AUGUST 11, 2009THIRTY-SECOND MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 11, 2009 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, Smith, and Walish. Staff members present were Karen James, Board Administrator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Walish to approve the Board minutes of the 08/04/2009 meeting as submitted. Carried 5-0.

The Board approved the separation of Benjamin L. Handke, Temporary Engineering Aide, Secondary Roads Dept., effective 08/14/2009. End of temporary work. Copy filed.

The Board approved the reclassification of Margaret J. Napier, Clerk II, Planning and Zoning Dept., effective 09/01/2009. Per AFSCME Courthouse contract agreement, from Grade 3, Step 4 to Grade 3, Step 5. Copy filed.

The Board approved the reclassification of Jayme A. Kirsch, Assistant County Attorney, County Attorney Dept., effective 09/02/2009. Per AFSCME Assistant County Attorney contract agreement, from Step 9 to Step 10. Copy filed.

The Board approved the reclassification of Jerardo Z. Cruz, Civilian Jailer, County Sheriff Dept., $17.48/hour, effective 09/09/2009. Per DSDOA/CWA contract agreement, from Class 2 to Class 1. Copy filed.

Motion by Boykin second by Walish to approve and authorize the chairman to sign a letter of agreement between Siouxland District Health and Woodbury County for the administration of influenza vaccine to Woodbury County employees for FY 2009-2010. Carried 5-0. Copy filed.

The Board discussed County health insurance with Ed Guilliland, Gallagher Benefit Services.

A public hearing was held at 10:15 a.m. for the sale of property parcel #534825 (1635 S. Fairmount Street). The Chairman called on anyone wishing to be heard.

Motion by Boykin second by Monson to close the hearing. Carried 5-0.

Motion by Boykin second by Walish to approve the sale of property parcel #534825 (1635 S. Fairmount Street) to Jaime and Iran Ortega for $1.00, plus recording fees. Carried 5-0.

RESOLUTION OF THE BOARD OF SUPERVISORS
OF WOODBURY COUNTY, IOWA:
RESOLUTION # 10,594

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By Jaime Ortega and Iran Ortega______in the sum of ONE & 00/100 ($1.00)--------------------------------------dollars.

For the following described real estate, To Wit:

Parcel #534825
Lots Six (6) Block Forty-Two (42) West Morningside Addition, City of Sioux City,
Woodbury County, Iowa
(1635 S. Fairmount Street)

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

NOTICE OF PROPERTY SALE

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Healys South One Hundred (100) Ft., Lot Six (6), Block Four (4)
Healys North Fifty (50) Ft., Lot Six (6), Block Four (4), City of Sioux City, Woodbury County, Iowa
(1505, 1507 Dale St.)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 25th Day of August, 2009 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate on the 25th Day of August, 2009, immediately following the closing of the public hearing to the City of Sioux City, Iowa, only per Code of Iowa 331.361 (2).

3. That said Board proposes to sell the said real estate to City of Sioux City, Iowa, only for consideration of $2.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

BOARD OF SUPERVISORS RESOLUTION
RESOLUTION # 10,596
RESOLUTION ACCEPTING AND APPROVING HINKEL ADDITION,
WOODBURY COUNTY, IOWA

WHEREAS, the owners and proprietors did on the 1st day of April, 2009, file with the Woodbury County Zoning Commission a certain plat designated as Hinkel Addition, Woodbury County, Iowa; and

WHEREAS, it appears that said plat conforms with all of the provisions of the Code of the State of Iowa and ordinances of Woodbury County, Iowa, with reference to the filing of same; and

WHEREAS, the Zoning Commission of Woodbury County, Iowa has recommended the acceptance and approval of said plat; and

WHEREAS, the County Engineer of Woodbury County, Iowa has recommended the acceptance and approval of said plat.

NOW, THEREFORE, BE, AND IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, that the plat of Hinkel Addition, Woodbury County, State of Iowa, be, and the same is hereby accepted and approved, and the Chairman and Secretary of the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, are hereby directed to furnish to the owners and proprietors a certified copy of this resolution as required by law.

Motion by Boykin second by Smith to approve and authorize the Chairman to sign a Permit for Use of County Road/Highway Right-of-Way for Overhead and/or Buried Utilities Accommodation submitted by Long Lines for work on Stone Avenue, Concord Township, for underground fiber cable, per recommendation of County Engineer Mark Nahra. Motion by Boykin second by Walish to approve and authorize the Chairman to sign an Application to Adopt-a-Highway permit submitted by the Boy Scout Troop 272, for work along D38 from Sergeant Bluff to Old Highway 141, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Walish second by Smith to approve and authorize the Chairman to sign an Iowa Department of Transportation Federal-aid Agreement for project #BROS-CO97(100)8J-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to approve and authorize the Chairman to sign FY 2010 Agreement to Provide Public Health and Home Care Aide Services to the Residents of Woodbury County, per recommendation of Linda Drey, Siouxland District Health. Carried 5-0. Copy filed.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign FY 2010 Agreement to Comply and Provide Chore Services to the Residents of Woodbury County, per recommendation of Linda Drey, Siouxland District Health. Carried 5-0. Copy filed.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

The closed session, per Iowa Code Section 21.5(1)(1), for a general relief appeal for L. V. did not take place as the appellant did not appear.

Motion by Walish second by Boykin to go into closed session, per Iowa Code Section 21.5(a). Carried 5-0 on a roll-call vote.

Motion by Boykin second by Monson to go out of closed session, per Iowa Code Section 21.5(a). Carried 5-0 on a roll-call vote.

Motion by Monson second by Boykin to approve and authorize the chairman to sign a memorandum of understanding discussed in the executive session. Carried 5-0; confidential copy filed in the Board office.

The Board adjourned the regular meeting until August 18, 2009.
