AUGUST 25, 2009THIRTY-FOURTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, August 25, 2009 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, Smith, and Walish. Staff members present were Karen James, Board Administrator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Walish second by Smith to approve the Board minutes of the 08/18/2009 meeting as submitted. Carried 5-0. Copy filed.

Motion by Walish second by Smith to approve the Board minutes of the 08/19/2009 special meeting as submitted. Carried 5-0. Copy filed.

Motion by Boykin second by Smith to approve and authorize the Chairman to sign an Authorization To Initiate Hiring Process form for:

Appointed Percentage 2nd Deputy, County Sheriff Dept. Entry level: Appointed 83%, $75,206/year.

Carried 5-0. Copy filed.

The Board approved the separation of Drew A. Conover, Summer Laborer, Secondary Roads Dept., effective 08/14/2009. End of temporary work. Copy filed.

The Board approved the separation of Kyle A. Grieme, Summer Laborer, Secondary Roads Dept., effective 08/19/2009. End of temporary work. Copy filed.

The Board approved the appointment of Amy D. Stensland, Case Manager, Social Services Dept., $36,582/year, effective 08/26/2009. Job vacancy posted 07/15/2009. Entry level salary: $36,582/year. Copy filed.

The Board approved the transfer of Douglas E. Boetger, Appointed Percentage 2nd Deputy, County Sheriff Dept., $75,206/year, effective 09/01/2009. Per County Sheriff, transfer from Deputy Sergeant to a Percentage 2nd Deputy. Copy filed.

The Board approved the reclassification of Kristine M. Timmins, Assistant County Attorney, County Attorney Dept., $57,969/year, effective 09/17/2009. Per AFSCME County Attorney contract agreement, from Step 4 to Step 5. Copy filed.

The Board approved the reclassification of Daniel M. Whitlock, Civilian Jailer, County Sheriff Dept., $16.81/hour, effective 09/25/2009. Per DSDOA/CWA contract agreement, from Class 3 to Class 2. Copy filed.

A public hearing was held at 10:15 a.m. for the sale of property parcels #197010 and #196995 (aka 1505 Dale Street and 1507 Dale Street). The Chairman called on anyone wishing to be heard.

Motion by Boykin second by Monson to close the hearing. Carried 5-0.

Motion by Monson second by Walish to approve the sale of property parcels #197010 and #196995 to the City of Sioux City, in the amount of $2.00, plus recording fees. Carried 5-0.

RESOLUTION OF THE BOARD OF SUPERVISORS
OF WOODBURY COUNTY, IOWA:
RESOLUTION # 10,600

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of:

By CITY OF SIOUX CITY_________in the sum of TWO & 00/100 ($2.00)-----------------------------------dollars.

For the following described real estate, To Wit:

Parcel #197010 and #196995
South One Hundred Feet (S 100 ft) Lot Six (6) Block Four (4); North Fifty feet (N 50 ft.) Lot Six
(6), Block Four (4), Healys Addition City of Sioux City, Woodbury County, Iowa

Now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted: said Amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said Real Estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign a Certificate of Completion for project
#L-G06(2)73-97, per recommendation of County Engineer Mark Nahra. Carried 5-0. Copy filed.

Motion by Walish second by Boykin to approve and authorize the Chairman to sign a Resolution approving tax abatement for the City of Bronson for parcels #884628326008 and #884628302003 used for ballpark purposes. Carried 5-0.

WHEREAS, the above stated property has an unpaid balance of taxes owing, and the parcel is owned by a political subdivision of the state; and

WHEREAS, the political subdivision, namely the City of Bronson, Iowa, is failing to immediately pay the taxes due; and

WHEREAS, the Board of Supervisors sees that good cause exists for the abatement of these taxes; and

NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby abates the taxes owing on the above parcels according to Code of Iowa, 445.63, and hereby directs the Woodbury County Treasurer to abate these aforementioned taxes from the tax records.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Patty Erickson-Puttmann invited the Board to attend the Iowa High School Rodeo Association event to be held at the Woodbury County Fair Grounds this weekend.

The Board adjourned the regular meeting until September 1, 2009.
