/Public Bidder, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Monson second by Boykin to approve the Board minutes of the October 9, 2007 meeting as submitted. Carried 4-0. Copy filed.

The Board approved the reclassification of Kenneth E. Grimes, Correctional Officer, County Sheriff Dept., $16.09/hour, effective 10/23/2007. Per DSA contract agreement, from Class 2 to Class 1. Copy filed.

The Board approved the reclassification of Carrie A. Klosterman, Clerk/Secretary, Social Services Dept., $13.23/hour, effective 10/27/2007. Per Wage Plan comparison with AFSCME Courthouse contract, from Grade 4, Step 2 to Grade 4, Step 3. Copy filed.

The Board approved the appointment of Larry C. Swanberg, Assistant Building Superintendent, Building Services Dept., $42,500/year, effective 10/29/2007. Job vacancy reposted 09/06/2007. Entry level salary: $42,500/year. Copy filed.

The Board approved the reclassification of Brent R. Eickholt, Correctional Officer, County Sheriff Dept., $16.09/hour, effective 10/30/2007. Per DSA contract agreement, from Class 2 to Class 1. Copy filed.

Motion by Boykin second by Monson to approve lifting the tax suspension for Sophia K. McGinnis, 1211 S. Fairmont Street, Sioux City, Iowa, as this person in deceased. Carried 4-0.

Motion by Clausen second by Boykin to approve the following tax abatements, per recommendation of County Treasurer, Bob Knowler:

1. Parcel #8847-15-200-001, Keith Cuthbert-Life Estate, Kathy Cole An erroneous assessment, due to a parcel split. Taxes payable for 2006-2007: $592.00

2. Parcel #8644-23-400-901, Randal Phil Davis Building on leased land for a mobile home that has been removed and is no longer assessed. Taxes payable for 2006-2007: $119.00 plus interest.

3. Parcel #8944-32-156-902, Brian Keith Cannon - Building on leased land for a mobile home that is no longer being assessed. Taxes payable for 2006-2007: $54.00 plus interest.

4. Parcel #8947-23-200-956, Elbert Bottorff Building on leased land for a mobile home that has been removed and is no longer assessed. Taxes payable for 2006-2007: $72.00 plus interest.

5. Parcel #8947-23-200-947, Karey Alan Windle or Debra S. Windle Building on leased land for a mobile home that has been removed and is no longer assessed. Taxes payable for 2006-2007: $38.00 plus interest.

6. Parcel #8947-23-200-924, Michelle Lynn Weber Building on leased land for a mobile home that has been removed and is no longer assessed. Taxes payable for 2006-2007: $56.00 plus interest.

7. Parcel #8947-23-200-93, Michael Craig Richardson Building on leased land for a mobile home that has been removed and is no longer assessed. Taxes payable for 2006-2007: $27.00 plus interest.

Carried 4-0.

Motion by Boykin second by Monson to approve a Red Ribbon display in Trosper Hoyt for Red Ribbon Week for the month of October, per the request of Patty Redmond, Juvenile Court Services. Carried 4-0.

Motion by Boykin second by Clausen to approve a domestic abuse card display in the restrooms at Trosper Hoyt, per the request of Patty Redmond, Juvenile Court Services. Carried 4-0.


The Board discussed preliminary platting of Framax Acres Addition Subdivision, GIS #8747-05-200-001, 8747-05-200-002, 8747-05-200-006, and #8747-05-200-007, with John Pylelo, Planning and Zoning Administrator.

Motion by Monson second by Boykin to approve the preliminary plats for Framax Acres Addition Subdivision and forward them to the Zoning Commission for review and recommendations. Carried 4-0.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date of the former radio tower site, section 28 Wolf Creek Township (excess property). Carried 4-0.

RESOLUTION #10,207
WOODBURY COUNTY BOARD OF SUPERVISORS
NOTICE OF PROPERTY SALE

WHEREAS, Woodbury County, Iowa is the owner of Excess real estate described as follows:

Lot 13 and Except North 4.1 Feet of Lot 14 Block 6 of Town of Danbury.

NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors as follows:

1. That said Board proposes to sell the said real estate at public auction to be held on the 14th of November 2007, at 10:00a.m. CST at the site 201 1st Street, Danbury, Iowa.

2. That a public hearing on the aforesaid proposal shall be held on the 13th November 2007 at 10:17 a.m. CST in the Board of Supervisors Meeting Room on the first floor of the Woodbury County Courthouse.

3. The said Board proposes to sell said real estate to the highest bidder at or above the minimum bid of $12,000.00.

4. The bidder submitting the bid accepted by the Board may pay in cash or cashiers check made out to the Woodbury County Treasurer c/o Secondary Roads. Payment is expected by 3:00 p.m. November 16, 2007 at the office of the Woodbury County Engineer, Room 502 Courthouse.

5. That the sale of the said real estate, shall be subject to easement of record, existing utilities, zoning regulations and upon the conditions that the tract, parcel, or piece of the land so sold shall not cause material damage to the adjacent owner(s).

Motion by Clausen second by Monson to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date of the former County maintenance facility in Danbury, Iowa (excess property). Carried 4-0.

WOODBURY COUNTY BOARD OF SUPERVISORS
NOTICE OF PROPERTY SALE

WHEREAS, Woodbury County, Iowa is the owner of Excess real estate described as follows:

All that part of the NE of the SW Section 28, Township 88 North, Range 44 West of the Fifth Principal Meridian, Woodbury County, Iowa, described as follows:

Beginning at a point 1321.9 feet North of the S Corner of Section 28, T88N, R44W of the fifth principal meridian, Woodbury County, Iowa. Thence West 533.0 feet on the South line of the NESW of Section 28, thence North 500.0 feet, thence East 533.0 feet to the East line of the NESW of Section 28, thence South 500.0 feet to the point of beginning. Said tract lies in the NESW of Section 28, T88N, R44W containing 6.12 acres, more or less, NOTE: The section centerline of Section 28, T88N, R44W is assumed to bear North-South.

NOW THEREFORE,

BE IT RESOLVED by the Woodbury County Board of Supervisors as follows:

1. That said Board proposes to sell the said real estate at public auction to be held on the 13th of November 2007, immediately following the closing of the public hearing.

2. That a public hearing on the aforesaid proposal shall be held on the 13th November 2007 at 10:15 a.m. CST in the Board of Supervisors Meeting Room on the first floor of the Woodbury County Courthouse.

3. The said Board proposes to sell said real estate to the highest bidder at or above the minimum bid of $21,500.00.

4. The bidder submitting the bid accepted by the Board may pay in cash or cashiers check made out to the Woodbury County Treasurer c/o Secondary Roads. Payment is expected by 3:00 p.m. the day of the sale at the office of the Woodbury County Engineer, Room 502 Courthouse.

5. That the sale of the said real estate, shall be subject to easement of record, existing utilities, zoning regulations and upon the conditions that the tract, parcel, or piece of the land so sold shall not be used in any manner so as to interfere with the use of the highway by the public or endanger public safety in the use of the highway, or the material damage to the adjacent owner(s).

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Larry Reynolds, Salix, addressed the Board with a drainage issue on his property.

The Board adjourned the regular meeting until October 23, 2007.
