JANUARY 8, 2008SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, January 8, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Meeting called to order.

Motion by Batcheller second by Monson to approve the Board minutes of the January 2, 2008 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the appointment of Douglas L. Walish, Board Chairman, Board of Supervisors, $34,979/year, effective 01/02/2008. Copy filed.

The Board approved the appointment of William E. Adkins, Temporary Equipment Operator, Secondary Roads Dept., $16.55/hour, effective 01/02/2008. Amended hire date from 12/12/2007 to 01/02/2008. Not to exceed 120 days.

The Board approved a leave of absence for Vincent T. Dvorak, Correctional Officer, County Sheriff Dept., effective 01/03/2008. Leave of absence due to military activation. Copy filed.

The Board approved the reclassification of Jermaine Greenaway, Part-time Youth Worker, Juvenile Detention Dept., $14.99/hour, effective 01/04/2008. Per AFSCME JD contract agreement from Grade 1, Step 2 to Grade 1, Step 3. Copy filed.

The Board approved the reclassification of Molly M. Haberer, Part-time Youth Worker, Juvenile Detention Dept., $14.99/hour, effective 01/11/2008. Per AFSCME JD contract agreement from Grade 1, Step 2 to Grade 1, Step 3. Copy filed.

The Board approved the reclassification of Lisa M. Hudson, Payroll/Claims Clerk II, County Auditor/Recorder Dept., $13.01/hour, effective 01/20/2008. Per AFSCME Courthouse contract agreement from Grade 3, Step 2 to Grade 3, Step 3. Copy filed.

The Board approved the reclassification of Troy M. Milligan, Correctional Officer, County Sheriff Dept., $17.83/hour, effective 01/31/2008. Per DSA contract agreement from Class 1 to Senior Class. Copy filed.

The Board discussed premium and claim history for Woodbury County workers compensation insurance with J. D. Pellersels, Human Resources Director.

Motion by Boykin second by Clausen to approve the payment of Woodbury County workers compensation insurance with United Heartland in the amount of $346,529.00, per recommendation of the Human Resources Director. Carried 5-0.

Motion by Boykin second by Batcheller to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date of real estate parcel #069315 (2728 S. Lakeport Street). Carried 5-0.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 22nd Day of January, 2008 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 22nd Day of January, 2008, immediately following the closing of the public hearing to Clark Godfrey only per Code of Iowa 331.361 (2).

3. That said Board proposes to sell the said real estate to Clark Godfrey only
for consideration of $1.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

2. That said Board proposes to sell the said parcel of real estate on the 22nd Day of January, 2008, immediately following the closing of the public hearing to the City of Sioux City only per Code of Iowa 331.361 (2).

3. That said Board proposes to sell the said real estate to the City of Sioux City only for consideration of $1.00 plus recording fees.

Motion by Monson second by Boykin to approve and receive for signatures, a 12-month, Class E liquor license with carry-out beer/wine, and Sunday sales privileges, for Heritage Express/Winnavegas, 1501 330th Street, Sloan, Iowa, effective 01/18/2008 through 01/17/2009. Carried 5-0. Copy filed.

Motion by Batcheller second by Monson to receive the Semi-Annual Report of Funds in the Hands of the County Treasurer at close of business on 12/31/2007, as submitted. Carried 5-0. Copy filed.

The Board reviewed preliminary platting for Deer Meadows Estates Addition Subdivision with John Pylelo, County Planning and Zoning Administrator.

Motion by Boykin second by Batcheller to approve the preliminary platting for Deer Meadows Estates Addition Subdivision, GIS parcels #8942-28-200-002, #8942-28-200-003, and #8942-28-200-007, and forward it to the Zoning Commission for public hearing and recommendations. Carried 5-0.

The Board reviewed preliminary platting for Lost Acres Addition Subdivision with John Pylelo, County Planning and Zoning Administrator.

Motion by Boykin second by Monson to approve the preliminary platting for Lost Acres Addition Subdivision, portion of GIS parcels #8644-28-100-004 and #8644-21-300-005, and forward it to the Zoning Commission for public hearing and recommendations. Carried 5-0.

