NOVEMBER 25, 2008FORTY-SIXTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, November 25, 2008 at 9:00 a.m. Board members present were Batcheller, Clausen, Monson, and Walish; Boykin was absent. Staff members present were Denise Fletcher, Public Bidder, Loan Hensley, Assistant County Attorney/Board Legal Counsel, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Batcheller to approve the Board minutes of the November 18, 2008 meeting as submitted. Carried 4-0. Copy filed.

Motion by Batcheller second by Monson to approve the Board minutes of the 1st executive session held November 17, 2008 as submitted. Carried 4-0. Copy filed.

Motion by Monson second by Clausen to approve the Board minutes of the 2nd executive session held November 17, 2008 as submitted. Carried 4-0. Copy filed.

Motion by Clausen second by Batcheller to approve the Board minutes of the 3rd executive session held November 17, 2008 as submitted. Carried 4-0. Copy filed.

Motion by Monson second by Batcheller to approve the Board minutes of the 1st executive session held November 18, 2008 as submitted. Carried 4-0. Copy filed.

Motion by Batcheller second by Monson to approve the Board minutes of the 2nd executive session held November 18, 2008 as submitted. Carried 4-0. Copy filed.

Motion by Clausen second by Monson to approve the Board minutes of the 3rd executive session held November 18, 2008 as submitted. Carried 4-0. Copy filed.

The Board approved the separation of Marti S. Sleister, Assistant County Attorney, effective 11/28/2008. Adjusted date of resignation, from 12/12/2008 to 11/28/2008. Copy filed.

The Board approved the appointment of James L. Moravek, Part-time Youth Worker, Juvenile Detention Dept., $14.50/hour, effective 12/01/2008. Job vacancy posted 08/06/2008 and 09/23/2008. Entry level salary: $14.50/hour. Copy filed.

The Board approved the appointment of Lisa L. Anderson, Human Resources Clerk II, Human Resources Dept., $12.56/hour, effective 12/01/2008. Job vacancy posted 09/10/2008. Entry level salary: $12.56/hour. Copy filed.

The Board approved the reclassification of James D. Loomis, Assistant County Attorney, County Attorney Dept., $58,606/year, effective 12/01/2008. Per AFSCME Assistant Attorney contract agreement, from Step 5 to Step 6. Copy filed.

The Board approved the reclassification of Bobbier A. Johnson, Assistant County Attorney, County Attorney Dept., $53,686/year, effective 12/06/2008. Per AFSCME Assistant Attorney contract agreement, from Step 3 to Step 4. Copy filed.

The Board approved the separation of Mat R. Cook, Full-time Civilian Jailer, County Sheriff Dept., effective 12/13/2008. Resignation. Copy filed.

The Board approved the reclassification of Cynthia L. Foxhoven, Custodian, Building Services Dept., $14.29/hour, effective 12/15/2008. Per AFSCME Courthouse contract agreement, from Grade 1, Step 4 to Grade 1 Step 5. Copy filed.

The Board approved the separation of Annette H. Rasmussen, Tax Clerk II, County Treasurer Dept., effective 12/19/2008. Retirement. Copy filed.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign an Authorization to Initiate Hiring Process for:

(1) Male Civilian Jailer, County Sheriff Dept. Entry level: DSDOA $15.50/hour
(1) Tax Clerk II, County Treasurer Dept. Entry level: AFSCME Courthouse Grade 3, Step 1 $12.56/hour

The Board discussed the status of the Countys self-funded health/dental insurance plan with Ed Guilland, Gallagher Benefit Services.

Motion by Clausen second by Batcheller to approve the recommendation to increase the health insurance premium by 20% and the dental insurance premium by 15% beginning 1/1/2009. Motion carried 4-0.

Motion by Batcheller second by Monson to approve a request made by retiring County employee (12/19/2008) Annette H. Rasmussen, County Treasurers Tax Division, to allow her to remain on the Countys dental insurance plan at her own expense. Carried 4-0.

Motion by Monson second by Clausen to approve a request made by retiring County employee (12/31/2008) G. Robert Batcheller, Woodbury County Supervisors, to allow him to remain on the Countys health/prescription insurance plan at his own expense. Carried 3-0; Batcheller abstained.

The Board discussed the architects recommendation on the courthouse skylights project with Patty Erickson-Puttmann, Social Services Director.

Motion by Clausen second by Monson to approve and authorize the Chairman to sign a Resolution setting the public hearing and sale date for property parcel #398340 (3252 Court Street) on 12/09/2008 at 10:15 a.m.. Carried 4-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 9th Day of December, 2008 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 9th Day of December, 2008, immediately following the closing of the public hearing to Lance Webb and Nancy Webb only per Code of Iowa 331.361 (2).

3. That said Board proposes to sell the said real estate to Lance Webb and Nancy Webb only for consideration of $1.00 plus recording fees.

Motion by Monson second by Clausen to approve and authorize the Chairman to sign a River Valley Addition Urban Renewal Plan Agreement by and between Woodbury County, the City of Correctionville, Western Iowa Tech Community College, and River Valley Community School District, to approve the extension of the division of revenue under Iowa Code Section 403.19 in the River Valley Addition Urban Renewal Area for projects involving g the provision of public improvements related to housing and residential development for up to five additional years, for a total of fifteen years, to the extent that is necessary to adequately fund the project and to meet any low and moderate income assistance required under Section 403.22. Motion by Monson second by Clausen to approve and authorize the Chairman to sign Change Order #1 for the Law Enforcement Center paving project, per recommendation of Building Services Director Mark Elgert. Carried 4-0. Copy filed.

Motion by Clausen second by Monson to draw the funds from the general basic cash reserves to meet the expenses of Change Order #1 for the Law Enforcement Center paving project. Carried 4-0.

Bid letting was held at 10:20 a.m. for project #L-CO7(8)73-97. The bids were as follows:

LA Carlson Contracting, 20984 C-43, Merrill, IA $77,918.55

Midwest Contracting, PO Box 545, Marshall, MN $80,346.60

Motion by Batcheller second by Monson to receive the bids and submit them to County Engineer Richard Storm for review and recommendation. Carried 4-0. Copy filed.

Motion by Clausen second by Batcheller to approve and authorize the Chairman to sign a proposal from Certified Testing Services, Sioux City, IA for geotechnical investigation for project #BROS-CO97(92)5F-97, per recommendation from the County Engineer. Carried 4-0. Copy filed.

County Farm lease bid opening was held at 10:30 a.m. The bids were as follows:

Jochum Farm $161.00 ($31,137.00 for 193.4 acres for 2009 crop year)

David Molstad The value of 33 times the spring federal crop corn price (past year would have been $169.95/acre)

There were no other bids.

Motion by Batcheller second by Monson to receive the bids for review and act on them at a later date. Carried 4-0.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Paul E. Taylor addressed the Board about a Breach of Peace.

The Board adjourned the regular meeting until December 2, 2008.
