OCTOBER 7, 2008FORTIETH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, October 7, 2008 at 9:00 a.m. Board members present were Batcheller, Boykin, Clausen, Monson, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Batcheller to approve the Board minutes of the September 30, 2008 meeting as submitted. Carried 5-0. Copy filed.

The Board approved the reclassification of Carrie A. Klosterman, Clerk/Secretary, Social Services Dept., $14.55/hour, effective 10/27/2008. Per Wage Plan comparison with AFSCME Courthouse Grade 3, Step 3 to Grade 3, Step 4. Copy filed.

The Board approved the reclassification of Gerald W. Yaremko, Equipment Operator, Secondary Roads Dept., $17.91/hour, effective 10/30/2008. Per CWA contract agreement, end of probation salary increase. Copy filed.

The Board discussed with Caroline Tompkins, Safety/Risk Coordinator, the purchase of emergency evacuation chairs for three County buildings.

Motion by Boykin second by Monson to approve the purchase of three emergency evacuation chairs for three County buildings funded from River Boat funds. Carried 5-0.

The Board discussed with Mark Olsen, Juvenile Detention Director, the use of $15,000.00 of State reimbursements in the Juvenile Detention Emergency Prevention Fund.

Motion by Boykin second by Monson to approve the use of $15,000.00 of State Reimbursements by the Juvenile Detention Emergency Prevention Fund. Carried 5-0.

Motion by Monson second by Clausen to approve and authorize the Chairman to sign a Resolution setting the date for a public hearing and sale of property parcel #027795 (312 13th Street). Carried 5-0.

1. That a public hearing on the aforesaid proposal shall be held on the 21st Day of October, 2008 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 21st Day of October, 2008, immediately following the closing of the public hearing.

The Board discussed with Rural Economic Development Director Rob Marqusee, a loan to Mid States Electric, as a match to a CEBA Grant, to relocate in Woodbury County. The loan amount would be a maximum of $33,000.00.

Motion by Batcheller second by Boykin to approve and authorize the Chairman to sign a Resolution approving a loan to Mid States Electric as a CEBA Grant match, per recommendation of Rural Economic Development Director Rob Marqusee. Carried 5-0.

WOODBURY COUNTY, IOWA
RESOLUTION NO. 10,493
A RESOLUTION APPROVING LOAN TO MID STATES ELECTRIC
AS A MATCH TO CEBA GRANT PROVIDED BY STATE OF IOWA

WHEREAS, Mid States Electric Company, Inc., a Nebraska Corporation, desires to relocate to Woodbury County, State of Iowa, at the Stockmens Building at 1658 Hwy 20. Mid States Electric will house its 12-member management and project team at that site, and will hire a significant number of skilled employees to perform electrical work on large scale projects throughout the Midwest; and

WHEREAS, Mid States Electric has applied to the Iowa Department of Economic Development for financial assistance under the Community Economic Betterment Account program, that requires a 20% match from local sources; and

WHEREAS, Woodbury County is a duly recognized political subdivision of the State of Iowa acting under the laws of the State of Iowa; and

WHEREAS, the Board of Supervisors is the duly elected governing body of Woodbury County, Iowa; and
WHEREAS, the Board of Supervisors is in full support of the application for Mid States Electric Company, Inc. to the Iowa Department of Economic Development, with the local match coming from the following source: Woodbury County.

IT IS HEREBY RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. The Board of Supervisors is hereby directed and authorized to execute a CEBA grant application to be submitted to the Iowa Department of Economic Development disclosing Woodbury Countys commitment to provide a 20% matching loan (up to a maximum amount of $33,000), as required by the Iowa Department of Economic Development, for the relocation of Mid States Electric Company, Inc. to Woodbury County, Iowa, in accordance with the terms set forth in Paragraph 2 below.

2. The loan from Woodbury County to Mid States Electric Company, Inc. shall be in the amount of 20% of the State of Iowas CEBA grant, up to a maximum of $33,000, at 0% interest, with principal payable in equal monthly installments over a term of 5 years. The loan shall be represented by a secured note and recorded in the Woodbury County Recorders Office.

Motion by Clausen second by Monson to defer action to approve a request received via letter from the City of Oto for paving a section of Royal Avenue and Lenox Avenue to Highway 31, per recommendation of the County Engineer. Carried 5-0.

Motion by Boykin second by Clausen to approve and authorize the Chairman to sign an application for use of highway right-of-way requested by Lundell Construction on behalf of Brian Ashley, to install a tile crossing, per recommendation of Richard Storm, County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to approve lifting the embargo on Warrior Road between Old Lakeport Road and Lewis Boulevard from 10/08/2008 to 11/14/2008, per recommendation of the County Engineer. Carried 5-0.

The Board discussed the recommendation of Richard Storm, County Engineer, that the County Landfill proceed with the sale of their dozer, and that Secondary Roads budget for a new dozer and trade-in their existing dozer.

The Board discussed with Richard Storm, County Engineer, long range transportation plans submitted to SIMPCO.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Rick Schneider, Woodbury County Conservation Director, discussed the acquisition of property near Little Sioux Park.

The Board adjourned the regular meeting until October 14, 2008.
