AUGUST 5, 2008THIRTY-FIRST MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 5, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Boykin to approve the Board minutes of the July 29, 2008 meeting as submitted Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to approve the Board minutes of the July 28, 2008 special meeting as submitted Carried 4-0; Boykin abstained. Copy filed.

The Board approved the appointment of Scott N. Mueggenberg, Full-time Youth Worker, Juvenile Detention Dept., effective 08/06/2008. In-house job posting 07/22/2008. From part-time to full-time at current wage. Copy filed.

The Board approved the appointment of Jesse J. Lieber, Part-time Youth Worker, Juvenile Detention Dept., $14.50/hour, effective 08/06/2008. Job vacancy posted 06/16/2008. Entry level wage $14.50/hour, per fiscal year 2008-2009. Copy filed.

The Board approved the reclassification of Kent W. Roepke, Senior Deputy Sheriff, County Sheriff Dept., $24.04/hour, effective 08/21/2008. Per DSDOA contract agreement, from Class 1 to Senior Class. Copy filed.

The Board approved the reclassification of Todd A. Trobaugh, Senior Deputy Sheriff, County Sheriff Dept., $24.04/hour, effective 08/21/2008. Per DSDOA contract agreement, from Class 1 to Senior Class. Copy filed.

The Board approved the separation of Richard J. Storm, County Engineer, Secondary Roads Dept., effective 12/31/2008. Retirement. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign an Authorization To Initiate Hiring Process for:

County Engineer, Secondary Roads Dept. Entry level: Wage plan: to be determined, based on experience.

Part-time Male Youth Worker, Juvenile Detention Dept. Entry level: AFSCME J. D. $14.50/hour.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign an agreement for a long term disability plan combination of all classes into one titled All Eligible Employees for FY 08/09. Carried 5-0.

Jack Lipovac, HR One Source, presented the Board with information on services HR One Source offers municipal and county governments in the administrative position hiring process.

A public hearing was held at 10:15 a.m. for the sale of parcel #223170 (205 Leonard Street). The Chairman called on anyone wishing to be heard.

Chris Strong called to the attention of the Board a problem with the address contained in the publication.

Motion by Monson second by Batcheller to close the hearing. Carried 5-0.

Motion by Boykin second by Batcheller to postpone action to sell parcel #223170 (205 Leonard Street). Carried 5-0.

A public hearing was held at 10:17 a.m. for the sale of parcel #223350 (2514 W. 3rd Street). The Chairman called on anyone wishing to be heard.

Motion by Boykin second by Clausen to close the hearing. Carried 5-0.

Jack Strong bid $300.00, David Berger bid $500.00, Jack Strong bid $600.00, David Berger bid $700.00.

Motion by Clausen second by Boykin to accept the bid from David Berger in the amount of $700.00 plus recording fees, for parcel #223350 (2514 W. 3rd Street). Carried 5-0.

1. That a public hearing on the aforesaid proposal shall be held on the 26th Day of August, 2008 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 26th Day of August, 2008, immediately following the closing of the public hearing.

WHEREAS, the above stated property has an unpaid balance of taxes owing, and the parcel is owned by a political subdivision of the state; and

WHEREAS, the political subdivision, namely the Woodbury County, Iowa, is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes and any future taxes that may be levied against this parcel; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcels according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

BOARD OF SUPERVISORS RESOLUTION
RESOLUTION NO. 10,464

RESOLUTION ACCEPTING AND APPROVING MARX DEVELOPMENT, AN ADDITION TO WOODBURY COUNTY, IOWA.

WHEREAS, THE OWNERS AND PROPRIETORS DID ON THE 1ST DAY OF JULY 2008, FILE WITH THE WOODBURY COUNTY ZONING COMMISSION A CERTAIN PLAT DESIGNATED AS MARX DEVELOPMENT, AN ADDITION TO WOODBURY COUNTY, IOWA; AND

WHEREAS, IT APPEARS THAT SAID PLAT CONFORMS WITH ALL OF THE PROVISIONS OF THE CODE OF THE STATE OF IOWA AND ORDINANCES OF WOODBURY COUNTY, IOWA, WITH REFERENCE TO THE FILING OF SAME; AND

WHEREAS, THE ZONING COMMISSION OF WOODBURY COUNTY, IOWA HAS RECOMMENDED THE ACCEPTANCE AND APPROVAL OF SAID PLAT; AND

Doug Noble, Juvenile Court Services, discussed with the Board a 28E agreement between Woodbury County, Siouxland Human Investment Partnership, and Juvenile Court Services regarding the disbursement of funding for at-risk children.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign a 28E agreement between Woodbury County, Siouxland Human Investment Partnership, and Juvenile Court Services regarding the disbursement of funding for at-risk children. Carried 4-0; Boykin abstained. Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The Board adjourned the regular meeting until August 12, 2008.
