SEPTEMBER 22, 2009THIRTY-EIGHTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS

The Board of Supervisors met on Tuesday, September 22, 2009 at 9:00 a.m. Board members present were Boykin, Clausen, Monson, Smith, and Walish. Staff members present were Karen James, Board Administrative Coordinator, Loan Hensley, Assistant County Attorney, and Patrick F. Gill, Auditor/Clerk to the Board.

The Claims were approved as presented. Copy filed.

Board of Supervisors meeting was called to order.

Motion by Monson second by Boykin to approve the Board minutes of the 09/15/2009 meeting as submitted. Carried
5-0. Copy filed.

The Board approved the reclassification of Amy L. Ellis, Assistant County Attorney, County Attorney Dept., $67,885/year, effective 10/02/2008. Per AFSCME Assistant Attorney contract agreement, from Step 7 to Step 8. Copy filed.

The Health Committee presented a report to the Board.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign a Resolution setting the sale date for property parcel #245775 (415 16th Street). Carried 5-0.

WHEREAS Woodbury County, Iowa was the owner under a tax deed of a certain parcel of real estate described as:

Higmans Addition E 46.4 Ft. W 78.4 Ft. S 52 2/3 Ft. Lot 2, Block 9, City of Sioux
City, Woodbury County, IA
(415 16th Street)

NOW THEREFORE,

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa as follows:

1. That a public hearing on the aforesaid proposal shall be held on the 6th Day of October, 2009 at 10:15 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 6th Day of October, 2009, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $575.00 plus recording fees.

4. That this resolution, preceded by the caption 'Notice of Property Sale' and except for this subparagraph 4 be published as notice of the aforesaid proposal, hearing and sale.

1. That a public hearing on the aforesaid proposal shall be held on the 6th Day of October, 2009 at 10:16 oclock a.m. in the meeting room of the Board of Supervisors on the first floor of the Woodbury County Courthouse.

2. That said Board proposes to sell the said parcel of real estate at a public auction to be held on the 6th Day of October, 2009, immediately following the closing of the public hearing.

3. That said Board proposes to sell the said real estate to the highest bidder at or above a total minimum bid of $289.00 plus recording fees.

Motion by Monson second by Walish to approve tax abatement on a building on leased land, parcel #884730301970, Martin Bettin, for 2009-2010 taxes total due $34.00, per recommendation of County Treasurer Bob Knowler. Carried 5-0.

There was no action taken to approve a supervisory staff addition for Motor Vehicle, per request of the County Treasurer.

The Board discussed raising bond limits for Elected Officials with Bob Knowler.

The Board discussed architectural services for the first floor public restrooms with Social Services Director, Patty Erickson-Puttmann.

Motion by Monson second by Boykin to approve and authorize the Chairman to sign an agreement with RDG (amendment #2) to provide architectural services for the Courthouse first floor public restrooms, subject to the removal of the words, without a maximum. Carried 5-0. Copy filed.

The Board discussed funding sources for Courthouse first floor handicapped restrooms, with County Budget/Tax Analyst Dennis Butler.

Motion by Monson second by Smith to approve and authorize the Chairman to sign a Permit for Use of County Road/Highway Right-of-way for Overhead and/or Buried Utilities Accommodation submitted by High Tech Electric, LLC to install a telephone drop on 120th Street, Concord Township, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Walish second by Boykin to approve and authorize the Chairman to sign a payment voucher for materials inspection costs for DOT project #BRS-CO97(80)60-97, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Motion by Boykin second by Monson to approve and authorize the Chairman to sign agreement #69-6114-9 between Woodbury County and the United States Department of Agriculture and Natural Resources Conservation Service, for Weir construction near 120th Street in Banner Township, Section 13, per recommendation of the County Engineer. Carried 5-0. Copy filed.

Bid letting was held at 10:20 a.m. for calcium chloride for Secondary Roads Dept.

There were no bids.

Jack Burright, Woodbury County Farm Bureau, presented a resolution approved by the Woodbury County Farm Bureau Board of Directors, in support of rebuilding the Port Neal Landing exit bridge at its current location.

Leo Jochum, 1691 250th Street, Salix, Dan Glee, Salix, Linda Cox, Salix Mayor, 121 Old Highway 75, Salix, and Larry Hunt, 2245 310th Street, Sloan, spoke in support of the resolution.

The Board discussed a possible grant application for funds for the Pathways out of poverty program, with Julie Stoik, Western Iowa Tech Community College.

Motion by Walish second by Boykin to approve and authorize the Chairman to sign a Resolution of commitment and to authorize a partnership with Western Iowa Tech Community College as lead applicant, endorsing the submission of a grant application for Pathways out of poverty funds. Carried 5-0.

WOODBURY COUNTY, IOWA
RESOLUTION #10,609

WHEREAS, Woodbury County, Iowa is defined as an area of high poverty by the data reported from the U.S. Census Bureaus 2005-2007 American Community Survey (ACS) 3-year Estimates; and

WHEREAS, the United States Department of Labor Employment and Training Administration is accepting grant applications from areas of high poverty for its competitive grant program Pathways out of Poverty to provide disadvantaged individuals 18 years of age or older with opportunities to access training and placement services for careers in the energy efficiency and renewable energy industries; and

WHEREAS, a partnership of area agencies and organizations is interested in submitting a grant application in response to the Department of Labor opportunity; and

WHEREAS, this partnership will not be able to assist Woodbury County residents without the assistance of the Department of Labor grant:

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS THAT WOODBURY COUNTY does hereby support and endorse the efforts of the partnership and Western Iowa Tech Community College, as the lead agency, to seek out a grant from the U.S. Department of Labor; and

FURTHER BE IT RESOLVED, that interested departments of Woodbury County may participate in the grant project and utilize their funding streams, based on eligibility and governing regulations, to assist the partnership and its project participants to provide Woodbury County residents with pathways out of poverty and into employment within the industries of energy efficiency and renewable energy.

The Chairman asked if there were any individuals or groups wishing to make a presentation of items not on the agenda or Supervisors concerns.

Rob Marqusee, Rural Economic Development Director, updated the board on recent developments.

The Board postponed a tour of the Law Enforcement Center roof.

The Board adjourned the regular meeting until October 6, 2009.