The Board reviewed platting for Wingert Addition Subdivision with John Pylelo, County Planning and Zoning Administrator.

Motion by Boykin second by Clausen to approve the Zoning Commissions recommendation on the preliminary platting for Wingert Addition Subdivision, and approve the final platting and forward it to the Zoning Commission for review and recommendations. Carried 5-0.

The Board reviewed Zoning Commission recommendations and final platting for Harrisons replat of Lot 6 and part of Lot 7 of Harrison Addition Subdivision with John Pylelo, County Planning and Zoning Administrator.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign the final plat and Resolution for Harrisons replat of Lot 6 and part of Lot 7 of Harrison Addition Subdivision, per recommendation by the Zoning Commission. Carried 5-0.

RESOLUTION # 10,230

Resolution accepting and approving Harrisons replat, a replat of part of Lot 6 and the north 25 feet of Lot 7A of Harrisons Subdivision in Section 17, T89N, R46W, Woodbury County, Iowa.

WHEREAS, the owner and proprietor did on the 1st day of December, 2007 file with the Woodbury County Zoning Commission a certain plat designated as Harrisons Replat, a replat of part of Lot 6 and the north 25 feet of Lot 7A of Harrisons Subdivision in Section 17, T89N, R46W, Woodbury County, Iowa; and

WHEREAS, it appears that said plat confirms with all of the provisions of the code of the State of Iowa and ordinances of Woodbury County, Iowa, with references to the filing of same; and

WHEREAS, the Zoning Commission of Woodbury County, Iowa has recommended the acceptance and approval of said plat; and

WHEREAS, the County Engineer of Woodbury County, Iowa has recommended the acceptance and approval of said plat.

NOW THEREFORE, be and it is hereby resolved by the Woodbury County Board of Supervisors, Woodbury County, Iowa, that the plat of Harrisons replat, a replat of part of Lot 6 and the north 25 feet of Lot 7A of Harrisons Subdivision in Section 17, to Woodbury County, Iowa be, and the same is hereby accepted and approved, and the Chairman and Secretary of the Woodbury County Board of Supervisors, State of Iowa, are hereby directed to furnish to the owner and proprietor a certified copy of this Resolution as required by law.

The Board discussed Woodbury Countys deferred compensation plan with Sharese Manker, Klass Law Firm.

Motion by Batcheller second by Boykin to approve termination of the current Woodbury County Deferred Compensation Plan. Carried 5-0.

Motion by Monson second by Boykin to approve adopting NACO/Nationwide as the deferred compensation plan carrier for Woodbury County. Carried 5-0.

Rick Schneider presented the Board with the Conservation Departments annual report.

Motion by Boykin second by Monson to receive the Woodbury County Conservation Board annual report. Carried 5-0.

Jeff Peters, Williams and Company, presented the Board with the 2007 Woodbury County Audit.

Motion by Batcheller second by Boykin to receive the 2007 Woodbury County comprehensive annual financial report. Carried 5-0.

Motion by Monson second by Batcheller to receive and approve plans for project #L-GR08(1)73-97, per recommendation of the County Engineer. Carried 5-0.

Motion by Batcheller second by Boykin to receive the County Engineers recommendation to revise fence removal/replacement reimbursement costs for projects. Carried 5-0.

The Board discussed a grant through Criminal and Juvenile Justice Grant, with James France, SHIP, Mark Olsen, Juvenile Detention, and Gary Miles, Juvenile Court Services.

Motion by Boykin second by Monson to approve application for an $80,000.00 state funds grant through CJJDP, to be used to reduce minority confinement in the Woodbury County Juvenile Detention Center. Carried 5-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Kevin Miller, Lawton, asked the Board to prepare for a large crowd to attend a hearing on January 29th.

Mr. Clausen excused himself at 11:30 A.M.

Motion by Batcheller second by Monson per the request of the employee to go into closed session for a performance evaluation, per Iowa Code 21.5 (1) (i). Carried 4-0 on a roll-call vote.

Motion by Boykin second by Batcheller to go out of closed session for a performance evaluation, per Iowa Code 21.5 (1) (i). Carried 4-0 on a roll-call vote.

The Board adjourned the regular meeting until January 15, 2008.
