SEPTEMBER 2, 2008THIRTY-FIFTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 2, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Batcheller to approve the Board minutes of the August 26, 2008 meeting as submitted. Carried
5-0. Copy filed.

The Board approved the reclassification of Kristine M. Rupp, Assistant County Attorney, County Attorney Dept., $53,686/year, effective 09/17/2008. Per AFSCME Assistant Attorney Contract, from Step 3 to Step 4. Copy filed.

The Board approved the separation of Jason J. McManigal, Civilian Jailer, County Sheriff Dept., effective 09/21/2008. Resignation. Copy filed.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process form for:

Human Resources Clerk II, Human Resources Dept.
Entry level: wage plan comparison with AFSCME Courthouse Contract Grade 3, Step 1 $12.56/hour.

Male Civilian Jailer, County Sheriff Dept.
Entry level: DSDOA $16.16/hour.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Utility Accommodation Permit submitted by Hi-Tech Electric LLC on behalf of Qwest Communications per recommendation of Richard Storm, County Engineer, to install 2,500 feet of underground phone line to a residence on 320th Street. Carried 5-0. Copy filed.

Motion by Batcheller second by Boykin to award the bid for three half-ton four-wheel drive pick-up trucks for Secondary Roads to Barry Motor for pick-up for Districts #2, #4 and #5, for a total of $55,290.00. Carried 5-0. Copy filed.

The Board discussed with County Treasurer Bob Knowler, a lease for Motor Vehicle customer parking.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Resolution approving tax abatement for the City of Moville for parcel #894432106002. Carried 5-0.

RESOLUTION APPROVING ABATEMENT OF TAXES

WHEREAS, the City of Moville is the titleholder of real estate Parcels #894432106002 located in Woodbury County, Iowa and legally described as follows:

Parcel #894432106002

East Twenty-five feet (25) of the North Half of Lot Two (2) and the North Half of Lot Three (3) all in Block Four (4) Jones First Addition, City of Moville, Woodbury County, Iowa

WHEREAS, the above stated property has an unpaid balance of taxes owing, and the parcels are owned by a political subdivision of the state; and

WHEREAS, the City of Moville requests the Board of Supervisors abate the tax representing that part of the taxes after which the City of Moville was in sole possession; and

WHEREAS, the political subdivision, namely the City of Moville is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes;

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcel according to Code of Iowa, 427.8 for the taxes owed for the 2008-2009 tax year and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

The W. 50 Ft. of Lots 7, 8, and 9 in Block 78, Sioux City East Addition,
City of Sioux City, Woodbury County, IA

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on
the 16th Day of September, 2008 at 10:15 oclock a.m. in the meeting
room of the Board of Supervisors on the first floor of the Woodbury
County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a
public auction to be held on the 16th Day of September, 2008, immediately
following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest
bidder at or above a total minimum bid of $2000.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale'
and except for this subparagraph 4 be published as notice of the
aforesaid proposal, hearing and sale.

Motion by Clausen second by Monson to close the hearing. Carried 5-0.

Danny Robinson bid $300.00.

Motion by Batcheller second by Monson to accept the bid of Danny Robinson in the amount of $300.00, plus recording fees, for property parcels #063720 and #093615 (aka 1205 and 1209 17th Street). Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By DANNY LEE ROBINSON in the sum of THREE HUNDRED & 00/100 ($300.00)------------------------- dollars.

For the following described real estate, To Wit:

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Batcheller second by Monson to close the hearing. Carried 5-0.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a lease agreement between Woodbury County, StarComm Public Safety Board, and the City of Sioux City, with SiouxLAN Communication, for tower space located at 3430 W. 23rd Street,, for StarComm. Carried 5-0. Copy filed.

A public hearing was held at 10:25 a.m. regarding the lease of tower space for StarComm from Alltel Communications. The Chairman called on anyone wishing to be heard.

Motion by Clausen second by Batcheller to close the hearing. Carried 5-0.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a lease agreement between Woodbury County, StarComm Public Safety Board, and the City of Sioux City, with Alltel Communication, for tower space located in the vicinity of 4647 Stone Avenue, for StarComm. Carried 5-0. Copy filed.

A public hearing was held for paving and parking renovations at the Law Enforcement Center. The Chairman called on anyone wishing to be heard.

Motion by Clausen second by Monson to close the hearing. Carried 5-0.
