AUGUST 19, 2008THIRTY-THIRD MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 19, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Denise Fletcher, Executive Secretary/Public Bidder, Loan Hensley, Assistant County Attorney/Board Legal Counsel and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Batcheller to approve the Board minutes of the August 12, 2008 meeting as submitted. Carried 5-0. Copy filed.

The Board discussed influenza vaccination shots for County employees with J. D. Pellersels, Human Resources Director.

Motion by Monson second by Batcheller to approve and authorize influenza vaccination shots for County employees who wish to participate. Carried 5-0.

Motion by Batcheller second by Monson to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date of property parcels #063720 and #093615 (aka 1205 and 1209 17th Street). Carried 5-0.

NOTICE OF PROPERTY SALE
Parcel #063720 & #093615

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

That part of Lot 11 Bellevue Addition to Sioux City, Iowa, and that part of Lot 8, Block 2, Chase and Taylors Addition to Sioux City, Iowa described as follows to-wit: Beginning at a point on the North line of 17th St., formerly known as Ash Street, which point is 49.8 feet East and 12.4 feet South of the Southwest corner of Lot 11, Bellevue Addition to Sioux City, Iowa; thence north parallel with the west line of said Lot 11 120.40 feet; thence with an angle to the right of 112 degrees 30 for 43.75 feet; thence with an angle to the right of 67 degrees 30 for 92.4 feet to the South Line of said Lot 11; thence East on the South line of said Lot 11 for 3.7 feet to the center of a private alley; thence southwesterly along the center of said private alley, 29.3 feet to the North line of said 17th Street; thence with an angle to the right of 69 degrees for 25.5 feet along the North side of said 17th Street to the place of beginning. NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 2nd Day of September, 2008 at 10:16 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 2nd Day of September, 2008, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $300.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

Motion by Clausen second by Boykin to approve lifting tax suspension for Verena Taylor as the property has been sold. Carried 5-0.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution approving abatement of taxes for Siouxland Planning and Transit Services LLC, parcel #894728132001. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, Siouxland Planning and Transit Services LLC is the titleholder of real estate Parcel #894728132001 located in Woodbury County, Iowa and legally described as follows:

Parcel # 894728132001

Lots One (1) to Three (3) Incl. Block Sixty-five (65) Sioux City East Addition, City of Sioux City, Woodbury County, Iowa

WHEREAS, the above stated property has taxes owing for the 2007/2008, tax year and the parcel is owned by Siouxland Planning and Transit Services LLC and

WHEREAS, the organization, namely the Siouxland Planning and Transit Services LLC is failing to immediately pay partial taxes due of $12,805.86; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates $12,805.86 of the taxes owing on the above parcel according to Code of Iowa, 427.8 for the taxes owed for the 2007-2008 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Notice to Terminate Farm Tenancy to Frank Welte II. Carried 5-0.

LaRae Lyons presented the Board with a new General Assistance manual.

Motion by Batcheller second by Monson to approve the new General Assistance manual as submitted. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by the City of Sioux City, per recommendation of Richard Storm, County Engineer. The permit requests permission to install an 8 waterline from Gordon Drive along sections of Garretson Avenue in the East Morningside Subdivision. Carried 5-0. Copy filed.

Motion by Batcheller second by Clausen to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by David Blutt, per recommendation of Richard Storm, County Engineer. The permit requests permission to install a septic tank line across a section of a platted alley. Carried 5-0. Copy filed.

Motion by Clausen second by Batcheller to approve and award the bid for bridge maintenance repairs to Kooiker, Incorporated, in the amount of $73,980.00, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Monson second by Batcheller to approve and authorize the installation of additional Share the Roadway signs on various County routes, as requested by the Siouxland Trail Foundation, per recommendation of the County Engineer. Carried 5-0.

The Board reviewed final platting for Framax Acres Addition Subdivision GIS #874705200001, #874705200002, #874705200006, and #874705200007, with John Pylelo, Planning and Zoning Administrator.

Motion by Batcheller second by Boykin to postpone action for three weeks to approve and authorize the Chairman to sign the final plat and Resolution for Framax Acres Addition Subdivision GIS #874705200001, #874705200002, #874705200006, and #874705200007. Carried 5-0.

Motion by Clausen second by Boykin to approve and authorize the Chairman to sign a Resolution setting a public hearing date for leasing tower space for StarCom to SiouxLAN on September 2, 2008 at 10:20 a.m. Carried 5-0.

NOTICE OF PUBLIC HEARING

WHEREAS, Siouxland Tri-State Area Radio Communications System (STARCOMM) provides public safety radio services to Woodbury County, Iowa, Dakota County, Nebraska, Union County, South Dakota, the City of Sioux City, Iowa, the City of Sergeant Bluff, Iowa, the City of North Sioux City, South Dakota, and the City of South Sioux City, Nebraska; and,

WHEREAS, Woodbury County telecommunications tower and shelter located at 4647 Stone Avenue, Sioux City, Iowa; as part of the communications system operated by STARCOMM; and,

WHEREAS, Woodbury County is authorized by Ordinance No. 21 to offer to a private telecommunication enterprise, which competes with other businesses in the telecommunications industry, the opportunity to lease space on the telecommunications tower owned by Woodbury County and operated by STARCOMM for telecommunications equipment and lease space for equipment in the shelter owned by Woodbury County and operated by STARCOMM; and,

WHEREAS, Section 331.361(2) of the Code of Iowa grants Woodbury County the power to dispose of interests in real property by lease

IT IS HEREBY RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposed lease shall be held on the 2nd day of September, 2008 at 10:20 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to lease the said property to SiouxLAN for a term of ten (10) years for at least $1250.00 per month, following the closing of the public hearing.

3. That said leases are available for public inspection in the Board of Supervisors Office in the Woodbury County Courthouse located at 620 Douglas Street, Sioux City, Iowa 51101.

4. That this resolution, preceded by the caption Notice of Public Hearing be published as notice of the aforesaid proposal, hearing and action.
